No. 066-08-12663RESOLUTIONNO. 66-08-12663 WHEREAS, applicant Maria Barcena (Maria -Maria Skin/Body) Dubey has submitted Historic Preservation Board Application No. BPB -08 -015 requesting a Certificate of Appropriateness approving the installation of a wall sign in the center of the building at the second floor level on a designated historic site at 5851 Sunset Drive (Shelley Building 5837 Sunset Dr.).; and WHEREAS, pursuant to Section 20- 5 -19(E) (3) of the Land Development Code, a "Certificate of Appropriateness" is required for applications affecting the exterior (renovation, repair, painting, demolition or landscaping); and WHEREAS, Section 20- 5.19(E)(3) of the South Miami Land Development Code requires the City Commission to conduct a public hearing on certificates of appropriateness and to approve, deny, approve in modified form, or defer a subject application; and WHEREAS, the Historic Preservation Board at its March 31, 2008 meeting felt that the location of this sign in the middle of the upper facade would degrade the appearance of the shaped parapet which is a key design element of the historic building; and WHEREAS, the applicant agreed to place the wall sign either on the front facade at the first floor level or on the west facade at the first or second floor level; and WHEREAS the Historic Preservation Board adopted a motion by a vote of 7 ayes 0 nays recommending approval of the requested Certificate of Appropriateness with the condition that the wall sign may only be placed on the front facade at the first floor level or on the west facade at the first or second floor level; and WHEREAS, the Mayor and City Commission of the City of South Miami desire to accept the recommendation of the Historic Preservation Board. HIS'T'ORIC BOARD ACTION The Historic Preservation Board reviewed the applicant's proposed sign at its March 31, 2008 meeting. It is the policy of the Planning Department and the Historic Preservation Board that signage shall be kept to a minimum on historic buildings. The Board felt that the location of this sign in the middle of the upper facade would degrade the appearance of the shaped parapet which is a key design element of the historic building. At the Board's request, the applicant agreed to place the wall sign either on the facade at the first floor level or on the west facade of the first or second floor level. The Board then adopted a motion by a vote of 7 ayes 0 nays recommending approval of the requested Certificate of Appropriateness for a wall sign with the limitation that it be located the on the facade at the first floor level or on west facade of the first or second floor level. Mr. Hochstim stated that a sign on the proposed parapet should be the name of the building and not the name of a business occupying the building. He recommended that the sign be placed on one of the arches above the first floor or on the west side of the arcade. Mr. Youkilis advised that there is a window on the second level of the west facade. The applicant replied that a sign on the west side of the arcade will require the owner's approval. She advised that the lease indicates that the owner has the right to reject a sign if he doesn't approve it. Therefore, if the Board approves the sign on the -west side and the owner does not approve it she runs the risk of not being approved for any sign. The applicant was in favor of cordially working with the Board and their recommendations. Mr. Kurtzman recommended placing the sign on a first floor open arch. The applicant replied that there is an open space however there is a conflict because the current tenant has a similar business. Motion: Mr. Hochstim moved to approve the signage installation with the conditions that the sign be located on the first floor west fagade or on an ach on the first floor frontage not presently with a sign and that the size be appropriately scaled to the location and Mr. Kurtzman seconded.
