Request: Approval of the proposed millage rate of 4.3639 for Fiscal Year 2013-2014; this results in a 0% increase from the City's FY 2012-13 property tax rate. 1 ORDINANCE NO. ______ _ 2 3 An Ordinance levying the millage of 4.3639 which represents a 0% 4 increase from the City's current rate and approximately 4.32% 5 increase over the rolled-back rate of 4.1830, for the fiscal year 2013- 6 2014. 7 8 WHEREAS, pursuant to section 200.065, Florida Statutes, tax assessments for all real 9 property within the jurisdiction of the City of South Miami for the fiscal year 201312014 has 10 been made by the property appraiser for Dade County; and, 11 12 WHEREAS, pursuant to the above-cited statutory provision, the Mayor and City Commission 13 are required to adopt a tentative and thereafter a final millage rate for the taxing jurisdiction of 14 the City of South Miami. 15 16 NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY 17 COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA THAT: 18 19 Section I. There shall be and hereby is levied upon real property in the City of 20 South Miami, Florida, a tax of 4.3639 mills on the dollar for the fiscal year 2013/2014 for the 21 operational expenses of the government of the City for the fiscal year beginning October I, 22 2013, and ending September 30, 2014. This results in a 0% increase from the City'S FY 2012-13 23 property tax rate. 24 25 Section 2. Severability. If any section, clause, sentence, or phrase of this ordinance 26 is for any reason held invalid or unconstitutional by a court of competent jurisdiction, this 27 holding shall not affect the validity of the remaining portions of this ordinance. 28 29 Section 3. Ordinances in Conflict. All ordinances or parts of ordinances and all 30 section and parts of sections of ordinances in direct conflict herewith are hereby repealed. 31 However, it is not the intent of this section to repeal entire ordinances, or parts of ordinances, 32 that give the appearance of being in conflict when the two ordinances can be harmonized or 33 when only a portion of the ordinance in conflict needs to be repealed to harmonize the 34 ordinances. If the ordinance in conflict can be harmonized by amending its terms, it is hereby 35 amended to harmonize the two ordinances.
