BACKGROUND
Pursuant to Section 20-3.4(B)(4)(b) of the Land Development Code (LDC) the applicant is
requesting Special Use Approval to locate a restaurant at the above referenced location. The
location of the restaurant will be in the comer unit of an existing street level storefront of a multi
tenant building (Figure 1 -Lot 17). This space was formerly occupied by a gallery and framing
store and is adjacent to the French bistro, Chocolate Fashion (Figure 2). This proposed use is
located in the "SR" Specialty Retail, "HD-OV" Hometown District Overlay zoning district which
allows restaurants if approved through the special use process. The LDC provides that special
uses must be approved by the City Commission after a public hearing and receipt of a
recommendation from the Planning Board. Pursuant to the requirements for special use
application review, the applicant provided notification via certified mail to the surrounding
property owners of their intent to file said application; documentation is on file with the Planning
& Zoning Department.

STAFF ANALYSIS
The applicant currently operates a Mediterranean restaurant, Marhaba at 5701 Sunset Drive and is
proposing to open a small restaurant of approximately 1,300 square feet. Based on the layout
provided, the restaurant is proposed have approximately 38 seats, with an additional 9 seats at the
bar within the 572 square foot dining area. The plan also indicates outdoor seating, which if the
use is approved will be handled through a separate administrative application process. Based on
the site plan provided by the applicant, there are 8 off street parking spaces available for the uses
in the building, which was verified by staff. The land development code stipulates that the
required parking ratio for restaurant use is 1 parking space per 100 square feet. Based on this
ratio, the applicant will need 13 parking spaces. Taking into consideration the onsite parking (2
per unit), the applicant would have to need an additional 11 parking spaces.
Pursuant to Section 20-7 .6(C)(2)(b) of the Hometown District Overlay for existing buildings, if
there are fewer spaces provided than required for existing buildings, the applicant may: obtain a
special exception waiving the number of additional spaces required in accord with the process set
forth in Section 20-7. 51 of this chapter; or pay into the Hometown District Improvement Trust
Fund a fee as set forth below. The fee payment into the Hometown District Improvement Trust
Fund for each space required but not provided shall be one thousand dollars ($1,000.00) per
parking space per year payable at the time of renewal of the occupational license.

At the July 9, 2013 Planning Board meeting, the question regarding parking was asked during
the public remarks portion of the hearing on this item. John Edward Smith, the representative for
this item, responded that parking for the restaurant will be managed via both existing spaces on
the site and parking directly adjacent to the tenant space. In addition, parking will be managed
via the execution of a parking agreement that will require an annual fee payment into the City'S

Hometown District Improvement Trust Fund. This payment will be in lieu of any parking spaces
that provided on the site for the tenant space.
SPECIAL CONDITIONS APPLICABLE:
The overall purpose of going through the special use process is to determine the compatibility of
the proposed use with the surrounding neighborhood. A special use must comply with the
conditions set forth in Section 20-5.8(B) in that the use:
a) Will not adversely affect the health or safety of persons residing or working in the
vicinity of the proposed use;
b) Will not be detrimental to the public welfare or property or improvements in the
neighborhood; and,
c) Complies with all other applicable Code provisions.
The general character of the surrounding area is a mix of retail, office, commercial, restaurant
and residential uses. This proposed use is compatible with the surrounding uses within the
Overlay District. If approved, a parking agreement for the deficient parking spaces will have to
be executed prior to a business license being issued. Any exterior modifications to the structure
or signage will require a separate application to the Environmental Review and Preservation
Board. Additionally, an outdoor seating application must be approved by the City before any
outdoor furniture can be placed outside of the restaurant.

8 WHEREAS, pursuant to Section 20-3.4(B)(4)(b) of the Land Development Code (LDC),
9 the applicant, Nach Group, LLC submitted to the Planning Board Application No. PB-13-022
10 requesting a Special Use Approval to operate a general restaurant to be located at 5864 Sunset
11 Drive, within the Specialty Retail "SR", Hometown District Overlay "HD-OV" zoning district;
12 and
13
14 WHEREAS, a general restaurant is permitted as a special use within the Specialty Retail
15 "SR", Hometown District Overlay "HD-OV" zoning district and is subject to meeting general
16 conditions specified in LDC Section 20-5.8 and subject to meeting special use requirements set
17 forth in LDC Section 20-3.4(B)( 4)(b); and

19 WHEREAS, the approval of a special use requires a recommendation from the Planning
20 Board and the approval of the City Commission after a public hearing; and

22 WHEREAS, at the July 9, 2013 Planning Board meeting, and following a public hearing,
23 the Board heard application PB-13-022 and recommended approval with a vote of 3 yays and 2
24 nays for the special use request for a general restaurant; and
25
26 WHEREAS, the City Commission desires to accept the recommendation of the Planning
27 Board.

29 NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY
30 COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA THAT:

32 Section 1: Special Use Application (PB-13-022) submitted by applicant Nach Group,
33 LLC for approval to operate a general restaurant located at 5864 Sunset Drive, within the
34 Specialty Retail "SR", Hometown District Overlay "HD-OV" zoning district is hereby

(3) All signage for the new establishment is subject to review and approval by the
Environmental Review and Preservation Board (ERPB).
(4) Any and all exterior renovations or modifications are subject to review and approval
by the ERPB
(5) A separate application for outdoor dining would be required as per Section 20-
3.3(E)(2) Outdoor Seating / Dining for all commercial Properties, of the Land
Development Code.
(6) If the subject restaurant is determined by the Planning and Zoning Director in the
future, to be adversely affecting the health or safety of persons residing or working in
the vicinity of the proposed use, or to be detrimental to the public welfare or property
or improvements in the neighborhood, or not be in compliance with other applicable
Code provisions, the special use approval may be modified or revoked by the City
Commission upon notification and a public hearing.
Section 2. Severability. If any section clause, sentence, or phrase of this resolution is for
any reason held invalid or unconstitutional by a court of competent jurisdiction, the holding shall
not affect the validity of the remaining portions of this resolution.
Section 3. Effective Date. This resolution shall become effective immediately upon
adoption by vote of the City Commission.
