A Resolution of the City of South Miami relating to a request to allow for the creation of
parcels 1 through 4, on property specifically located at 6150 SW 80th Street; 6120 SW 80th
Street; and 6040 SW 80th Street, South Miami, Florida within an RS-3; Low Density
Single-Family Residential Zoning District, as permitted by provisions pertaining to
"Waiver of Plat" set forth in Section 20-4.2(B) of the City of South Miami Land
Development Code, and Section 28-4 of the Miami-Dade County Code; for the purpose of
constructing four new single family homes; and providing for a legal description.
BACKGROUND:
On May ih, 2013, an application for Waiver of Plat was filed by the owner of the properties, MIGG
Development, LLC, in order to divide three existing single family residential parcels located at 6150,
6120, AND 6040 SW 80 th Street into five (5) new single family lots as described below.
This application [PB-13-017] requesting a waiver of plat was presented to the Planning Board for
review and recommendation at the June 11, 2013 regular meeting. Following a public hearing
and discussion on the item, the Board recommended unanimously (5 ayes 0 nays) to recommend
denial of the application. The denial was based on the fact that the five proposed lots, although
meeting the minimum dimensional requirements for the RS-3 zoning district, failed to meet the
provision of Section 20-4.2(B)(2)(a) of the City's Land Development Regulations that states in
part "The building site created by the proposed waiver-ol-plat will be equal to or larger than the
majority of the existing building sites ... ". All of the proposed lots would range between 1 0,995
square feet to 11,004 square feet (Figure 1). There was discussion at the Planning Board meeting
regarding reducing the request from five to four lots, which would be more in harmony with the
adjacent and surrounding properties. Please refer to the attached minutes.
Subsequent to the Planning Board hearing, the applicant reconsidered the original application
and has now filed a revised application proposing a waiver of plat to divide three existing single
family residential parcels located at 6150, 6120, AND 6040 SW 80 th Street into four (4) new
single family lots. This item had originally been scheduled to be heard by the City Commission
at their August 20, 2013 meeting. However, it was ruled by the City Attorney that it should be
sent back to the Planning Board for a re-review of the four lot proposal prior to Commission
action on application PB-13-029.

Said lands containing 13,676.6 square feet, more or less, lying and being in the SE lit of Section
36, Township 54 South, Range 40 East, situated in the City of South Miami, Miami-Dade
County, Florida.
The complete legal description of the four proposed lots, provided by Bello & Bello Land
Surveying Corporation, is attached in the backup material for reference.
ANALYSIS:
The proposed waiver of plat is intended to create four single residential properties (parcels no.
"I" "2" "3" and "4") zoned RS-3 "Low Density Residential" located at 6150 SW 80 TH Street , " , , ,
6120 SW 80 TH Street, AND 6040 SW 80 th Street. The four parcels at this location are consistent
with the RS-3 "Low Density Residential" zoning on the north, east and south. The properties to
the west ofSW 62 Avenue are within Unincorporated Miami-Dade County.
The minimum lot size within the RS-3 zoning use district is 10,000 square feet. The proposed
wavier of plat would create lots that range from 13,677 square feet to 13,759 square feet.
Pursuant to Section 20-4.2 of the City'S Land Development Code (LDC), subdivision of land is
governed by Chapter 28 of the Miami-Dade County Code of Ordinances. However, waivers of
plat are subject to the provisions of the City'S LDC, including Section 20-4.2(B)(2)(a) of the
City's Land Development Regulations, which states in part:
(2) City Commission Findings. Prior to approving a waiver-ofplat, the city
commission shall use the following guidelines:
(a) The building site created by the proposed waiver-ofplat will be equal to or
larger than the majority of the existing building sites and of the same
character as the surrounding area (this shall be demonstrated using copies
of the official plat maps for the subject property and surrounding
neighborhood). (2)
(b) The building site created by the proposed waiver-ofplat will not result in
existing structures becoming noncoriforming as they relate to setbacks and other
applicable regulations of these land development regulations.
(c) The building site created by the proposed waiver-ofplat will be free of
encroachments from abutting buildable sites.

The resulting "new" lots will be of similar character as the surrounding properties (Figure 1). In
addition, the existing geometric configuration is similar to the lots directly across the street and
that is also repeated on the eastern end of the same block. The variation in this alignment would
be the properties located directly south and abutting the subject properties (Figure 1). The
applicant provided a survey of the surrounding properties to indicate the square footages of these
properties. This survey is enumerated below. Additionally, please refer to the sections of the plat
maps that are included with your packets for additional information.

MIGG DEVLOPMENT (4 proposed lots)
1. The proposed lots fronting on SW 80 Street (Davis Rd) need Miami Dade County
approval as it mainly pertains to driveway. Although the street is within South Miami,
Miami Dade County has jurisdiction of this road.
2. Driveways are not to be constructed within 5 feet of an interior side property line and a
within 15 feet from the property line (right of way line) at corner lots.
3. The City is in the process of planning for the construction of sidewalks along SW 80 St.,
as such the developer shall provide sidewalk along the front of the lots.
4. All lots are to be connected to water and sewer. For information on the location of the
lines contact Miami Dade W ASD.
5. All planning and zoning requirements will be address separately.
6. Final site plan and water and sewer plans to be submitted South Miami PW Engineering
Division for approval.

that were based on the original proposal for five (5) new lots. The resulting amendment of the
request to four (4) new lots, will decrease any impacts the development would have on these
facilities.

This revised proposal is more in keeping with the character of the surrounding area, and aligns
with the property frontages on the north side of SW 80th Street. At their September 10, 2013
meeting, the Planning Board following a public hearing and considerable discussion by the
Board, voted 4 ayes and 2 nays to recommend the City Commission approve the proposed
waiver of plat as presented in application PB-13-029.
All existing structures on the parent tract (3-lots) will need to be demolished prior to the issuance
of a development permit to avoid creating a nonconforming structures. Additionally, all other
requirements stated by the City'S Public Works Department would still be applicable should the
Commission decide to approve the revised waiver request. Any approval of this request is
subject to County review and approval, and compliance with the City of South Miami Land
Development Code, the Comprehensive Plan and Section 20-4.1 adequate public facilities of the
Land Development Regulations.

analysis was undertaken between the existing and proposed land use intensities. The

As indicated in Table 1, the addition of two (2) single-family lots is projected to generate
approximately 19 new daily trips, approximately 2 new AM peak hour trips, and
approximately 2 new trips during the typical afternoon peak period, when compared
against the current land-use intensity. Hence, from a traffic-engineering standpoint, the
increase from three (3) single-family lots to five (5) single-family lots results in an
insignificant (De Minimus) traffic impact to the surrounding street system (one new
vehicle-trip every 30 minutes). Therefore, the proposed change in intensity will not
create any measurable traffic impacts to the surrounding street system.
Additionally, a review of the traffic concurrency stations located in the vicinity of the
subject project indicate that ample roadway capacity is available in order to absorb the
insignificant traffic impacts generated by the proposed change in land-use intensity.

Ladies and Gentlemen:
This letter is in response to your inquiry regarding water and sewer availability to the above-
referenced property for the construction of five (5) single family homes (Over 5,000 sq-ft).
The Owner shall connect to an existing twelve (12) inch water main located in S.W. 80 Street
abutting the northern boundary of the property. If water services are needed along S.W. 62
Avenue, thence connect to an existing twelve (12) inch water main in S.W. 80 Street at S.W. 62
Avenue, and install a twelve (12) inch water main southerly in S.W. 62 Avenue to the
southwestern comer of the property interconnecting to an existing six (6) inch water main at that
location. If the Fire Department requires a fire hydrant in S. W. 62 Avenue, thence connect to an
existing twelve (12) inch water main in S.W. 80 Street at S.W. 62 Avenue and install a twelve
(12) inch water main southerly in S.W. 62 Avenue as required to feed the fire hydrant
interconnecting to an existing six (6) inch water main at that location. Any public water main
extension within the property shall be twelve (12) inches minimum in diameter. If two (2) or
more fire hydrants are to be connected to a public water main extension within the property,
then the water system shall be looped with two (2) points of connection.
The OWner shall connect sewer services to any of the existing eight (8) inch gravity sewer
mains located in S.W. 80 Street and in S.W. 62 Avenue abutting the northern and western
boundaries of the property respectively.
Construction connection charges and connection charges shall be determined once the property
owner enters into an agreement for water and sewer service, provided the Department is able to
offer those services at the time of the owner's request. Information concerning the estimated
cost of facilities must be obtained from a consulting engineer. All costs of engineering and
construction will be the responsibility of the property owner. Easements must be provided
covering any on~site facilities that will be owned and operated by the Department. Other points
of connection may be established by the Department.
Please be advised that the right to connect the referenced property to the Department's sewer
system is subject to the terms, covenants and conditions set forth in the Settlement Agreement
between the Florida Department of Environmental Protection ("DEP") and the County dated Jul y
27th, 1993; the First Amendment to Settlement Agreement between DEP and the County dated

