RESOLUTIONNO. 10_09_12819 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA RELATING TO THE ISSUANCE OF A CERTIFICATE OF APPROPRIATENESS PURSUANT TO SECTION 20- 5.19(E)(3) OF THE LAND DEVELOPMENT CODE FOR THE INSTALLATION OF A WALL SIGN ON A DESIGNATED HISTORIC SITE (SHELLEY BUILDING) LOCATED AT 5851 SUNSET DRIVE, PROVIDING AN EFFECTIVE DATE. WHEREAS an applicant, Professional Signs Inc. is requesting a Certificate of Appropriateness for the installation of a sign on the marquee and a wall sign on a designated historic site at 5881 Sunset Drive (Shelley Building); and WHEREAS, pursuant to Section 20- 5.19(E) of the Land Development Code, a "Certificate of Appropriateness ", is required for applications affecting the exterior (renovation, repair, painting, signage, demolition or landscaping) of properties designated historic; and WHEREAS, Section 20- 5.19(E)(3) of the South Miami Land Development Code requires the City Commission to conduct a public hearing on certificates of appropriateness and to approve, deny, approve in modified form, or defer a subject application; and WHEREAS, the Historic Preservation Board at its December 29, 2008 meeting adopted a motion by a vote of 4 ayes 0 nays recommending approval with revisions of the requested Certificate of Appropriateness for the installation of a wall sign on a designated historic site at 5881 Red Road (Shelley Building); and WHEREAS, the Mayor and City Commission of the City of South Miami desire to accept the recommendation of the Historic Preservation Board. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA THAT: Section 1. Historic Preservation Board Application No. BPB -08 -025 requesting a Certificate of Appropriateness which will allow for the installation of a wall sign on a designated historic site at 5881 Sunset Drive (Shelley Building) is hereby approved as shown on the applicant's plans marked "Exhibit "A" attached to this resolution. The recommendation of the Historic Preservation Board on this request is now being transmitted to the City Commission for final approval. PROPOSED SIGNAGE The applicant is proposing to place a wall sign at the first floor of the building. The sign will contain the name and logo of "Imprevo Salon ", a new business which will occupy part of the second floor of the building. Attached is a drawing of the sign and location photographs. The sign area is 12 sq. ft. which is well below the maximum permitted size of a "flat" wall sign (20% of the fagade or max. of 200 sq. ft.). HISTORIC BOARD ACTION The Historic Preservation Board reviewed the applicant's proposed signage at its December 29, 2008 meeting. The Historic Preservation Board suggested several changes in the submitted sign plan. The Board then adopted a motion by a vote of 4 ayes 0 nays recommending approval of the requested Certificate of Appropriateness to allow the installation of the wall sign. RECOMMENDATION Approval of the requested Certificate of Appropriateness to allow the installation of the wall sign, in accordance with the revised sign plan marked `Exhibit A ", and dated 1 -4 -09. The sign area is 24 sq. ft. which is well below the maximum permitted size of a "flat" wall sign (20% of the fagade or max. of 200 sq. ft.). The LDC regulation governing wall signs read as follows: FLAT SIGNS with a total aggregate sign area, not to exceed twenty (20) percent of the area of any building face; for the purposes of sign regulation, there shall be considered to be only four (4) facades to any building; no single sign shall exceed two hundred (200) square feet in area. Direct illumination is permitted. The applicant should demonstrate that the wording on the signage is the official business (legal) name of the business. It is also the policy of the Planning Department that signage shall be kept to a minimum on historic buildings and the location of sia age should be in harmony with the fagade design. The location of the proposed sign is not aligned with.,the curved arches and is a distraction on the front fagade of the building. The wall sign should be moved to the east and be aligned at the top of the second curved arch. (This will require the removal of an illegal banner sign currently in that space) Staff recommends that the request to place this sign be approved at he location set forth above. Action: Mr. Youkilis explained that the applicant's request is to place a wall sign on the first floor of the Shelly building on 5851 Sunset Drive. He commented that the sign will have the wording "Imprevo Paul Mitchell Salon ". The business will be occupying the second floor of the building. The signage is 24 sq feet and is dimensionally within code. Mr. Youkilis recommended approval with the condition that the wall sign should be moved to the east and be aligned at the top of the second curved arch, which requires the removal of an illegal banner and the applicant should demonstrate that the wording on the signage is the official business (legal) name of the business. Mr. Ruiz de Castilla questioned who was the owner of the banner and if it had been removed. Mr. Youkilis replied that he did not know who was the owner of the banner was or if it had been removed, but it has already been mentioned to Code Enforcement who had cited the owner. The applicant Hilda, the Professional Signs Inc, represented the owner of the business and stated that she is not familiar with the other signage on the building. Ms. Clyatt commented that the signage does not have a border in comparison to the other signs on the building. Mr. Ruiz de Castilla then commented that the Alta Cocina has been approved the way it is. Mr. Youkilis commented that Alta Cocina business occupies two spaces and the sign is centered over the two arches. Mr. Hochstim commented that there is a misinterpretation on the drawings and graphically that represent the existing signs on the west side are off centered, when it is actually centered on the arch. He then commented that there will not be enough room if the sign is to be placed between the two arches above the columns. Mr. Youkilis commented that staff recommended that the sign is to be centered over the second arch and the removal of "Paul Mitchell'. The name will read "Improve, Salon." Mr. Hochstim commented that if the applicant were to place the word salon with the dimensions given it would look out of place, it would be too small. He then recommended that increasing the size of the word Salon to make it more compatible with the word Imprevo or the graphics smaller. Mr. Ruiz de Castilla questioned if the graphics of Impravo is that the logo. The applicant replied that she did not know, but the sign could be changed. He then suggested changing the design of the word salon to look as one sign not two. The applicant questioned if the signage could be on one line. Mr. Ruiz de Castilla replied that the signage will look like one sign if salon is placed under the name Imprevo, it is smaller right underneath it without stretching it or widening it. Mr. Hochstim questioned if the applicant would need to resubmit to the Historic Board. Mr. Youkilis replied that the applicant needs to bring a redesign Signage Plan to staff before it goes City Commission. Motion: Mr. Hochstim moved and Mr. Ruiz de Castilla seconded the motion to approve the signage with the following conditions: 1) The sign is to be centered above the second arch from the west. 2) The wording "Paul Mitchell' is to be eliminated. 3) The word salon is could be incorporated into the signage to read as one sign. 4) The sign should line up horizontally.
