2 A Resolution for the purpose of submitting to the electors the question of
3 whether the City's General Elections should be moved from February to
4 November of even numbered years to coincide with the date on which the
5 federal government's general elections are held.

7 WHEREAS, the Mayor and City Commission seek to increase voter turnout and thereby
8 enfranchise a greater number of South Miami citizens in their governance;
9
10 WHEREAS, voter turnout in City elections has proven to increase significantly when
11 City elections are held at the same time as federal general elections;
12
13 WHEREAS, the Mayor and City Commission seek to increase efficiency and lower
14 costs, while maintaining or increasing the quality of conducting City business, including
15 elections;
16
17 WHEREAS, election costs have proven to be reduced significantly when City elections
18 are held at the same time as federal general elections;
19
20 WHEREAS, the Mayor and City Commission seek to move the City's General Elections
21 to coincide with the federal government's general elections and have proposed this change to the
22 Article V, Section 2 of the City Charter;

24 WHEREAS, to the extent a change for the date of City General Elections from February
25 to November of even numbered years increases a City elected official's term of office, the Mayor
26 and City Commission approve such extension solely to facilitate this transition in election date;
27 and

29 WHEREAS, these proposed changes to Article V to the City Charter on Elections will
30 be submitted to City residents in February 2014.

32 NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY
33 COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA THAT:

35 Section 1: The following question shall be submitted to the electors of the City of South
36 Miami at the next general election:

40 Shall the City Charter be amended for purposes of changing the City'S General
41 Elections from February to November of each even numbered year to coincide
42 with the federal government's general elections and allow the resulting eight
43 month extension of term for elected officials that would be caused by such
44 change?

5 Section 2: If the question is approved by a majority of the voters in the general election,
6 the Charter for the City of South Miami shall be amended as follows:

15 SECTION 2. General Elections.

17 A. Time General elections for the Commission shall be held during· February-of
18 eachevenyearjat the same time as the federal general elections held in each even
19 year, the day, place and time to be set by ordinance, at which time the Mayor shall be
20 elected to a term of two years and two Commissioners shall be elected to terms of four
21 years. Any extension of term resulting from this change of timing for general
22 elections shall be permitted, notwithstanding any language in this Charter or other
23 City ordinance or rule to the contrary. (See Art.II,Sec.2)

27 Section 3: If any section, clause, sentence, or phrase of this resolution is for any reason
28 held invalid or unconstitutional by a court of competent jurisdiction, the holding shall not affect
29 the validity of the remaining portions of this resolution.
30 Section 4. This resolution shall become effective immediately upon adoption by vote of
31 the City Commission.
