A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH
MIAMI, RELATING TO A REQUEST PURSUANT TO SECTION 20- 3.3(D) OF THE LAND

SPECIFICALLY. LOCATED AT 6394 S. DIXIE HIGHWAY; PROVIDING FOR AN
EFFECTIVE DATE
WHEREAS, pursuant to section 20- 3.3(D) of the Land Development Code applicants Miguel
Cervoni and Teresita Carro have filed Application No. PB -06 -038 requesting a Special Use Approval to
operate an animal hospital at 6394 S. Dixie Highway; and
WHEREAS, an animal hospital is allowed as a special use in the "GR" General Retail zoning
district subject to meeting general conditions specified in LDC Section 20 -5.8 and subject to meeting
special requirements set forth in LDC Section 20- 3.4(B)(21); and
WHEREAS, the approval of a special use requires a recommendation from the Planning Board
and the approval of the City Commission after a public hearing; and
WHEREAS, on December 12, 2006 the Planning Board, after public hearing, voted 6 ayes 0
nays to recommend approval with conditions of the special use request; and
WHEREAS, the Mayor and City Commission of the City of South Miami desire to accept the
recommendation of the Planning Board.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION
OF THE CITY OF SOUTH MIAMI, FLORIDA:
Section 1: The application for special use approval to allow for an animal hospital to be located at 6394
S. Dixie Highway in the "GR" General Retail zoning use district is hereby approved subject to the
following conditions:
(1) All such uses shall be located within a fully enclosed, air- conditioned, soundproof structure.
(2) There shall be no overnight boarding of animals except for medical purposes_
(3) The hours of operation for visits and treatment will be 7:00 a.m. to 9:00 p.m. Monday through
Saturday; hours of operation shall not prevent emergency medical treatment
(4) The applicant shall provide a revised site plan showing the actual dimensions of the building„
parking spaces, and driveways prior to the application being forwarded to the City Commission.
(5) The applicant's final site plan shall show additional landscaping on the site covering at minimum the
area of three parking spaces.
(6) If the subject use is, in the future, determined by the Director of Planning , to be adversely affecting
the health or safety of persons residing or working in the vicinity of the proposed use, to be detrimental
to the public welfare or property or improvements in the neighborhood, or to be not in compliance with

other applicable Code provisions, the special use approval may be modified or revoked by the City
Commission upon notification and public hearing.
Section 2: This resolution shall be effective immediately after the adoption hereof.

Background: The applicants Miguel Cervoni and Teresita Carro have filed Application No. PB -06 -038
requesting a Special Use Approval to operate an animal hospital at the above referenced location. The proposed use
is located in the "GR" General Retail Zoning Use District. An animal hospital is permitted with Special Use
Approval. The applicant is requesting a special use permit to use 2468 sq. ft. of a one story building (3326 sq. ft.)
at 6394 S. Dixie Highway as an animal hospital. A smaller portion of the building is occupied by an automobile
rental agency.
The site faces S. Dixie Highway and the only access to the site is from S. Dixie Highway. In the GR zone to the
south of the site is an auto repair shop, to the north is a restaurant. The property to the rear is a. multi-family
building in the RM -24 zone district. A tall landscape hedge provides a significant buffer between the residential
units and the parking lot to the rear.
A total of 7 parking spaces are required for the animal hospital. And three spaces for the car rental agency. The
applicant's submitted site plan indicates 28 spaces provided for both uses. The submitted site plan should be
revised in order to show specific dimensions for each space
Planning Board Action:
The Planning Board at its December 12, 2006 meeting, after public hearing, adopted a motion by a vote of 6 ayes
0 nays recommending approval with conditions of the special exception request.
Recommendation:
The placement of an animal clinic at this location is compatible with current uses in the GR zoning use district
along S. Dixie Highway. In addition the requested use complies with the LDC requirements set forth for special
uses in Section 20 -5.8. Approval of the application with the following conditions is recommended:
(1) All such uses shall be located within a fully enclosed, air - conditioned, soundproof structure.

APPLICANT'S REQUEST:
Pursuant to section 20-3.3(D) of the Land Development Code (LDC) the applicant is requesting a Special
Use Approval to operate an animal hospital at the above referenced location. The proposed use is located
in the "GR' General Retail Zoning Use District. An animal hospital is permitted with Special Use
Approval. The proposed use must meet the requirements for special uses contained under Section 20 -5.8
Special Use Approval and Section 20 -3.4 (21), Special Conditions for Animal Hospital/Veterinarian.
STAFF ANALYSIS:
The applicant is requesting a special use permit to use 2468 sq. ft. of a one story building (3326 sq. ft.) at
6394 S. Dixie Highway as an animal hospital. A smaller portion of the building is occupied by a an

receipt of a recommendation from the Planning Board. The overall purpose is to determine the

compatibility of the proposed use with the surrounding neighborhood. A special use must comply with
the conditions set forth in Section 20- 5.8(B) in that the use:
a) Will not adversely affect the health or safety of persons residing or working in the vicinity of
the proposed use,
b) Will not be detrimental to the public welfare or property or improvements in the
neighborhood; and,
(c) Complies with all other applicable Code provisions.
In addition to the general conditions applicable to special uses, an animal hospital also must comply with
specific limitations set forth in the Section 20 -3.4 (21) of the Code for Animal Hospitals. These
conditions are listed below (Conditions 1,2, 3) in the recommendation section of this report
