A Resolution of the City of South Miami relating a Final Plat approval to allow for the

BACKGROUND:
6835 SW LLC, Turgo Homesites, owner of Tract 6, of said "Nelson Homesites" submitted an application
to the City for an adjustment to the lot lines of a previously approved plat. A tentative plat application
No. T-23401 was also filed with Miami Dade County, pursuant to Section 28-4 of Miami Dade County
Code and Section 20-4.2 of the City's Land Development Code. The applicant owns both properties
specifically located at 6835 6805 SW 67 Street within an RS-l, Estate Residential zoning district and is
requesting this replat in order move the lot line between both parcels by approximately five (5), feet to
accommodate a bathroom addition on the east side of the existing single-family home located at 6435 SW
67 Street.
ANALYSIS:
As submitted for review and comments, the TENTATIVE PLAT signed and sealed by Rene Aiguesvives
P.S.M., Professional Surveyor and Mapper for the firm Alvarez, Aiguesvives and Associates., field dated
June 28, 2013, illustrates proposed Lot 1 and Lot 2 of Block 1 as follows:

The West 166 feet of Track 6, NELSON HOMESITES, according to the plat thereof, as recorded in Plat
Book 39, Page 57, of the Public Records of Miami-Dade County, Florida.
Containing 50,496 square feet.
Lot 2, Block 1:
Tract 6 less the West 166 feet thereof, of NELSON HOMESITES, according to the plat thereof,
as recorded in Plat Book 39, Page 57, of the Public Records of Miami-Dade County, Florida.
Containing 47,401.3 square feet.
The proposed Tentative Plat would vary the current lot width frontages and the lot areas of the two
existing single residential properties (indicated as Lots 1 and 2 of Block 1) zoned RS-l "Estate
Residential," located at 6835 SW 67th Street and 6805 SW 67th Street. Currently, the two lots total 322
feet of frontage, each lot consisting of 161 feet. As proposed, the lot line between both parcels would shift
five feet towards the east. Therefore, Lot 1 would gain five feet of frontage from Lot 2; Lot 1 would also
increase in lot" area. The lots will range in size from 47,401.3 to 50,496 square feet (Figure 2). The
minimum lot size within the RS-l zoning use district is 40,000 square feet. The two parcels at this
location are consistent with the RS-l "Estate Residential" zoning on the north, south, east and west. The
proposed tentative plat is maintaining lots that are larger than required by the land development
regulations for RS-l, as indicated below.

Zoning District: "RS-l" Estate Residential District:
The purpose of this is to provide for estate type single-family residential development located in a
spacious rural-like setting which emphasizes the preservation of open space. This district is appropriate in
areas designated "Single-Family" on the city's adopted Comprehensive Plan.
Pursuant to Section 20-3.5E of the Land Development Code, Dimensional Requirements Single-Family
District are as follows:

Lot size: 50,496 s.f., Minimum lot size 40,000 s.f. required.

WHEREAS, 6835 SW LLC, Turgo Homesites, owner of Tract 6, of said "Nelson Homesites"
submitted a Tentative Plat to Miami Dade County, application No. T-23401, pursuant to Section 28-4 of
Miami Dade County Code; and
WHRERAS, the Miami Dade County plat committee met on September 6, 2013 and
recommended approval of the tentative plat subject to any provisions enumerated in their approval letter,
and subject to final plat approval by the City; and
WHEREAS, the replat application requests a lot line adjustment of five feet from 6805 SW 67
Street to facilitate an addition to the existing home located on the abutting lot, specifically located at 6835
SW 67 Street; and
WHEREAS, the replat is in compliance with the City's requirements within the RS-l, Estate
Residential zoning district; and
WHEREAS, the Mayor and City Commission desire to approve the final plat pursuant to Section
20-4.2(B) of the City of South Miami Land Development Code, and Section 28-4 of the Miami-Dade
County Code.
NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF
THE CITY OF SOUTH MIAMI, FLORIDA:
Section 1. The application submitted by 6835 SW LLC, Turgo Homesites, requesting approval of
a proposed Final Plat for the property legally described in Section 2, pursuant to section 20-4.2(b) of the
Land Subdivision Regulations is hereby , and subject to the following
conditions, and/or other conditions deemed appropriate by the City Commission:
