The proposed use is located in the "TODD(MU-5)", Transit Oriented Development District (Mixed Use-5) Zoning District which permits general restaurants through the Special Use Approval. Process. Staff Analysis: The applicant is proposing to convert an existing vacant space (2,066 sq. ft.) in a one story building located across from City Hall at 6101 Sunset Drive to a general restaurant. The occupant is to be Starbucks. The remainder of the building (5344 sq. ft.) will be retail uses. The parking requirement for the proposed restaurant is 21 spaces (I space for every 100 sq. ft.) and the retail portion of the building will require 18 parking spaces (I space for every 300 sq. ft.). A total of 39 parking spaces is required by the provisions of the Land Development Code. The applicant's submitted plan shows a total of 42 parking spaces provided in the form of 35 off -street parking spaces in a surface lot behind the building and a total of 7 on street spaces located along Sunset Drive and SW 61 Avenue. The applicant is permitted to count the on-street spaces in front of the business establishment to meet the required off -street parking requirement (LDC Section 20- 4.4(A)(1) ). The Parking Board at a special meeting on Tuesday, July 3, 2007, reviewed the subject application and recommended (vote: 3 ayes and I nay) that the application be approved with the limitation that only four abutting on-street metered spaces be counted toward meeting the required parking for the building. Planning Board Action: The Planning Board at its July 10, 2007 meeting adopted a motion by a vote of 6 ayes 0 nays recommending approval of the special use request with conditions (see below). (2) Recommendation: The requested special use complies with the LDC requirements set forth for special uses in Section 20-3.4 and the conditional use requirements set forth in Section 20-5.8. The placement of a coffee house/restaurant at this location is appropriate and will be an excellent addition to current uses along Sunset Drive in this area. It is recommended that the Commission approve the application subject to the following conditions (1) The applicant's plans be adjusted to show that only four of the seven abutting on-street metered spaces be counted as meeting the required parking for the building. The overall purpose is to determine the compatibility of the proposed use with the surrounding neighborhood. A special use must comply with the conditions set forth in Section 20- 5.8(B) in that the use: (a) Will not adversely affect the health or safety of persons residing or working in the vicinity of the proposed use; (b) Will not be detrimental to the public welfare or property or improvements in the neighborhood; (c) complies with all other applicable Code provisions. Mr. Morton questioned why an individual from the Parking Board voted against the Resolution. Mr. Perez responded the Parking Board member was concerned with the allocation of the parking spaces. Ms. Young stated that under the recommendation a word was left out. Planning Board Meeting Page 3 of 3 Ms. Beckman questioned if the idea of having two restaurants, as had been proposed before, was no longer in the works. She questioned whether the remaining retail space is pending or existing retail. Mr. Youkilis stated it would only be one restaurant. Sally Baumgartner, agent for the owner, clarified that currently there is a beauty salon however the applicant was negotiating with another bank and a small pharmacy. The ratio of parking is 11300 for retail use therefore the four parking spaces on the street would be required. Ms. Beckman stated that employee parking seems to be a problem therefore she questioned how employees will be accommodated. Ms. Baumgartner stated that Starbucks has requested five parking spaces for their employees however Starbucks pays for their employee's parking. Ms. Young questioned why the Parking Board recommended a limitation where only four spaces could be counted as opposed to seven. Mr. Perez responded the limitation exists because the applicant needs only four spaces in order to meet their parking requirement. Ms. Young indicated that the language is not clear under the recommendation therefore, it should be changed to reflect there are seven parking spaces, of which four were granted to the applicant. Mr. Perez stated that staff will review the language because the current language is that which was given by the Parking Board and it could not be changed. Mr. Youkilis advised the condition given by staff may be changed to read "that only four of the seven needed spaces would be counted as meeting their required parking for the building." Ms. Chael questioned why the applicant would not consider outdoor dining. Ms. Baumgartner replied that the front of the building will be cut back allowing for outdoor dining which is part of Starbuck's leaseable area. Motion: Ms. Beckman motioned to approval the special use to allow a general restaurant to be located at 6101 Sunset Drive with the following conditions. Ms. Young seconded. (1) "The applicant's plans shall be adjusted to show that only four of the seven needed spaces would be counted as needing their required parking for the building."
