A Resolution of the City of South Miami relating to a request to allow for the creation of
parcels A, B, and C on the Northern portion of property specifically located at 6520 SW
56th Street, South Miami, Florida within an RS-3; Low Density Single-Family Residential
Zoning District, as permitted by provisions pertaining to "Waiver of Plat" set forth in
Section 20-4.2(B) of the City of South Miami Land Development Code, and Section 28-4 of
the Miami-Dade County Code; for the purpose of constructing three new single-family
homes; and providing for a legal description.
BACKGROUND:
On May 10,2013, an Application for Waiver of Plat was submitted for review by the owner of
the property 6520 Development LLC, in order to divide the northern portion of a single tract of
land (parent tract) described as property folio 09 4025 0000190, located at 6520 SW 56 th Street
into three individual single family lots. On June 11,2013, the Planning Board heard application
PB-13-0 18, and following a public hearing voted unanimously to recommend approval of the
proposed waiver of plat.
On July 16, 2013 the application was presented to the City Commission for review; following
considerable public comment and discussion between the applicant's representative, staff and the
City Commission, the item was deferred and referred back to the Planning Board for rehearing.
The main points of discussion were the existing tree survey, tree removal permit application and
two separate applications for waiver of plat, both on one parcel of land. Miami-Dade County
Code, Chapter 28.4 (attached) states that waivers are limited to subdividing land into no more
than six (6) lots. However, in telephone conversations between City representatives and Mr. Julio
Delgado with Miami-Dade County Zoning & Platting Section and Mr. Raul Pino, Chairman of
the Miami-Dade County Plat Committee, the City was advised that it is not uncommon for waiver
requests to be split into separate applications, provided it complies with the other waiver of plat
requirements, and the municipality did not object to this application. The tree mitigation
requirements are discussed further in this report.
On July 30, 2013 the Planning Board held a special meeting and public hearing on the revised
application for waiver of plat. The applicant presented a revision to the proposed site plan and
tree removal permit, which is included in the backup material. During the public hearing, there
was considerable discussion by the surrounding residents primarily related to the following

The character of the neighborhood and the impact of the proposed homes; lot frontages; the desire
for an independent arborist review of tree the mitigation; need for a geologic and environmental
impact survey; the provisions of Miami Dade County Code Section 28-4 related to six-lots; and
sewer hook up versus septic tanks. Following considerable deliberation by the Board and input
from the City Attorney, the Board made a motion to recommend approval of the waiver
application for three lots by a vote of 3 ayes and 2 nays.
LEGAL DESCRIPTION:
PARENT TRACT:
The east liz, of the northwest V4, of the northwest V4, of the northwest V4~ less the east 91 feet and
less the south 447 feet and less the north 50 feet of section 25, township 54 south, range 40 east,
in Miami-Dade County, Florida;
and also less:
The external area formed by a 25 foot radius arc concave to the southwest, tangent to a line that is
91 feet west of and parallel with the east line of the east liz of the northwest V4 of the northwest V4
of the northwest V4 of section 25, township 54 south, range 40east, Miami-Dade County, Florida
and tangent to the line that is 50 feet south of and parallel with the north line of the northwest V4
of said section 25.
PROPOSED PARCEL "A":
The west 123.25 feet of the east liz, of the northwest V4 of the northwest V4 of the northwest corner
V4 of section 25, township 54 south, range 40 east, in Miami-Dade County, Florida, less the south
522 feet, and also less the north 50 feet thereof.
Containing 12,433 ± square feet, 0.2854 ± acres.
PROPOSED PARCEL "B":
The east liz of the northwest V4 of the northwest V4 of the northwest V4 of section 25, township 54
south, range 40 east, in Miami-Dade County, Florida, less the east 91 feet, and also less the south
522 feet, and also less the north 50 feet, and also less the west 123.25 feet thereof.
AND also less:
The external area formed by a 25 foot radius arc concave to the southwest, tangent to a line that is
91 feet west of and parallel with the east line of the east liz of the northwest V4 of the northwest 1;4
of the northwest 1;4 of section 25, township 54 south, range 40 east, Miami-Dade County, Florida,
and tangent to the line that is 50 feet south of and parallel with the north line of the northwest 1;4
of said section 25.
Containing 12,246 ± square feet, 0.2811 ± acres.
PROPOSED PARCEL "C":
The north 75 feet of the south 522 feet of the east liz of the northwest V4 of the northwest 1;4 of the
northwest 1;4 of section 25, township 54 south, range 40 east, in Miami-Dade County, Florida, less
the east 91 feet thereof.
Containing 18,486 ± square feet, 0.4244 ± acres.