Whenever land is subdivided a plat must be recorded, except that the recording of a plat will not be required i
(1) The subdivision involved consists only of the dedication of a road, highway, street, alley or ea~
circumstances the plat division of the appropriate authority finds that it is not necessary that a
plat, the dedication may be required by deed, and may be subject to compliance with such COl

A Resolution of the City of South Miami relating to a request to allow for the creation of
parcels 1 through 5, on property specifically located at 6150 SW 80th Street; 6120 SW 80th
Street; and 6040 SW 80th Street, South Miami, Florida within an RS-3; Low Density
Single-Family Residential Zoning District, as permitted by provisions pertaining to
"Waiver of Plat" set forth in Section 20-4.2(B) of the City of South Miami Land
Development Code, and Section 28-4 of the Miami-Dade County Code; for the purpose of
constructing five new single family homes; and providing for a legal description.
Ms. Fischer read the item into the record.
Mr. Brimo presented the item to the Board.
The applicant gave an opening statement.
Dr. Whitman asked the applicant for his view of the waiver of plat ordinance. The applicant
responded that when he acquired the properties his architect Ms. Dulce Conde met with staff to
establish the options of this proposal and we moved forward with the request. Ms. Conde stated
that after several meetings with Mr. Brimo to determine the possibility of this proposal, they
made the decision to move forward. She also stated that we meet all of the requirements for a
waiver of plat according to the Land Development Code. Mr. Brimo stated that although the
proposed waiver of plat meets the minimum requirements for lot size in the RS-3 zoning district,
the proposal to create five buildable lots does not meet the requirements of Section 20-
4.2(B)(2)(a), which requires that the lots created will be equal to or larger than the majority of
the existing building sites. The proposed lots will be smaller than the most of the surrounding
lots.

Mr. Dundorf made the point that the proposal would have been more appropriate had the
applicant tried to create 4 lots rather than 5. He then asked the Board whether they (the Board)
could offer 4 lots, or if this was just an "up or down" vote. The City Attorney (Thomas Pepe)
responded that it was the applicant that would have to make the request; what's before the Board
for consideration is to split the properties into 5 lots.

The Board held a brief discussion on the proposal. Mr. Greiner wanted this comment passed
along to the Commission. He stated that this is a tough case where the underlying zoning is so
inconsistent with the "Commission findings", which make sense on this, on the plat splitting; yet
another reason to get the Code in line with what's happening on the ground.
Dr. Whitman stated that he didn't think we could really do that; "we have a lot of really
heterogeneous lots within the city, and every neighborhood you get a little lot and a big lot, and
you can't micro-zone." The zoning has to be much broader. The fact that we have several of
these waivers on the agenda is a sign that the economy is improving now. Back around 2003
there was a lot of building and a lot of splitting of the big lots and building larger homes. Before
this ordinance was put in you didn't need a public hearing; it went before the Commission on the
consent agenda with no Planning Board involvement. There was concern in the neighborhoods
that they didn't want the properties being chopped up piece by piece where it would destroy the
character. In this case as staff notes, you have three lots behind it that would now have 5 lots
behind them, and the property lines would not be contiguous. Breaks up the character of the
neighborhood.
Antoinette Fischer stated that she agreed with staffs analysis of the situation and the reason she
is on the Board is to represent the people of the City. She indicated she spoke with many of the
residents in the neighborhood who were alarmed with proposal; they don't want it to happen. She
stated that she also lives in this neighborhood since 1995. People are angry and resentful of the
lot splitting that took place 10 or 12 years ago; the lack of privacy and lack of adequate buffer
landscaping that was promised when homes were built. For the reasons stated by Mr. Brimo, her
own survey of the residents and her experience living in the community, she can't approve ofthis
proposal.
Motion: Ms. Fischer motioned for denial of the proposed item. Mr. Greiner seconded the
motion.

