An Ordinance of the City of South Miami amending the land
development codeSection 20-3.3(D),Permitted UseScheduleand
Section 20-7.12(B),Permitted Uses;to permit certain additional uses
within RS-5 and SR zoning districts,and to correct a scriveners error
related to school parking and special use conditions.
WHEREAS,theCityCommissionexpressedaninteresttoamendthepermitteduse
schedule withintheSpecialtyRetailzoningdistricttopermitbyright,Physical Therapists;and
WHEREAS,thepermitteduseschedulecurrentlyallowssimilarprofessionalservices
withintheSpecialtyRetailzoningdistrictandtheaddition of thisusewillenhancethose
services;and
WHEREAS,the Planning Department,in reviewing the request toamendthe permitted
use schedule also recommends the following changes:
Allowing "Home Occupation"asa permitted useintheRS-5 zoning district,tobe consistent
with the other residential zoning districts;and
Correcting a scriveners error under Educational Uses "schools,elementary or secondary",
moving thespecialuse condition and off street parking requirements tothe correct columns;and
WHEREAS,application PB-13-032 proposingthese amendments wasreviewedbythe
PlanningBoardon December 10,2013,andfollowingapublichearing,voted5ayesand0nays
to recommend thattheCity Commission approvetheamendmentsas proposed.
NOW,THEREFORE,BE IT ORDAINED BY THE MAYOR AND THE CITY

Section 2.Codification.The provisions of this ordinance shall become andbemadepart
of theCode of Ordinances of theCity of South Miami as amended;thatthe sections of this
ordinance may be renumbered or re-lettered to accomplish such intention;andthattheword
"ordinance"may be changed to "section"or other appropriate word.
Section 3.Severability.If any section,clause,sentence,or phrase of this ordinance is
forany reason held invalid or unconstitutional byacourt of competent jurisdiction,this holding
shall not affect the validity of the remaining portions of this ordinance.
Section 4.Ordinances in Conflict.All ordinances or parts of ordinances andall
sectionsandparts of sections of ordinances indirectconflict herewith areherebyrepealed.
However,itisnottheintent of thissectiontorepealentire ordinances,orparts of ordinances,
thatgivethe appearance of being in conflict whenthetwo ordinances canbe harmonized or
whenonlya portion of the ordinance inconflictneedstobe repealed to harmonize the
ordinances.If the ordinance in conflict can be harmonized by amending its terms,itis hereby
amended to harmonize thetwo ordinances.Therefore,only that portion that needs tobe repealed
to harmonize thetwo ordinances shall be repealed.

BACKGROUND
Atthe request ofthe Vice Mayor,the administration was asked to review the appropriateness of
amending theland development code,permitted use schedule to include "physical therapists"within the
SR-Specialty Retail zoning district.Additionally,in reviewing the permitted use schedule,the Planning
Department is also recommending an amendment tothe RS-5 district to permit "home occupations"and
an amendment to the Schools uses to correct an error in the table.
Currentlytheland development codedoesnotpermit physical therapists asa professional use within the
SR zoning district,however it does permit similar uses such as acupuncturists,massage therapists,
chiropractic office and physical fitness facilities.Physical therapists fall within this categoiy andarealow
impactusethatis appropriate forthis district.Theparking requirement forthisuseinother districts where
itis currently permitted,is1spaceper200 gross square feet.Both Section 20-3.3(D),Permitted Use
ScheduleandSection20-7.12(B),PermittedUsesin Hometown Overlaywillneedtobe amended.
Staffis also recommending that "home occupations",which are currently permitted by right in all ofthe
"R"districts but one,be allowed inthe RS-5 zoning district.Section 20-3.6(P)ofthe land development
code provides specific conditions under which a home occupation canbe approved and licensed.
Additionally,under Educational Uses inthe permitted use schedule,the special use conditions and
parking requirements for elementary and secondary schools are printed inthe wrong columns.This
proposed amendment will correct this scriveners error.