ANALYSIS:
The proposed waiver of plat would create three single residential properties (indicated as parcels
"a", "b" and "c") zoned RS-3 "Low Density Residential," located at 6520 SW 56 th Street (Figure
1). The lots will range in size from 12,246 to 18,486 square feet. The minimum lot size within the
RS-3 zoning use district is 10,000 square feet. The three parcels at this location are consistent
with the RS-3 "Low Density Residential" zoning on the east, south, and the northeast. The
properties to the west and northwest are zoned RT-6 "Townhouse Residential". The proposed
wavier of plat is creating tracts that are larger than required by the land development regulations
for RS-3, and is consistent with the requirements of Section 20-4.2(B)(2)(a) of the City's Land
Development Regulations, which states in part:
(2) City Commission Findings. Prior to approving a waiver-ol-plat, the city commission
shall use the following guidelines:
(a) The building site created by the proposed waiver-ol-plat will be equal to or larger than
the majority of the existing building sites and of the same character as the surrounding
area (this shall be demonstrated using copies of the official plat maps for the subject
property and surrounding neighborhood).
The resulting three "new" lots will be equal to or larger than the majority of the surrounding
building sites (Figure 2).

6520 DEVELOPMENT (3 proposed lots)
1. The proposed lots fronting on SW 56 Street (Miller Dr.) need Miami Dade County
approval as it mainly pertains to driveway. Although the street is within South Miami,
Miami Dade County has jurisdiction of this road.
2. Driveways are not to be constructed within 5 feet of an interior side proPeJiy line and a
within 15 feet from the property line (right of way line) at corner lots.
3. The City is in the process of planning for the construction of sidewalks along SW 56 St.,
as such the developer shall provide sidewalk along the front ofthe lots.
4. All lots are to be connected to water and sewer. For information on the location of the
lines contact Miami Dade W ASD.
5. All planning and zoning requirements will be address separately.
6. Final site plan and water and sewer plans to be submitted South Miami PW Engineering
Division for approval
The project landscape architect met on site with the City'S Arborist to conduct a walkthrough of
the property; please see the attached emails. The applicant's existing tree survey for the entire

parcel (North and South), is attached for your reference. In addition, the City's Arborist will be
conducting a mitigation survey as part of the applicant's tree removal application prior to the
removal of trees from this parcel, to ensure full compliance with city standards and Miami-Dade
County/DERM tree canopy requirements.
City representatives spoke with the Deputy Director of Miami-Dade County Water and Sewer
Department (W ASD) regarding the requirement for public utilities to be in place in compliance
with the waiver of plat requirements. A 4-inch sewer line exists on the north side of SW 56th
Street across from the applicants property. Under certain circumstances developments are
required to connect to existing sewer lines. In this instance, the lines are insufficiently sized to
accommodate the proposed added wastewater discharge; an 8-inch line would be the minimum
required. The City is in receipt of an email from County staff indicating that W ASD and the
Environmental Quality Control Board (EQCB) will review the proposal for septic tanks on these
lots, with an agreement to tie into the existing potable water lines. Please refer to the attached
email dated July 19, 2013 from W ASD representatives.
The applicant will also be submitting a traffic analysis for that street and intersection, and will file
for school concurrency determination with Miami Dade County Public Schools prior to permit
issuance.