Dr. Philips asked the applicant if the proposal is for one story or two story homes. The applicant
responded that he believes that they will be two story homes and these are conceptual drawings
in the earliest stages of this process. Mr. Greiner stated that the lot sizes seem to be in
conformance and in general character with the average size of the lots. He then stated that it was
said that the frontages on 80 th St didn't line up with the properties across the street; this was one
of the problems that was brought up at the last meeting when this item carne before us. Mr.
Brimo stated that the proposed frontage of the lots will be one hundred feet.
The Board held a discussion on the item and these were some of the concerns:
• The Miami Dade County regulation Sec. 28-4 appears to be dealing with large tracts of
land that need to be platted for the first time it was not for re-platting. It was asked is this
in conflict with the intent of the regulation.
• The Historical background of the lots was asked for. It was asked were there any
covenants or restrictions at time of initial platting of this neighborhood.
• Have there been changes in zoning ( setbacks etc) since the initial platting of the
neighborhood? Do those now have to be adhered to retro actively.
• When the neighborhood was initially platted the homes were smaller, ranch style homes
on large lots. The 4 resulting lots will each have a two story horne and how does that
change impact on the neighborhood.
• Concern about parking, excess traffic, noise and pollution. The residents chose to live in
a low density neighborhood and this should not be violated.
• Would the current homes be straddling the lot lines in the new configuration that is being
proposed.
• Public Health Issues: low water pressure; absence of water pressure for fire hydrants on
87, 86, 85 and perhaps more streets.
• Infrastructure may not be up to par (water delivery and sewer). One engineer who is a
neighbor often mentions that our water grid is pieced together in Christmas tree fashion.
This would destabilize the neighborhood.
• There is no evidence of hardship. These are new owners who bought the property for
spec houses.

• Cited information for the Snapper Creek Charrette of 1997 showing that traffic and crime
are major concerns. It was stated that increased density was not recommended by the
neighbors.
• It was pointed out that Mimi Ferre's house and the Smith' house across the street on 82nd
street requested but did not get approval for lot splitting. In the end they built lovely
homes on large lots and their property values did not go down.
• It was stated that the recommendation for the lots to be reduced from five to four came
from a South Miami resident.
• Another concern was the possibility of having two neighbors in the rear of these homes
opposed to just having one neighbor in the rear.
• The levels of service that will be impacted by increasing density on 80 th St. .. no
sidewalks, no arcade of trees to slow down the traffic and the heavy traffic.
The Chairman stated that this not an upzoning and there is a nominal increase in density of an
additional housing unit that should not have a tremendous impact on the traffic. He also stated
that the infrastructure and the water pressure issues are concerns that will be dealt with later on
in the permitting process with Miami-Dade County and the City of South Miami. He then stated
regarding the various lot sizes with large lots backing onto two or three other lots and sometimes
up to four lots, which is prevalent throughout South Miami and finds that it provides an
interesting variety of architecture.
Mr. Cutler stated that in Pinecrest, FL waiver-of-plats are approved when it is consistent with the
surrounding area.
Mr. Fuhrman stated that there are more than nine properties that have experience this, so he feels
that this considered keeping with the neighborhood. Mr. Carreras stated that part of the charm of
South Miami is the lots on a whole are not uniform. He also stated that the fact that they are
consistent with what is across the street is more apparent as of drive down the street. He then
stated that he would much rather see uniformity across the street than to the rear yard that will
more than likely be buffered and not seen.
