No. 164-09-12973RESOLUTION NO. 164 -09 -12973 A RESOLUTION OF THE MAYOR & CITY COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA, RELATING TO INTERIM CITY ATTORNEY; REQUESTING THAT THE TERM "INTERIM" BE DROPPED AND THAT LAURENCE FEINGOLD BE DECLARED THE CITY ATTORNEY OF THE CITY OF SOUTH MIAMI; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City Attorney serves at the pleasure of the City Commission and may be terminated at any time by majority vote; and WHEREAS, if such termination occurs, it is understood that there is no severance or other funds due Mr. Feingold, other than the monies he has earned to date; and WHEREAS, the new title of Mr. Feingold will not affect the ability of the City of South Miami to hire a new City Attorney from the current Request for Proposals (RFP) if it is determined that the City Commission wants to replace Mr. Feingold. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA, THAT: Section 1. The City Commission wishes to declare Laurence Feingold as City Attorney of the City of South Miami, rather than the Interim City Attorney. Section 2. The City Commission asks the City Manager to calculate the percentage of Mr. Feingold's fee that should be paid by the South Miami Community Redevelopment Agency (SMCRA), including, but not limited to, affordable housing, where Mr. Feingold's assistant, Mark A.
