9 The following members of the City Commission were present: Mayor Stoddard, Vice
10 Mayor Liebman, Commissioner Newman, Commissioner Harris, Commissioner Welsh.

~ RESOLUTION(S) SECOND READING
1:. A Resolution to consider, approve, reject or modify a settlement agreement
between Metro South Senior Apartments Limited Partnership and the City of
South Miami under the Florida Land Use and Environmental Dispute
Resolution Act. 3/5 (City Manager)
23 Attorney for the applicant Amy Boulris addressed the Commission about the
24 revisions of the Agreement.

26 Architect Dusan Peric with Metro South, also addressed the Commission.

28 The public hearing was opened and the following individual(s) addressed the
29 Commission: Gray Reed, Beth Schwartz, Yvonne Beckman, Antoinette Fischer.

31 At this time Mr. Pepe outlined the following provisions to be added to the
32 Development Agreement: restricting tenants from moving in and out during certain times;
33 residents being evicted will not be put on the street or on public property; City of South Miami
34 residents will be given precedence to the extent allowed by law to rent in this facility; decals
35 will be given to each unit to be used for one parking space; there will be an arm to stop
36 nonresidents from entering the residential parking area.

1 Mr. Pepe said for clarification that the City is not up-zoning this parcel.

3 Moved by Mayor Stoddard to add all of the above provisions to the Development
4 Agreement as outlined by the City Attorney. Seconded by Commissioner Welsh the motion
5 passed unanimously.

7 Moved by Mayor Stoddard, seconded by Vice Mayor Liebman, the motion to approve as
8 amended Resolution No. 188-13-14006 to consider, approve, reject or modify a settlement
9 agreement between Metro South Senior Apartments Limited Partnership and the City of South
10 Miami under the Florida Land Use and Environmental Dispute Resolution Act, passed by a 5 -0
11 vote:
