An Ordinance related to a request for a zoning map amendment to the City of South Miami
official zoning map, to re-zone the Agency owned property assemblage referred to as the
Marshall Williamson properties (Madison Square redevelopment west), folio numbers 09-
4025-000-0850; 09-4025-000-0852; and 09-4025-065-0090, from a current zoning designation
of "RS-4" (Single-Family) to the "RM-18" (Low Density Multi-Family Residential) to allow
for additional residential dwelling units within the Madison Square Mixed-Use
Development Project.
BACKGROUND
The South Miami Community Redevelopment Agency (SMCRA) Board at its June 10, 2013
meeting received a report from the Agency Director proposing that the Planning and Zoning
Department be requested to initiate the process of rezoning the approximately 0.92 acre Marshall
Williamson property that is owned by the CRA, for inclusion in the Madison Square development
project. This property acquired by the CRA in 2009-2010, should be used as a site for additional
multi-family affordable/workforce housing. The property lies to the west of the main
development site, along SW 60 Avenue and consists of three lots on the south side of SW 64
Terrace surrounding the historic Williamson House located at 6500 SW 60th Avenue (Figure 1).
At their June 10,2013 Board meeting, the SMCRA Board approved the following motion:
SMCRA Board Approved Motion #2 -"Authorization for the SMCRA to submit a request to
the City of South Miami Planning & Zoning Board to amend existing land-use and zoning ofthe
Historic Marshall Williamson site (Folio #'s 09-4025-000-0850; 09-4025-000-0852 and 09-4025-
065-0090) from and existing RS-4 Residential Zoning District to an RM-18 Multi-Family
Zoning District; and from an existing Single-Family land-use category to a Multi-Family
Residential land-use category.
At the August 7, 2012 City Commission meeting, the Commission approved Ordinance 10-12-
2126 effectively converting the remaining Madison Square development properties to a unified
Future Land Use designation of Mixed-Use Commercial Residential. In December 2012 the City
Commission also approved the rezoning of the Madison Square property assemblage from NR -
Neighborhood Retail, to SR -Specialty Retail for the development of approximately 35 units in a
mixed use project. This request is to rezone the property just west ofSW 60th Avenue from RS-4,

Single Family Residential, to RM-18, 'which is a 2-story Multi-Family Residential (Figure 2)
district in order to develop additional townhomes in conjunction with the main mixed use
development site. Given the site area of approximately 40,000 square feet, the project could gain
up to an additional 16 residential units.

Compatibility of Use
The proposed development site is surrounded by single-family, two-family (duplex), multi-family
development. There are also several religious institutions, commercial and public/institutional
uses. The subject property is bounded on three sides by existing streets; is approximately 80 feet
from the main Madison Square development assemblage and abuts Marshall Williamson Park and
recreational facilities to the rear, along S W 61 st Court.
Public Facilities
The developer selected to construct this project will be responsible for assuring that public
infrastructure serving the site will be sufficient. The CRA and the City will work with the
developer to ensure the standards are met.
Parks/Recreation
It is important to note that the LDC also allows the City to consider allocating surplus recreational
capacity to a developer of affordable housing(Affordable Housing Concurrency Reserve). The

City currently has surplus recreational capacity (acreage). A developer would have to obtain a "A
Certificate of Capacity Reservation", which would avoid the fee payment for the required park
space. This requires a separate application made to the Planning and Zoning Department and an
approval of a resolution by the City Commission (LDC Sec. 20-4.1 (F). Based upon the City's
current Level of Service standard (Recreation/Open Space Element; Objective 1.1 -four acres for
every 1000 population).
Public Schools
Once the total unit count for the entire Madison Square mixed-use project has been established,
the Planning Department will file an application with the Miami-Dade County School District for
a concurrency review and impact fee assessment.
Water and Wastewater
The developer will be required to submit necessary plans to Miami-Dade Water and Sewer to
determine if sufficient capacity exists at time of construction permit.
Transportation/Traffic
The development in this area is within an established urban infill redevelopment area and within
the County's redevelopment exception area. However, the developer will be required to provide a
traffic study for the project to address any other impacts.

The proposed development is compatible with and advances the goals and objectives contained
in the City's Comprehensive Plan. The proposed change also furthers the goals and objectives of
the CRA plan with the provision of additional affordable and workforce housing units.
HOUSING ELEMENT
Goal1 To assure the availability of sound and affordable housing for all current and future
residents of the City of South Miami with special focus on infill and redevelopment and to
include housing units in the Hometown District. It is recognized
that the choice of location rests with the individual and that the City's role is to implement
policies that expand choices.
Objective 1.1 The City shall support public and private efforts to provide at least 100 additional
housing units, and aspire for the creation of 200 additional units, by 2015. Additionally, the City
shall seek to provide an adequate supply of housing units that are affordable to households of all
incomes, including the middle income sector, in proportions that are reflective of housing
demands and needs in residential projects and communities.
STAFF OBSERVATIONS
While the particular site is in close proximity to existing single-family residential, there is a
considerable mix of other types of residential development and-uses within the general area.' It is
the intent of the Madison Square development project to maintain a cohesive residential character
with the project, one that is sensitive to the existing single family residential development.
The location of this site within the CRA and Urban Infill and Redevelopment Boundary; its
proximity to the main Madison Square development project; its furtherance of the City's
Comprehensive Plan goals and objectives, and the CRA Plan for the provision of additional
affordable and workforce housing, all add up to positive benefits for the community.
RECOMMENDATION
The Planning Board at their meeting on August 13,2013, conducted a public hearing to discuss
application PB-13-028. Following discussion between the board, staff, applicant, and the public,
the board adopted a motion by a vote of 5 ayes and 0 nays, to recommend approval of the
proposed rezoning of the following properties from RS-4 to RM-18; folio numbers 09-4025-000-
0850; 09-4025-000-0852; and 09-4025-065-0090.
Staff also recommends that these properties be added to the Madison Square assemblage through
unity oftitle.

WHEREAS, on June 1 0,2013, the South Miami Community Redevelopment Agency (SMCRA)

WHEREAS, the purpose of the change of zoning is to provide compatibility with the Future Land
Use Designation of Multi Family Residential, and to permit development of additional affordable two-
story residential townhomes, as a part of the Madison Square Mixed Use Development Project; and
WHEREAS, after review and consideration, the Planning and Zoning Department recommended
approval of the requested zoning use district amendment, in conjunction with a companion application for
a Future Land Use Map amendment from Single Family Residential to Multiple Family Residential; and
WHEREAS, on August 13, 2013, the Planning Board considered application PB-13-028, and
following a public hearing, recommended approval of the proposed amendment to the official zoning map
by a vote of 5 ayes and 0 nays; and
WHEREAS, the City Commission desires to accept the recommendation of the Planning Board.
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND THE CITY
COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA:
Section 1 The Commission finds that the approval of the rezoning request is for a public purpose
and substantially advances the health, safety and general welfare of the community, and benefits the
public, in general, as opposed to solely providing an individual benefit.
Section 2. The proposed change to the City's Official Zoning Map requested by South Miami
Community Redevelopment Agency Application No, PB-13-028; said application requesting an
amendment to the official zoning map of the City of South Miami by changing the zoning use district for
the property assemblage known as Marshall Williamson properties (Madison Square redevelopment
west), having the following Folio numbers: 09-4025-000-0850; 09-4025-000-0852; and 09-4025-065-
0090 from a current zoning designation of "RS-4" (Single-Family) to the "RM-18" (Low Density Multi-

Section 3. Severability. If any section, clause, sentence, or phrase of this ordinance is for any
reason held invalid or unconstitutional by a court of competent jurisdiction, this holding shall not affect
the validity of the remaining portions of this ordinance.
Section 4. Ordinances in Conflict. All ordinances or parts of ordinances and all sections and
parts of sections of ordinances in direct conflict herewith are hereby repealed. However, it is not the
intent of this section to repeal entire ordinances, or parts of ordinances, that give the appearance of being
in conflict when the two ordinances can be harmonized or when only a portion of the ordinance in conflict
needs to be repealed to harmonize the ordinances. If the ordinance in conflict can be harmonized by
amending its terms, it is hereby amended to harmonize the two ordinances. Therefore, only that portion
that needs to be repealed to harmonize the two ordinances shall be repealed. '
Section 5. Effective Date. This ordinance shall become effective upon enactment.

As indicated in the June 13,2013 e-mail correspondence, the Community Redevelopment Agency
Board during their June 10, 201.3 Meeting authorized the Agency to submit a application to the
City of South. Miami Planning & Zoning Department requesting a land-use and zoning amendment
for Madison Square redevelopment properties identified (lS Folio Numbers 09-4025-000-0850;
09-4025-000-0852 and 09-4025-065-0090.
The above listed properties are currently zoned RS-4 Residential with a corresponding land-use
designation of Single-Family Residential. The attached application requests a zoning change from
RS-4 Residential to RM-18 Multi-family Residential and from an existing land-use designation of
Single-Family Residential to Multi-Family Residential.
Please note that the official June 10, 2013 SMCRA Board Meeting minutes have yet to be
completed however, confirmation of the two (2) unanimously approved SMCRA Board motions
authorizing submittal of special-use and land-use related applications to the City's Planning &
Zoning Department may be obtained from the Office of the City Clerk/SMCRA Secretary.
In light of related project deadlines including submittal of a tax credit application to the Florida
Housing Finance Corporation, the attached request is time sensitive in nature. If you have

Green Mills Investments LLC is intends to submit a tax credit application to the Florida Housing
Finance Corporation as early as August lJ 2013. The milestone schedule is therefore quite
ambitious. The SMCRA Board and Commission are also interested in moving the project
forward in an as expeditious manner as possible.

City of South Miami Ordinance No. 08-06-1876 requires all lobbyists before engaging in any lobbying activities
to register with the City Clerk and pay an annual fee of$500 per Ordinance No. 44-08-1979. This applies to all
persons who are retained (whether paid or not) to represent a business entity or organization to influence "City"
action. "City" action is broadly described to include the ranking and selection of professional consultants, and
virtually all-legislative, quasi-judicial and administrative action.

Applicant: South Miami Community Redevelopment Agency
A Resolution related to a request pursuant to Section 20-3.5(D) of the South Miami Land
Development Code, requesting an additional (third) floor within the Madison Square
Mixed Use Development Project, located between SW 60 Avenue and SW 59 Court; and
between SW 64 Street and SW 66 Street.

Applicant: Oscar Sol (Project Developer) and Luigi Vitalini (Project Architect)
Mr. Sol stated that they were selected by the CRA board for this project and gathered feedback
from the different stakeholders such as the City, staff, elected officials, area residents and
community groups. He stated next that what became apparent was that there were conflicting and
various ideas as to the development of this property. He then stated that some groups expressed
the desire for greater density, others were of the opinion to higher than four stories and no less,
and others shared a concern for a limited height adjacent to single family homes. He stated that
they tried to comply with the many requests and find the right balance.
Mr. Vitalini gave a brief presentation of the project to the Board.
Mr. Sol stated that one apartment building and two small houses will be demoed in the area in
order to implement this project. Mr. Vitalini stated that it is important to note that retail will be
located along sixty-Fourth Street which was one of the requests that was largely expressed by
everyone. Mr. Sol stated that what they are proposing will consist of one .bedroom units, two
bedroom units, and three bedroom units built with a total of forty-one units. Mr. Brimo stated
that the rent is regulated by the Miami-Dade County Area Median Income (AMI) which adjusts
annually; if the project is not builtin the time frame that has been set the amount may increase or
decrease. Mr. Sol stated that this formula is used by the State of Florida and Miami-Dade County
Housing and Urban Development (RUD) based on the annual incomes of the families. Mr. James
McCants, the CRA Outreach Coordinator stated that there are a total of eight displaced families
that will be relocated with the aid of the CRA. He also stated that they will be given first priority
in choosing to move back once this project is complete. Mr. Sol stated that the commercial retail
. that will be located on the first floor will be geared to promote jobs within the CRA area and
encourage the residents to shop and receive services within the neighborhood opposed to
travelling a number of miles away.

He stated that this has been a very tedious process almost three decades of trying to get projects
such as Madison Square, Murray Park Pool and others completed. He also stated that what is
currently being proposed he and other residents are in favor of. He stated next that affordable
housing is very much needed within South Miami and several people have moved away due to a
lack thereof. He then stated that he implores the Board to recommend this proposal.

buildings that face 64 th Street only. Mr. Carreras seconded the motion.

Regarding Neighborhood Trees
The City of Coral Gables will be holding several informational meetings to discuss the
Neighborhood Tree Succession Plan and Tree Initiation Plan being developed. During
these meetings. City staff will discuss plans to replace missing. dead or diseased trees
throughout neighborho(,d streets. as well as determining street tree themes for those
neighborhoods with no Clearly defined street tree theme. The public is invited to attend.

A Resolution authorizing the City Managerto enter into a two (2) year vehicle rental agreement with Enterprise Rent-A~Garfor
rental vehicles used in undercover pollee operations by the Police Department and authorizing the City Manager to disburse
up to $30,000.00 per year over a two year period from the federal forfeiture rentaillease police vehicles account number
615-1910-521-4450 (Purchase/Lease-Police Vehicles).
A Resolution authorizing the South Miami Community Redevelopment Agency ("SMCRA") to convey property owned by the
