_Add-on bAdd-On Item b) Sponsored by: Commissioner Harris City Commission Meeting 9-03-13 Page 1 of 2 1 2 RESOLUTION NO. _________________ 3 4 5 A Resolution of the City of South Miami, Florida, requesting that the Miami-6 Dade County Public Works and Waste Management Department collect 7 recyclable materials from business and apartment buildings, soliciting other 8 communities to do the same, and requesting an amendment to Ch. 15, Sec. 9 2.3, Miami-Dade County Code. 10 11 WHEREAS, Miami-Dade County Public Works and Waste Management Department 12 (“Waste Management”) currently provides recycling services to residential properties once every 13 two (2) weeks; and 14 15 WHEREAS, commercial recycling became mandatory countywide in July 1992 as per 16 Chapter 15, Section 2.3 of the Miami-Dade County Code, requiring business owners to provide a 17 recycling program for their employees and tenants and imposing fines of up to $950 for 18 violations; and 19 20 WHEREAS, Miami-Dade County’s mandatory commercial recycling requirements do 21 not appear to be effective; and 22 23 WHEREAS, recycling is critical to the health of the environment as it helps reduce the 24 amount of raw materials that are needed to produce new products which in turn reduces the 25 negative impact of extracting raw materials, reduces emissions and pollution, saves on 26 production and energy costs, and reduces the volume of waste in landfills; and 27 28 WHEREAS, high-density buildings such as business and apartment buildings produce 29 more waste than single-family residential buildings and therefore, the benefits of collecting 30 recyclables from business and apartment buildings will be enormous; and 31 32 WHEREAS, the energy required to collect recyclable items from business and apartment 33 buildings would be offset by profits of resale of recycled products and the benefit to the 34 environment; and 35 36 WHEREAS, the benefit to the environment would be dramatically increased if Miami-37 Dade County collected recyclables from businesses and apartment buildings in other 38 communities throughout Miami-Dade County. 39 40 NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY 41 COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA: 42 43 Section 1. The Mayor and City Commission of the City of South Miami, Florida hereby 44 request that the Miami-Dade County Public Works and Waste Management Department collect 45 recyclable materials, free of charge, from business and apartment buildings, in addition to 46 Add-On Item b) Sponsored by: Commissioner Harris City Commission Meeting 9-03-13 Page 2 of 2 residential properties; request that Chapter 15, Section 2.3 of the Miami-Dade County Code be 1 amended to conform to this resolution; and instruct the City Clerk to send this resolution to the 2 Miami-Dade County League of Cities, the Mayor of Miami –Dade County, and to all the 3 municipalities in Miami-Dade County. 4 5 Section 2. Severability. If any section clause, sentence, or phrase of this resolution is for 6 any reason held invalid or unconstitutional by a court of competent jurisdiction, the holding shall 7 not affect the validity of the remaining portions of this resolution. 8 9 Section 3. Effective Date.
