Independently identified as: FY 2013-2014 General Fund Stormwater Drain Trust Fund Local Option Gas Tax Hometown Improvement Fund Tree Trust Fund Peoples Transportation Debt Service Capital Improvement Program Emergency Reserve State Forfeiture Federal Forfeiture TOTAL Appropriation Amount 16,757,088 567,818 225,000 o 3,200 935,000 1,241,634 610,000 o 12,000 842,950 21,194,690 1 ORDINANCE NO. ___ _ 2 3 An Ordinance adopting the Capital and Operating Budget of 4 $21,194,690 and pay plan for the fiscal year 2013/2014. 5 6 WHEREAS, the City Manager has submitted a proposed budget together with a 7 budget message and supporting schedule including a pay plan; and 8 9 WHEREAS, pursuant to Chapter 200, Florida Statutes, the Mayor and City 10 Commission are required to adopt a tentative, and thereafter, a final budget for the City. 11 12 NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY 13 COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA THAT: 14 15 Section I. The Budget for the fiscal year, as submitted by the City Manager, 16 including the pay plan, as filed in the City Clerk's Office, in an amount of $21,194,690, be and 17 the same is hereby approved. Any amount encumbered during Fiscal Year 2012-2013, but paid in Fiscal 22 Year 2013-2014 shall be transferred in accordance with GAAP and reflected in the 2013-2014 23 budget. 24 25 Section 3. Severability. If any section, clause, sentence, or phrase of this 26 ordinance is for any reason held invalid or unconstitutional by a court of competent jurisdiction, 27 this holding shall not affect the validity of the remaining portions of this ordinance. 28 29 30 31 32 33 34 35 36 37 38 39 40 41 42 43 44 45 46 47 48 49 50 51 52 53 54 55 56 57 Section 4. Ordinances in Conflict. All ordinances or parts of ordinances and all section and parts of sections of ordinances in direct conflict herewith are hereby repealed. However, it is not the intent of this section to repeal entire ordinances, or parts of ordinances, that give the appearance of being in conflict when the two ordinances can be harmonized or when only a portion of the ordinance in conflict needs to be repealed to harmonize the ordinances. If the ordinance in conflict can be harmonized by amending its terms, it is hereby amended to harmonize the two ordinances. Therefore, only that portion that needs to be repealed to harmonize the two ordinances shall be repealed. Section S. Effective Date.
