A Resolution of the City of South Miami relating to a request to allow for the creation of
parcels A, B, C, and D on the Southern portion of property specifically located at 6520 SW
56th Street, South Miami, Florida within an RS-3; Low Density Single-Family Residential
Zoning District, as permitted by provisions pertaining to "Waiver of Plat" set forth in
Section 20-4.2(B) of the City of South Miami Land Development Code, and Section 28-4 of
the Miami-Dade County Code; for the purpose of constructing three new single-family
homes; and providing for a legal description.
BACKGROUND:
On May 10, 2013, an Application for Waiver of Plat was submitted for review by the owner of
the property 6520 Development LLC, in order to divide the southern portion of a single tract of
land (parent tract) described as property folio 09 4025 000 0190, located at 6520 SW 56 th Street
into four individual single family lots. On June 11, 2013, the Planning Board heard application
PB-13-019, and following a public hearing voted unanimously to recommend approval of the
proposed waiver of plat with the condition that the applicant increase the front building setback
from SW 65th Avenue to increase the amount of green area and tree canopy along that street
frontage. This was recommendation from staff given the depth of the four proposed lots.

PROPOSED PARCEL "D":
The north 75 feet of the south 222 feet of the east 12 of the northwest V4 of the northwest V4 of the
northwest V4 of section 25, township 54 south, range 40 east, in Miami-Dade County, Florida, less
the east 91 feet thereof.
Containing 18,485 ± square feet, 0.4244 ± acres.
ANALYSIS:
The proposed waiver of plat would create four single residential properties (parcels "a", "b" "c"
and "d"), zoned RS-3 "Low Density Residential," located at 6520 SW 56th Street (Figure 1). The
four proposed new lots are approximately 18,485 square feet each. The minimum lot size within
the RS-3 zoning use district is 10,000 square feet. The four parcels at this location are consistent
with the RS-3 "Low Density Residential" zoning on the east, south, and the northeast. The
properties on the west and northwest are zoned RT-6 "Townhouse Residential". The proposed
wavier of plat is creating tracts that are larger than required by the land development regulations
for RS-3, and is consistent with the requirements of Section 20-4.2(B)(2)(a) of the City's Land
Development Regulations, which states:
(2) City Commission Findings. Prior to approving a waiver-ofplat, the city commission
shall use the following guidelines:
(a) The building site created by the proposed waiver-of-plat will be equal to or larger than
the majority of the existing building sites and of the same character as the
surrounding area (this shall be demonstrated using copies of the official plat maps for
the subject property and surrounding neighborhood).
The proposed wavier of plat is creating parcels that are larger in area than the required 10,000
square foot minimum, and which are larger than the majority of the surrounding lots (Figure 2).

While the proposed lots are larger in area than most of the surrounding properties, the proposed
minimum RS-3 frontage of 75 feet are potentially not of the same character as the surrounding
area, specifically the existing lots to the east that face the subject property. The surrounding
properties have lot frontages ranging between 83 feet and 97 feet ± (Figure 2).
To help mitigate the visual difference between of the lot frontages, the applicant should consider
setting the proposed structures back farther from the property line, creating more greenspace on
the front. The applicant can also consider a reduction in the number of lots requested from 4 to 3.
In return several positive features would be accomplished; greater separation between the future
residences proposed to be built on the subject site; additional green area and fewer curb cuts onto
SW 65 th Avenue. It is also important to note that the waiver of plat application [PB-13-0 18] to the
north is proposing parcel "C" with 75 feet of frontage on SW 65 th Avenue, and if approved, five
75 foot wide parcels will front SW 65th Avenue.
During the Planning Board public hearing the applicant addressed this concern with the Board.
Generally, the applicant felt that if they reduced the request to three lots, the structure that could
be built on an approximately 24,000 square foot lot would be more out of character for the
surrounding area, than one designed for an approximately 18,000 square foot lot as proposed.
City Public Works Review
6520 DEVELOPMENT (3 proposed lots)
1. Driveways are not to be constructed within 5 feet of an interior side property line and a
within 15 feet from the property line (right of way line) at comer lots.
2. The City is in the process of planning for the construction of sidewalks along SW 56 St.,
as such the developer shall provide sidewalk along the front of the lots.
3. All lots are to be connected to water and sewer. For information on the location of the
lines contact Miami Dade W ASD.
4. All planning and zoning requirements will be address separately.

