A Resolution related to a request pursuant to Section 20-3.4(B)(4)(b) of the City of South
Miami Land Development Code for Special Use Approval to locate a general restaurant at
5818 South Dixie Highway within the Specialty Retail "SR", Hometown District Overlay
"HD-OV".
BACKGROUND
Pursuant to Section 20-3.4(B)(4)(b) of the Land Development Code (LDC) the applicant is
requesting Special Use Approval to locate a general restaurant at the above referenced location.
The location of the restaurant will be in an existing street level storefront of a one-story, multi
tenant retail/commercial building fronting on South Dixie Highway, and occupy the a storefront
in that building (Figure 1). This proposed use is located in the "SR" Specialty Retail, "HD-OV"
Hometown District Overlay zoning district which allows restaurants if approved through the
special use process. The LDC provides that special uses must be approved by the City
Commission after a public hearing and receipt of a recommendation from the Planning Board.
Pursuant to the requirements for special use application review, the applicant provided
notification via certified mail to the surrounding property owners of their intent to file said
application; documentation is on file with the Planning & Zoning Department.

STAFF ANALYSIS
The applicant is proposing to open a 38 seat Mediterranean restaurant in the space occupied by.Z
Mattress, situated between Tire Kingdom and Akashi Japanese Restaurant (Figure 2). The floor
plan provided by the applicant indicates the space is approximately 4,000 square feet. The
property is bounded by South Dixie Highway, SW 58th Avenue and SW 71st Street. The
restaurant fronts South Dixie Highway with a secondary entrance on S W 71 st Street. Hours of
operation for the restaurant will be between 11 :OOAM and 12:00 midnight, with all deliveries
and solid waste removal handled offSW 71st Street.
The general character of the surrounding area is mix of office, commercial, retail and
restaurant uses. Based on the proposed square footage this restaurant will require
approximately 40 parking spaces (1 space per 100 sq. ft.). While there are a few on-street
parking along SW 71st Street and a City surface parking lot to the rear of the this property, the
site has very limited on-site parking available. Based on the survey provided by the applicant
there are only 6 parking spaces available plus an additional 2 handicap spaces behind the Tire
Kingdom. Per the current requirements of the Land Development Code, the site is deficient by
32 parking spaces. Several of the older structures in this general area fronting South Dixie
Highway face the same parking constraints. The Miami-Dade County Property Appraiser
records indicate this structure was built in 1948.
Pursuant to Section 20-7 .6(C)(2)(b) of the Hometown District Overlay for existing buildings, ij
there are fewer spaces provided than required for existing buildings, the applicant may: obtain
a special exception waiving the number of additional spaces required in accord with the
process set forth in Section 20-7.51 of this chapter; or pay into the Hometown District
Improvement Trust Fund afee as set forth below. The fee payment into the Hometown District
Improvement Trust Fund for each space required but not provided shall be one thousand
dollars ($1,000.00) per parking space per year payable at the time of renewal of the
occupational license. Given the potential annual cost of meeting the parking requirement, the
applicant has also filed a companion application for a "special exception" to obtain a waiver on
the total number of parking spaces required.

At their June 11,2013 Planning Board meeting, and following a public hearing, the board voted
unanimously to approve the request for a special use to operate a general restaurant "Rice House
of Kabob", located at 5818 S. Dixie Highway. The board's recommendation for approval was
tied to their previous recommendation of approval for the special exception waiving strict
compliance with the district's parking requirements.
SPECIAL CONDITIONS APPLICABLE:
The overall purpose of going through the special use process is to determine the compatibility of
the proposed use with the surrounding neighborhood. A special use must comply with the
conditions set forth in Section 20-5.8(B) in that the use:
a) Will not adversely affect the health or safety of persons residing or working in the
vicinity of the proposed use;
b) Will not be detrimental to the public welfare or property or improvements in the
neighborhood; and,
c) Complies with all other applicable Code provisions.
RECOMMENDATION
A recommendation of approval of this special use is dependent on the favorable outcome of the
companion application [PB-13-016] for a special exception for a parking waiver. Should the
request for a waiver to the parking be approved by the Commission, staff recommends approval
of the special use to locate a restaurant at 5818 South Dixie Highway.

