10I ORDINANCE NO. __ _ An Ordinance of the City of South Miami, Florida confirming the abandonment of that alley commonly known as 41 st Street Bird Road Alley. 1 2 WHEREAS, the City Commission has the power to vacate, abandon, discontinue and 3 close an existing public or private street, alley-way, road, highway or other place used for travel 4 or any portion thereof, other than a state or federal highway, and to renounce and disclaim any 5 right of the City and the public in and to any land in connection therewith; and 6 7 WHEREAS, on July 28, 1992 a public hearing was set for September 1, 1992 at 7:30 8 P.M. and notice thereof was published in a newspaper of general circulation in Miami-Dade 9 County at least two weeks prior to the date stated therein for such hearing; and 10 11 WHEREAS, the City Commission completed the public hearing and adopted the 12 recommendation that the 41 ST Bird Road Alley (which is legally described in the attached 13 Exhibit "A") be abandoned, renounced, and disclaimed by the City of South Miami, and shall, 14 pursuant to the plat creating that alley, revert the title thereto to the immediate adjacent 15 properties; and 16 17 WHEREAS, by Ordinance number 33-92-1527 dated December 1, 1992 the City 18 Commission abandoned, renounced, and disclaimed the 41 sl Bird Road Alley to take effect 19 immediately at the time of its passage which then vested the title thereto to the immediate 20 adjacent properties; and 21 22 WHEREAS, the said Ordinance directed that Notice of the adoption of the Ordinance by 23 the Commission be published one time, within 30 days following its adoption, in one issue of a 24 newspaper of general circulation published in Miami-Dade County, and additionally directed that 25 the proof of publication of notice of public hearing, the Ordinance as adopted, and the proof of 26 publication of the notice of the adoption of such Ordinance shall be recorded in the deed records 27 of Miami-Dade County, Florida; and 28 29 WHEREAS, the proof of the publication of the Notice of the adoption of the Ordinance 30 by the Commission cannot be located among the records of the City; and 31 32 WHEREAS, no record of the recording of the proof of publication of notice of public 33 hearing and of the notice of the adoption of such ordinance appears in the deed records of 34 Miami-Dade County, Florida; and 35 36 WHEREAS, the City Commission wishes to confirm and ratify the adoption of the said 37 Ordinance nunc pro tunc to December 1, 1992 notwithstanding the possible lack of publication 38 and the non-recording; 39 40 NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY 41 COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA: Page 1 of 2 1 Section 1. Ordinance No. 33-92-1527 which abandoned, renounced, and disclaimed the 2 alley commonly known as 41 st Street Bird Road Alley and legally described in the attached 3 Exhibit "A" and transferred the title equally thereto to the immediate adjacent property owners 4 properties is hereby confirmed and ratified nunc pro tunc to the date of its adoption on December 5 1, 1992. The property owner shall pay the costs associated with the abandonment of this 6 property, including costs of all publication concerning this ordinance and the cost of recording of 7 this ordinance, all attachments thereto and the proof of publication. 8 9 Section 2. Notice of the adoption of this Ordinance by the Commission shall be 10 published one time, within 30 days following its adoption in one issue of a newspaper of general 11 circulation published in Miami-Dade County, Florida. 12 13 Section 3. The proof of publication of (1) the notice of public hearing where this 14 ordinance was debated and enacted and (2) the publication of the notice of the adoption of this 15 Ordinance as required by Section 2 above shall be recorded in the deed records of Miami-Dade 16 County, Florida together with this ordinance and the original Ordinance dated December 1, 1992 17 18 19 Section 4. If any section, clause, sentence, or phrase of this Ordinance is held to be 20 invalid or unconstitutional by any court of competent jurisdiction, then said holding shall in no 21 way affect the validity of the remaining portions of this Ordinance. 22 23 Section 5.