Currently Parcel "A" is the only access to the subject property directly accessible from SW 56
Street (Miller Drive). The existing asphalt driveway, which is also located in part on parcel "C"
will be removed. The property shall front and remain accessible through SW 56 th Street.

Currently Parcel "B" at the comer portion of site has three existing detached wood sheds to be
demolished, on the subject property. The subject property shall front through SW 56 th Street and
shall have vehicular accessibility through SW 65 th Avenue; taking full advantage of the comer
site.

RECOMMENDATION
The Planning Board recommended approval of the application PB-13-018 by a vote of3 ayes and
2 nays. Pursuant to Section 20-4.2(B)(3) of the City's Land Development Code, the City
Commission may designate such additional conditions in connection with the waiver of plat as
will, in its opinion, that such waiver will conform to the requirements of Section 20-4.2.
(attached).
Any approval of this request is also subject to County review and approval, and compliance with
the City of South Miami Land Development Code, the Comprehensive Plan, Section 20-4.1
adequate public facilities of the Land Development Regulations, and Miami Dade County
Schools concurrency requirements.

neighborhood are two-thousand to three thousand square feet and these homes are proposed to be
three times the square footage, this does not fit the character of the neighborhood. She stated that
there a 2007 Ordinance 27071928, where the City Commission expressed concern of the new
construction of two story homes and the addition of a second story to existing one story homes
which may not be compatible with scale and massing of their existing residential neighborhood.
She also stated that she feels that with the removal of the trees will impact the wildlife as well as
the residents in the neighborhood.

neighborhood).

The applicant stated that the statements from the residents do not come from a professional in the
respected fields of arborist, biologist, archaeologist or geologist and their testimony is not
substantial evidence in which you are to review in your adjudication rights regarding this item.
She stated that they chose to go thru the waiver of plat process opposed to a tentative plat
process to give the project a level of transparency. She also stated that the waiver of plat process
specifically deals with the property rights of this parcel; this process has no bearing on the design
of the homes or the removal of the trees which will be handled separately. She then discussed the
issue of frontage in greater detail. She then discussed the comments of the public of the homes
being McMansions; this process will be handled at the Environmental Review and Presentation
Board.
Mr. Carlos Tosca stated that he has worked with the City of South Miami on several projects
over the years and the zoning for this property is ten thousand square foot lots and they would
have been able to build ten to twelve lots had they been able to connect to sewer and chose to
build seven lots and use septic tank to save the majority of the trees on the parcel. He then stated

that he feels that they are in compliance, that they are user friendly and has gone above and
beyond to satisfy the concerns of the city and the residents.
Ms. Fischer stated that it has been stated that the Planning Board is a quasi judicial hearing. Mr.
Pepe that he has done some research and the Planning Board hearings are not quasi judicial but
the City Commission hearings are. Ms. Fischer stated her concern of this is being the second
review of this item is there a certain process to void the votes from the previous hearing. Mr.
Pepe stated that the today's vote will supersede the previous. Dr. Philips asked Mr. Brimo the
dimensional requirements regarding these lots. Mr. Brimo replied that the maximum impervious
coverage (40%) and maximum building coverage (30%). Mrs. Beckman stated her concern of
the septic tank and how long is the distance for the implementation. Mr. Brimo then stated that
the Environmental Quality and Control Board with Miami-Dade County review septic tanks. Mr.
Greiner stated that the zoning requiring the large lots may be affecting the vegetation. He then
stated that we passed this at the previous hearing with the condition of an additional setback
from the street to protect the trees on the property. He also stated that due to the narrow
conditions that the Board is faced with this is extremely perplex for those reasons. Mr. Carreras
stated whether a waiver of plat could come before the Board without a site plan without the
structure or building and just provide the land proposed. Mr. Brimo stated that the according to
the Land Development Code the applicant must provide a conceptual site plan.
Motion: Dr. Philips motioned for the approval of the item as presented. Mr. Carreras seconded
the motion.

He stated that the 75 feet of frontage per lot, does it have relevance to this Section 20-4.2
(B)(2)(a) of the Land Development Code. Mr. Greiner stated yes it does have relevance which is
what the Board must determine.
Dr. Philips stated that her question of recommending that this parcel be approved for three
homes instead of four. Mr. Pepe stated that yes you can provide for conditions so that it
conforms to the requirements of Section 20-4.2 (B)(2)( a) (b)( c) . He then stated that if a change
in the size of the lot is required so that it is the same character of the surrounding area not just
what is across the street but the entire area around it. Dr. Philips then asked for the dimensions of
the surrounding area. He stated that the notice for public hearing requirement is within five
hundred (500) feet in diameter of the sites and you can interpret that as the surrounding area.
Mr. Greiner stated that you should also consider the decision-making processes if the land is
divided into three lots instead of four, you could conceivably have three homes built that are
even larger and allowed by the underlying zoning than what is being proposed. Mr. Greiner
asked Mr. Brimo if he and the owner/developer discussed other options such as making the
property a' PUD, revising the zoning, rezoning or anything that would protect the vegetation,
topography. Mr. Brimo responded that they discussed the number of lots possibly reducing them
and rezoning was not looked at which could have been viewed as spot zoning going from RS3 to
RS2 for this parcel.
Mr. Tosca stated that they want to continue doing business with the City of South Miami and do
not to do anything to jeopardize their relationship with the city, the board or the residents. He
also stated that he is doing less than what is allowed which is fifteen lots but due to the septic
tanks I am only doing seven lots. He stated that if he doesn't develop the property someone else
will and he feels that he has been very transparent with this proposal and open to the concerns of
the residents and city administration.
Motion: Dr. Philips motioned for approval of the item with conditions of the setback as shown
on S 1 of the site plan. Mr. Carreras seconded the motion.

YOU DON'T KNOW WHAT YOU ARE ABOUT TO LOSE!
Our South Miami neighborhood has a choice. Do you want an unspoiled park that the neighborhood can
enjoy or a row of ugly McMansions at 6520 Miller Drive in South Miami, some facing Miller Drive and
some facing S. W. 65th Avenue? This area has the only undisturbed example of limestone karst
topography left in South Miami. It sits on a limestone ridge with a hardwood hammock of old oak trees
that clean and nourish the air we breathe. There are small limestone caves and many native plants that
provide sustenance, support and safety for a variety of butterflies, birds (did you know South Miami is a
bird sanctuary?), small animals like raccoons and opossums, and a beautiful red fox that was standing in
my driveway just 2 months ago. The owner of the property would prefer the area be scraped bare with
bulldozers and the trees be torn down. He wants to squeeze 7 two story single family homes onto a 2 5/8
acre piece of property. Limestone ridges like this were often used by Indi~ns for ceremonial events and
the small sink in the center of the \Nooded region (which cannot be viewed from the street) might have
provided a camping site for these ancient peoples. The area really needs an archeological survey as well
as an objective environmental impact study by an unbiased group. These studies have not to our
knowledge, been performed by the current owner.
The next regular City Commission meeting scheduled for Tuesday, July 2nd , 2013, at 7:00 PM, in the City
Commission chambers, will take place at 6130 Sunset Drive, South Miami, Florida, 33143 to consider the
resolution about this property. The notice states that all interested parties are invited to attend and will be
heard. The meeting is being held to hear 2 proposals to change platting rules, but the issues are much,
much larger than just a platting change. This cuts to the whole issue of how our irreplaceable
greenspaces are being wiped out around us without our knowledge.
This small piece of local relatively undisturbed geography deserves the highest and best use of the land
for the citizens of South Miami. Keeping it a greenspace will add to the property values of all the homes
in the vicinity. Let's save this tiny bit of paradise for all of us, our children, and our grandchildren to enjoy.

anymore.

Hello Dr. Yoder
The property 6520 SW 56 ST, has agreement 21504 with WASD. Originally the project came proposing 12 single family
residences (SFR) connecting to sewer. At that time we studied the system, unfortunately there is no gravity close to
connect; being single family homes in order to connect to sewer they will have to do a public pump station, non private
pump station is allowed by rules and regulations. Obviously this is a big impact on cost and site requirements for this
project. Even worst, the existing force main in front ofthe property indeed is 4/1, it is not the minimum 8" required, in
addition the existing 4/1 F.M. discharges to a gravity sewer (piggy back condition) which is a non desirable condition for
WASD, and there is no. proper F.M. close to the property. So we recommend the owner to verify if the project can be on
septic. They came later reducing the project to 7 SFR with a proposal for septic tanks and we provided the agreement for
water only.
The 4/1 F.M. as mentioned before is an undersized main and also discharges to a gravity sewer, we will not consider it a
proper main abutting the property and there is no force main close to the property for connection so I think they are ok
for EQCB.

I had a call from the City Manager of South Miami regarding a proposed development at 6520 SW 56 Street (Miller
Road) that involves replatting a single family site to accommodate a development of 7 homes. The question has to do
with sewer access. They mentioned a 4/1 line on the north side of Miller that might require enlargement for an extensive
distance and wanted to know if septic tanks would be an option. Can you check to see if we have reviewed this with the

developer and what our conclusions are at this point? I told him that the EQCB would ultimately make a decision of they
are seeking a variance or extension of time to comply, but the connection requirement involves both availability of an
abutting line and feasible distance to an available line.

Good morning the canopy mitigation is very accurate I base this on mUltiple issues on sight an estimated 40 percent of
this material is invasive as well there are mUltiple issues on the other tree's, storm damage cambium rot and mass
amounts of Wisteria Vine. One issue in particular concerns me after the preliminary walk through I noticed that a man
made berm above ground has many native strangler figs when the base was checked the ground was extremely soft I
attribute this to foliage droppings over many years. This could be problematic for two reasons one erosion around the
berm could lead to tree failure I note this for the fact that there are some tree's laying on the ground and two in
conversation with Mr. Grosswirth ,he indicated to me that homes would be on septic tank due to a WASA issue,
Strangler Fig would be problematic at best. The requirement is eighty tree's for replacement although I have not seen a
landscape plan to base my mitigation the DERM or R.E.R loss is fairly accurate. Unfortunately over many years improper
pruning techniques were used probably in storm recovery attempts and many of the tree's are disfigured as well many
are Volunteers. Chris we can look at this property again, I am not an expert on grade issues but it seems the property is
well below grade, and if the replacements for a two story home are at specification per the Land Development code I do
not see eighty tree's on site. Please let me know how you would like to proceed we can always get a second or more
opinion.

