BACKGROUND: On May 10, 2013, an Application for Waiver of Plat was submitted for review by the owner of the property 6520 Development LLC, in order to divide the northern portion of a single tract of land (parent tract) described as property folio 09 4025 000 0190, located at 6520 SW 56 th Street into three individual single family lots. On June 11, 2013, the Planning Board heard application PB-13-0 18, and following a public hearing voted unanimously to recommend approval of the proposed waiver of plat. LEGAL DESCRIPTION: PARENT TRACT: The east Yz, of the northwest 14, of the northwest 1;4, of the northwest 1;4, less the east 91 feet and less the south 447 feet and less the north 50 feet of section 25, township 54 south, range 40 east, in Miami-Dade County, Florida; and also less: The external area formed by a 25 foot radius arc concave to the southwest, tangent to a line that is 91 feet west of and parallel with the east line of the east Yz of the northwest 14 of the nOlihwest 1;4 of the northwest 14 of section 25, township 54 south, range 40east, Miami-Dade County, Florida and tangent to the line that is 50 feet south of and parallel with the north line of the northwest 1;4 of said section 25. PROPOSED PARCEL "A": The west 123.25 feet of the east Yz, of the northwest 14 of the northwest 14 of the nOlihwest corner 14 of section 25, township 54 south, range 40 east, in Miami-Dade County, Florida, less the south 522 feet, and also less the north 50 feet thereof. PROPOSED PARCEL "B": The east Y:! of the northwest V4 of the northwest V4 of the northwest V4 of section 25, township 54 south, range 40 east, in Miami-Dade County, Florida, less the east 91 feet, and also less the south 522 feet, and also less the north 50 feet, and also less the west 123.25 feet thereof. AND also less: The external area formed by a 25 foot radius arc concave to the southwest, tangent to a line that is 91 feet west of and parallel with the east line of the east ~ of the northwest V4 of the northwest V4 of the northwest V4 of section 25, township 54 south, range 40 east, Miami-Dade County, Florida, and tangent to the line that is 50 feet south of and parallel with the north line of the northwest V4 of said section 25. Containing 12,246 ± square feet, 0.2811 ± acres. PROPOSED PARCEL "C": The north 75 feet of the south 522 feet of the east Y:! of the northwest V4 of the northwest V4 of the northwest V4 of section 25, township 54 south, range 40 east, in Miami-Dade County, Florida, less the east 91 feet thereof. Containing 18,486 ± square feet, 0.4244 ± acres. ANALYSIS: The proposed waiver of plat would create three single residential properties (indicated as parcels "a", "b" and "c") zoned RS-3 "Low Density Residential," located at 6520 SW 56th Street (Figure 1). The lots will range in size from 12,246 to 18,486 square feet. The minimum lot size within the RS-3 zoning use district is 10,000 square feet. The three parcels at this location are consistent with the RS-3 "Low Density Residential" zoning on the east, south, and the northeast. The properties to the west and northwest are zoned RT-6 "Townhouse Residential". The proposed wavier of plat is creating tracts that are larger than required by the land development regulations for RS-3, and is consistent with the requirements of Section 20-4.2(B)(2)(a) of the City's Land Development Regulations, which states: (2) City Commission Findings. Prior to approving a waiver-ol-plat, the city commission shall use the following guidelines: (a) The building site created by the proposed waiver-ol-plat will be equal to or larger than the majority of the existing building sites and of the same character as the surrounding area (this shall be demonstrated using copies of the official plat maps for the subject property and surrounding neighborhood). The resulting "new" lots will be equal to or larger than the majority of the surrounding building sites (Figure 2). The proposed lots fronting on SW 56 Street (Miller Dr.) need Miami Dade County approval as it mainly pertains to driveway. Although the street is within South Miami, Miami Dade County has jurisdiction of this road. 2. Driveways are not to be constructed within 5 feet of an interior side property line and a within 15 feet from the property line (right of way line) at comer lots. 3. The City is in the process of planning for the construction of sidewalks along SW 56 St., as such the developer shall provide sidewalk along the front of the lots. 4. All lots are to be connected to water and sewer. For information on the location of the lines contact Miami Dade W ASD. 5. All planning and zoning requirements will be address separately. 6. Final site plan and water and sewer plansto be submitted South Miami PW Engineering Division for approval The project landscape architect met on site with the City's Arborist to conduct a tree survey. Appropriate mitigation will be required pursuant to City and County Requirements. The existing tree survey for the entire tract of land (North and South), is attached for your reference. The applicant will also be submitting a traffic analysis for that street and intersection prior to permit issuance. Pursuant to Section 20-3.5E of the Land Development Code, Dimensional Requirements Single- Family District are as follows: ZONING SUMMARY for Parent Tract (a) Zoning Designation: RS-3 "Low Density Residential" (b) Use: Single-Family (c) Lot size: 43,165 s.f. (0.9909 acres), Minimum lot size 10,000 s.f. required. (d) Building Frontage: 222.71 feet, Minimum frontage 75 feet required. ZONING SUMMARY for Parcel A: (a) Zoning Designation: RS-3 "Low Density Residential" (b) Use: Single-Family (c) Minimum Lot Size: 12,433 s.f. proposed,'Minimum lot size 10,000 s.f. required. (d) Building frontage: 123.25 feet proposed, Minimum frontage 75 feet required. The existing asphalt driveway, which is also located in part on parcel "C" will be removed. The property shall front and remain accessible through SW 56 th Street. ZONING SUMMARY for Parcel B: (a) Zoning Designation: RS-3 "Low Density Residential" (b) Use: Single-Family (c) Minimum lot size: 12,246 s.f. proposed, Minimum lot size 10,000 s.f. required. (d) Building frontage: 98.46 feet proposed, Minimum frontage 75 feet required. Currently Parcel "B" at the comer portion of site has three existing detached wood sheds to be demolished, on the subject property. The subject property shall front through SW 56th Street and shall have vehicular accessibility through SW 65 th Avenue; taking full advantage of the comer site. ZONING SUMMARY for Parcel C: (a) Zoning Designation: RS-3 "Low Density Residential" (b) Use: Single-Family (c) Minimum lot size: 18,486 s.f. proposed, Minimum lot size 10,000 s.f. required. (d) Building frontage: 75.00 feet proposed, Minimum frontage 75 feet required. Currently Parcel "C" has two existing one-story buildings and the remaining portion of the existing asphalt driveway, to be demolished, on the subject property. The property shall front and be accessible through SW 65 th A venue. Staff recommends approval of the request. Any approval of this request is also subject to County review and approval, and compliance with the City of South Miami Land Development Code, the Comprehensive Plan and Section 20-4.1 adequate public facilities of the Land Development Regulations. Mr. Marcello Alfano, who resides at 6521 SW 58 St., stated that he moved to South Miami because of the greenery with Oak Trees that give a lot of foliage in our back yard and he would not like to see that compromised with trees being cut down and two-story homes being erected. A young woman approached him and said she was collecting for an organization, something to do with the United Na- tions. My father is so giving -let's just say that all the home- less people in Miami know him by his frrst CALDWELL name -s 0 he went inside and told his wife to give the woman a check for her organization. As his wife was talking to her, she asked what orga- nization she should make the check out to. Guess what? They do not take dli\ ~ checks. The woman ex- plained that they wanted their bank information and would withdraw the money directly from their account for deposit into their orga- nization's account They told her to leave. My mother-in-law was looking for a parking spot at the Navarro in Sunny Isles Beach. Third-party com- panies claiming to repre- sent the u.S. Postal Service offer to help consumers register a new residential address, resulting in un- expected monthly charges of $17 to $24. Scambook has received more than 300 complaints about "change of address" sites from consumers across the country, central- ized in Florida, California, Arizona, Oregon, Washing- ton state and Texas. ' Individuals are receiving an initial processing charge of $1, followed by unwar- ranted monthly charges for additional services they did not knowingly purchase. Many have also experi- enced difficulty contacting the sites' customer service departments to cancel the unwanted sUbscriptions.