The project landscape architect met on site with the City's Arborist to conduct a tree survey.
Appropriate mitigation will be required pursuant to City and County Requirements. The existing
tree survey for the entire tract of land (North and South), is attached for your reference. The
applicant will also be submitting a traffic analysis for that street and intersection prior to permit
issuance.

RECOMMENDATION
The proposed project will not adversely affect the health or safety of persons residing in the
vicinity of the waiver of plat, and will not be detrimental to the public welfare or property or
improvements in the neighborhood. Staff recommends approval of the request, with the condition
applicant increase the front building setback from SW 65th Avenue to increase the amount of
green area and tree canopy along that street frontage.
Any approval of this request is also subject to County review and approval, and compliance with
the City of South Miami Land Development Code, the Comprehensive Plan and Section 20-4.1
adequate public facilities of the Land Development Regulations.

38 WHEREAS, the Mayor and City Commission of the City of South Miami desire to
39 accept the recommendation of the Planning Board.

Mr. Brimo presented the item to the Board.
The Chairman opened the public hearing.
Mr. Mackie stated that it would be hard to find a five thousand plus square foot house please
consider that.
Mr. Alfano stated that three blocks away there is a similar lot, the Girl Scouts of America with
the same type of land and trees are located there, which seems to be a sanctuary for birds and
wildlife.
The Chairman closed the public hearing.
Mr. Carreras stated that staff made a reduction in the recommendation in the number of lots. Mr.
Brimo responded that difference being is that the alignment across the street on the northern
portion of the property is fronting a single large property. He then stated that the analysis was
taken, we found that the on the east side of 65 th the frontage is about ninety-six feet (96) and
these lots are considerably deeper about two hundred and forty-six (246) feet deeper. He also
stated that we chose to look at possible options that are not based just on the size but also the
character issues as well.
Ms. Fischer stated that it seems that every time we do lot splitting we see very large mansions or
McMansions going up with very little green space around them. She also stated that she would
like to see more green space around each home or if you are going to split up the a'lot to such an
extent let the new construction be more to the size that is already there instead of building
something that has a lot more square footage. Dr. Whitman stated that the lots are very long and
narrow which concerns him with this being three lots rather than three lots.
The Board held a discussion on the proposed item.
Ms. Fischer stated that on the last page L-1 01 Dewitt Project, it looks as though the proposed
item will be built out very close to the lot line.
The Chairman opened the public hearing.
The applicant responded that the setbacks required are ten (10) feet according to the Land
Development Code and we are planning to meet the requirement on each side with some lots that
will exceed the ten (10) feet. Dr. Whitman stated that the two-story homes will require a fifteen
(15) foot setback. The applicant responded correct we will meet the requirements. He also stated
that they reviewed many different layouts and found this to be the best one with the least asphalt,
the nicest looking; we are leaving most of the trees up within the lots which should conceal the
houses.

were confronted
with two different scams
recently. I just want to tell
you about them.
My father was outside in
front of his house in Miami
Beach. A young woman
approached him and said
she was collecting for an
organization, something to
do with the United Na-
tions. My father is so giving
-let's just
say that all
the home-
less people
in Miami
know him
by his fIrst
name-so
he went
inside and told his wife to
give the woman a check for
her organization.
As his wife was talking
to her, she asked what orga-
nization she should make
the check out to. Guess
what? They do not take
checks. The woman ex-
plained that they wanted
their bank information and
would withdraw the money
directly from their account
for deposit into their orga-
nization's account. They
told her to leave.
My mother-in-law was
looking for a parking spot
at the Navarro in Sunny
Isles Beach. She noticed a
motorcycle about to leave a
handicapped space and she
drove near the spot to wait.
As the biker pulled out,
he told my mother-in-law
to roll down her window.
She did, and he accused her
of hitting his motorcycle.
She was waiting for the
spot, so she was never near
his cycle.
He asked for her papers,
and she wouldn't give them
to him. He said he was
going to call the police, and
she said "good idea."
So she waited and wait-
ed; he approached her
again and said the police
were taking too long, that
she better stay there and he
would come back with the

Individuals are receiving

additional services they did
not knowingly purchase.
Many have also experi-
enced difficulty contacting

departments to cancel the