15 WHEREAS, a general restaurant is permitted as a special use in within the Specialty
16 Retail "SR", Hometown District Overlay "HD-OV" zoning district and is subject to meeting
17 general conditions specified in LDC Section 20-5.8 and subject to meeting special use
18 requirements set forth in LDC Section 20-3.4(B)(4)(b); and

20 WHEREAS, the approval of a special use requires a recommendation from the Planning
21 Board and the approval of the City Commission after a public hearing; and

23 WHEREAS, at the June 11, 2013 Planning Board meeting, and following a public
24 hearing, the Board heard application PB-13-0 15 and voted unanimously to recommended
25 approval of the special use request for a general restaurant; and

27 WHEREAS, the City Commission desires to accept the recommendation of the Planning
28 Board.

(3) All signage for the new establishment is su~ject to review and approval by
the Environmental Review and Preservation Board (ERPB).
(4) Any and all exterior renovations or modifications are subject to review
and approval by the ERPB
(5) A separate application for outdoor dining would be required as per Section
20-3.3(E)(2) Outdoor Seating / Dining for all commercial Properties, of the Land
Development Code.
(6) If the subject restaurant is determined by the Planning and Zoning Director in
the future, to be adversely affecting the health or safety of persons residing or working in
the vicinity of the proposed use, or to be detrimental to the public welfare or property or
improvements in the neighborhood, or not be in compliance with other applicable Code
provisions, the special use approval may be modified or revoked by the City Commission
upon notification and a public hearing.
Section 2. Severability. If any section clause, sentence, or phrase of this resolution is for
any reason held invalid or unconstitutional by a court of competent jurisdiction, the holding shall
not affect the validity of the remaining portions of this resolution.
Section 3. Effective Date. This resolution shall become effective immediately upon
adoption by vote of the City Commission.

This letter of intent accompanies the application by Rice South Miami, LLC, Inc. for a
special use approval for a new restaurant, Rice House of Kabob ("Rice") at 5818 South Dixie
Highway. This request is filed with the authorization of the property owner, Collegiate
Marketing, Inc.
Rice is a local and very successful, healthy, Mediterranean restaurant chain. Rice has
existing location in Miami Beach, Brickell, North Miami, Doral and Kendall. The new restaurant is
planned for the space previously occupied by the "Z Mattress Store" located on the east side of
South Dixie Highway, between Tire Kingdom and Akashi Japanese Restaurant. The location for
the restaurant is zoned Specialty District "SR" and Hometown Overlay "HD". Pursuant to Section
20-7.12. of the Land Development Regulations ("LDRs") of the City of South Miami, general
restaurants are permitted in the HD District after Special Use approval.
This application respectfully requests a Special Use approval for an approximately 4,045
sq. ft. foot restaurant consisting 01'2,000 sq. ft. for kitchen/preparation area; 1,500 sq. ft. for a 38
seat patron area; and, 545 sq . ft. for bathrooms and display areas. The restaurant will offer take-
out and delivery service. However, it will not include any drive-through service.

Rice is a casual restaurant featuring healthy Mediterranean dishes. All the menu
specialties including yogurt, hummus, falafel, chicken, fish and, of course, rice, are cooked fresh
to order. Rice's menu provides a healthy and affordable dining option in the City of South
Miami. Copies of the restaurant's menu are included with this submittal.
The proposed hours of operation for the restaurant are 11 :00 a.m. to 12:00 midnight,
every day. All deliveries and solid waste removal will take place off S.W. 71 st Street. In
addition to the dining options offered by this new restaurant, the location of the restaurant with
frontage along South Dixie Highway will be an opportunity to enhance the appearance of a very
visible building on this important commercial corridor of the City. The plans for Rice include
the remodeling of the exterior of the building with exciting new fayade.