20-4.2 Land subdivision regulations.
(A) Applicable Regulations. The subdivision of all land within the city shall be subject to Chapter
28 of the Miami-Dade County Code of Ordinances and administered by the Miami-Dade
County Department of Public Works.
(8) Platted Lot Compliance. Every building or structure hereafter erected, moved or structurally
altered within the city shall be located on a platted lot, except that the city commission may
waive platted lot compliance in accordance with section 28-4 of the County Code and the
procedures set forth below.
(1) Waiver-of-Plat A waiver-of-plat may be approved by the city commission. Prior to city
commission approval, the application shall be reviewed by the planning board. The
subject property shall be posted ten (10) days prior to the planning board review of the
application, and mailed notice shall be provided to all property owners within a five
hundred-foot radius of the subject property.
(2) City Commission Findings. Prior to approving a waiver-of-plat, the city commission
shall use the following guidelines:
(a) The building site created by the proposed waiver-of-plat will be equal to or
larger than the majority of the existing building sites and of the same character
as the surrounding area (this shall be demonstrated using copies of the official
plat maps for the subject property and surrounding neighborhood).
(b) The building site created by the proposed waiver-of-plat will not result in
existing structures becoming nonconforming as they relate to setbacks and
other applicable regulations of these land development regulations.
(c) The building site created by the proposed waiver-of-plat will be free of
encroachments from abutting buildable sites.
(3) Additional Conditions. The city commission may designate such additional conditions
in connection with a waiver-of-plat as will, in its opinion, assure that such waiver-of-
plat will conform to the foregoing requirements.
(4) Additional Application Requirements. As part of the required waiver-of-plat application,
applicants shall be required to submit a proposed site plan for the resulting building
parcels, an existing tree survey (may be included in property survey) which shall
indicate any proposed tree removal or relocation necessary, and, if so, the appropriate
city application for tree removal or relocation.
(C) Improvements Required.
(1) Sidewalks, curbs, gutters, drainage and paving shall be installed by the developer in
accordance with Chapter 28 of the County Code and other applicable city
requirements, unless such can be and are waived or deferred by the city commission.
(2) No building shall be erected, improved, modified, altered or enlarged in any zoning
use district, other than in an RS residential district, unless proper public improvements
have been installed.
(D) Creation of Authorized Building Sites.
(1) No building permit for the construction of any structure within the city shall be issued
until an authorized building site has been created which meets at least one (1) of the
following criteria:
(a) Is part of a recorded subdivision plat;

Is part of an officially approved planned unit development which:
i. Provides for all utility and drainage easements, alleys, streets and other
public improvements necessary to meet the normal requirements for
platting, and
ii. Includes the designation of building areas and easements, alleys and
streets required and properly dedicated, and necessary public
improvements; or
(c) Fronts upon a dedicated public street and was separately owned prior to the
effective date of this Code or annexation to the city;
(2) Wherever there exists a single-family dwelling unit which was constructed on a
building site containing two (2) or more platted lots, the nonconforming lot of record
provisions in this Code shall apply.
(3) Established building sites shall not be reduced in any manner to a size which is less
than that required for the zoning district in which located.

Whenever land is subdivided a plat must be recorded, except that the recording of a plat will not be
required if:
(1) The subdivision involved consists only of the dedication of a road, highway, street, alley or
easement and due to unusual conditions and circumstances the plat division of the appropriate
authority finds that it is not necessary that a plat be recorded. In lieu of the recording ofa plat, the
dedication may be required by deed, and may be subject to compliance with such conditions as
may be deemed appropriate under the particular circumstances, such as improvements of
sidewalks, streets, or drainage facilities and the acceptance of the dedication by the governing
body. Posting of bond may be required.
(2) The land to be subdivided is to be divided into no more than six (6) parcels and because of (a)
unusual conditions created by ownership or development of adjacent lands, or (b) the isolation or
remoteness of the land concerned in relation to other platted or improved lands, or (c)
improvements and dedications existing on the land substantially in accordance with the
requirements of this chapter, it is determined by the plat division of the appropriate authority that
waiving of the requirement for platting would not conflict with the purpose and intent of this
chapter. In lieu of platting the plat division of the appropriate authority may require any
dedications, reservations, or improvements required in connection with platting under this
chapter, including the posting of a performance and maintenance bond, as may be necessary to
carry out the intent and purpose of this chapter.
(3) The resubdivision of land heretofore platted is of such unusual size or shape, or is surrounded by
such development or unusual conditions as may be determined by the plat division of the
appropriate authority to justify the waiving of the requirement for recording a plat. In lieu of the
recording of a plat, such conditions may be imposed as may be deemed necessary and appropriate
to preserve the public interest.
(4) A parcel ofland conveyed by a recorded warranty deed that is dated prior to January 1, 1958, the
effective date of this code; provided, however, that the parcel may be diminished in size as a
result of a public dedication of any portion of that parcel.
