No. 116-09-12925RESOLUTION NO. 116-09-12925 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA CONCERNING AN APPLICATION SUBMITTED BY CHAMBER SOUTH: (1) TO PERMIT PURSUANT TO LAND DEVELOPMENT CODE SECTION 20- 4.3(1) THE INSTALLATION OF A BANNER AT 5800 SUNSET DRIVE TO PROMOTE THE 38TH ANNUAL SOUTH MIAMI ART FESTIVAL TO BE HELD IN THE SOUTH MIAMI DOWNTOWN, NOVEMBER 7 -8, 2009; (2) REQUESTING A WAIVER OF THE TEMPORARY RIGHT -OF -WAY USAGE FEE FOR THE TWO DAY FESTIVAL; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, pursuant to Land Development Code Section 20 -4.3 (N) `Banners over rights -of way" all non - profit organizations proposing to display a special event banner over a City street must submit a Banner Request Application; and WHEREAS, the applicant, Chamber South, a non - profit organization, has submitted a Banner Request Application asking for approval to hang a banner over Sunset Drive at 5800 Sunset Drive in order to promote the 38`h Annual South Miami Art Festival, an event to be held in the South Miami downtown on the weekend of November 7 -8, 2009; and WHEREAS, the submitted application contains the required insurance statement, banner design document, and fee; and WHEREAS, the applicant, Chamber South, is also requesting a waiver of the temporary right -of way usage fee for the 381h Annual South Miami Art Festival,; and. WHEREAS, the Mayor and City Commission of the City of South Miami desire to support the 38th Annual South Miami Art Festival. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA: Section 1. That the application submitted by Chamber South, a non - profit organization; requesting approval to hang a banner over Sunset Drive at 5800 Sunset Drive in order to promote the 381h Annual South Miami Art Festival, an event to be held in the South Miami downtown on the weekend of November 7 -8, 2009 is hereby approved for hanging during the period October 23- November 7, 2009. Section 2. Chamber South, request for a waiver of the temporary right -of way usage fee for the 387 Aual South Miami Art Festival is hereby approved. Section 3. APPLICANT'S REQUEST The applicant, Chamber South, a non -profit organization, has submitted a Banner Request Application asking for approval to hang a banner over Sunset Drive at 5800 Sunset Drive in order to promote the 381h Annual South Miami Art Festival, an event to be held in the South Miami downtown on the weekend of November 7 -8, 2009. Chamber South is also requesting the waiver of the temporary right -of way usage fee for the two day festival. APPLICABLE REGULATIONS Attached is Land Development Code Section 20 -4.3 (N) which sets forth regulations governing the placement of banners. SPECIFIC BANNER REQUEST It is requested that the proposed banner be placed across Sunset Drive at 5800 Sunset Drive. The event is scheduled to take place on the weekend of November 7 -8, 2009. Attached is a copy of the application, and a banner design document. The adopted ordinance limits the display period for a banner to a maximum of 14 days prior to the event. The banner will be displayed October 23- November 7, 2009. WAIVER OF FEE REQUEST It is customary for the City to waive certain fees for special events which are sponsored or supported by the City itself. Chamber South is requesting a waiver of the temporary right -of way usage fee for the two day festival. RECOMMENDATION It is recommended that the banner request be approved for the time period limit set forth in the Land Development Code (14 days prior to the event); and the requested waiver of the temporary right -of way usage fee for the two day festival be approved. The following principles shall control the computation of sign area and sign height: (1) Computation of Area of Individual Signs. The area of a sign shall be computed by means of the smallest square, circle, rectangle, triangle, or combination thereof that will encompass the extreme limits of the sign content, together with any material or color forming an integral part of the background of the display or used to differentiate the sign from the backdrop or structure against which it is placed, but not including any supporting structure clearly incidental to the display itself or any other clearly incidental decorative element; (2) Computation of Area of Multi -faced Signs. The sign area for a sign with more than one (1) face shall be computed by adding together the area of all sign faces visible from any one (1) point. When two (2) identical sign faces are placed back to back, so that both faces cannot be viewed from any point at the same time, and when such sign faces are part of the same sign structure and are not more than three (3) feet apart, the sign area shall be computed by the measurement of one of the faces; and . (3) Computation of Height. The height of a sign shall be computed as the distance from grade as defined in this Code to the top of the highest component of the sign or supporting structure. (N) Banners over Rights -of -Way. ✓�` (1) Organizations wishing to display a banner over rights -of -way in the City of South Miami must submit to the Planning Department a 'Banner Request" application at least thirty (30) days in advance. (2) The city commission will review all requests and will determine whether the request conforms to the following guidelines: (a) Only not for profit organizations may display banners; (b) Banners for no more than three (3) special events shall be displayed at any given time; (c) Banners may be displayed ten (10) to fourteen (14) days before the advertised event takes place; banners must be removed within five (5) days after the end of the special event. (d) Banner design, color, size, proposed location and wording must be approved by the city commission, and must be submitted along with request. (3) The organization displaying a banner must provide proof of public liability insurance naming the City of South Miami as additionally insured for the period of time banner is displayed. (4) The organization must pay a two hundred and fifty- dollar ($250.00) fee in advance or the actual cost incurred by the city to hang and remove the banner. The city Supp. No. 12 92.1 20 -4.3 SOUTH MIAMI LAND DEVELOPMENT CODE commission may adjust this fee from time to time in order to reflect the current costs of installation. No. 22 -01 -1753, § 1, 10 -2 -01; Ord. No. 10 -07 -1911, § 1, 5 -1 -07) 20 -4.4 Off- street parking requirements. (A) Applicability. All structures and uses which are erected, established or enlarged within the City shall provide adequate off - street parking spaces and control mechanisms for on -site vehicular and pedestrian traffic in order to insure the safety and convenience of the public pursuant to the requirements of this section. (1) On- street parking spaces not currently assigned or credited to other properties adjacent to a lot may count toward the parking requirements for a building set forth below in subsection (B) for that lot, provided that the property owner complies with subsection 20 -4.4 (A)(3); a partial space longer than eleven (11) feet shall count as a full space. (2) Unimproved rights -of -way adjacent to business property in commercial zoning dis- tricts may be improved by the abutting property owner for credit as on- street parking spaces by written agreement approved by the application to the City Manager provided that the property owner complies with subsection 20- 4.4(A)(3). The City Manager upon the advice of the Parking Board, will determine if the installation of parking meters is warranted and appropriate for the area. (3) An annual fee of one thousand dollars ($1,000.00), per space, which shall increase five (5) percent annually, shall be paid into the Parking Fund for all on- street parking spaces which are credited or counted toward required parking for new structures, or a change in use that increases the minimum number of off - street spaces required after the date of January 2, 2008. (Ord. No. 31 -08 -1966, § 1, 8- 27 -08) (B) Space Requirements. The minimum number of off - street parking spaces required for each permitted or special use shall be as set forth below and referenced in Section 20 -3.3D. Where fractional spaces result, the number of spaces required shall be the next highest whole number. (1) Two (2) spaces per dwelling unit. (2) Two (2) spaces per dwelling unit, provided that at least one (1) space per unit shall be enclosed. (3) One and one -half (1.5) spaces per efficiency or studio unit and two (2) spaces per unit with one (1) or more bedrooms, plus an additional visitor space for every ten (10) units. (4) One (1) space per guest room, plus two (2) spaces for the reception office.
