No. 061-09-12870RESOLUTION NO. 61` -09 -12870 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA, RELATING TO PROVIDING SUPPORT FOR PROPOSED STATE LEGISLATION, SUPPORTING HOUSE BILL 1315 AND SENATE BILL 2644 RELATING TO CONSTRUCTION OF ELECTRICAL TRANSMISSION LINES; DIRECTING THE CITY CLERK TO PROVIDE A COPY OF THIS RESOLUTION, UPON ENACTMENT, TO THE PSC; THE GOVERNOR; FLORIDA HOUSE OF REPRESENTATIVES, THE SENATE, THE FLORIDA LEAGUE OF CITIES, MIAMI -DADE COUNTY BOARD OF. COUNTY COMMISSIONERS; OUR SISTER CITIES IN MIAMI -DADE COUNTY; AND THE MIAMI -DADE COUNTY LEAGUE OF CITIES; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the Mayor and City Commission of the City of South Miami are concerned about electrical transmission lines and the proposal to install transmission lines in residential corridors within the City of South Miami; and, WHEREAS, Representative Brise has proposed a Florida House Bill, Bill 1315, which bill removes exceptions to requirements for electric utility to obtain certification prior to construction of transmission line; requires electric utility to notify affected municipalities of proposed transmission line sites & routes; requires disclosure of methods used to determine routes & efforts to minimize impact on municipality; authorizes municipality to request hearing by PSC to determine disputes with electric utility; authorizes municipality to bring action challenging transmission line siting; authorizes local governmental entity that requests electric transmission lines be placed underground to share underground installation costs with any surrounding governmental entity that benefits from installation; and, WHEREAS, Florida Senate Representative Siplin, has proposed a Florida Senate Bill, Bill 2644, which is identical to Representative Brise's Bill; and, WHEREAS, both the Senate and House Bill are under review during this legislative session; and, WHEREAS, the Mayor and City Commission desire to urge the passage of Senate Bill 2644, and House Bill 1315, NOW THEREFORE BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA; Page 1 of 2 Additions shown by underlinin¢ and deletions shown by everstriking. Res. No. 61 -09 -12870 Section 1. The above whereas clauses are incorporated by reference into this resolution. Section 2. The City Clerk is directed to provide a copy of this resolution to the PSC; Governor Charlie Christ; the Florida House of Representatives; the Florida Senate; Senate Representative Siplin, House Representative Brise; the Florida League of Cities; the Miami -Dade League of Cities; Miami -Dade County; and our Sister Cities in Miami -Dade County. Section 3 This resolution shall take effect immediately upon approval.
