BACKGROUND Pursuant to Section 20-3.4(B)(4)(b) of the Land Development Code (LDC) the applicant is requesting Special Use Approval to locate a general restaurant at the above referenced location. The location of the restaurant will be in an existing street level storefront of a one-story, multi tenant retail/commercial building fronting on South Dixie Highway, and occupy the a storefront in that building (Figure 1). This proposed use is located in the "SR" Specialty Retail, "HD-OV" Hometown District Overlay zoning district which allows restaurants if approved through the special use process. The LDC provides that special uses must be approved by the City Commission after a public hearing and receipt of a recommendation from the Planning Board. Pursuant to the requirements for special use application review, the applicant provided notification via certified mail to the surrounding property owners of their intent to file said application; documentation is on file with the Planning & Zoning Department. Dixie Hwy Special use approval -General Restaurant June 12, 2013 Page 2 of3 STAFF ANALYSIS The applicant is proposing to open a 38 seat Mediterranean restaurant in the space occupied by.Z Mattress, situated between Tire Kingdom and Akashi Japanese Restaurant (Figure 2). The floor plan provided by the applicant indicates the space is approximately 4,000 square feet. The property is bounded by South Dixie Highway, SW 58th Avenue and SW 71st Street. The restaurant fronts South Dixie Highway with a secondary entrance on S W 71 st Street. Hours of operation for the restaurant will be between 11 :OOAM and 12:00 midnight, with all deliveries and solid waste removal handled offSW 71st Street. The general character of the surrounding area is mix of office, commercial, retail and restaurant uses. Based on the proposed square footage this restaurant will require approximately 40 parking spaces (1 space per 100 sq. ft.). While there are a few on-street parking along SW 71st Street and a City surface parking lot to the rear of the this property, the site has very limited on-site parking available. Based on the survey provided by the applicant there are only 6 parking spaces available plus an additional 2 handicap spaces behind the Tire Kingdom. Per the current requirements of the Land Development Code, the site is deficient by 32 parking spaces. Several of the older structures in this general area fronting South Dixie Highway face the same parking constraints. The Miami-Dade County Property Appraiser records indicate this structure was built in 1948. Pursuant to Section 20-7 .6(C)(2)(b) of the Hometown District Overlay for existing buildings, ij there are fewer spaces provided than required for existing buildings, the applicant may: obtain a special exception waiving the number of additional spaces required in accord with the process set forth in Section 20-7.51 of this chapter; or pay into the Hometown District Improvement Trust Fund afee as set forth below. The fee payment into the Hometown District Improvement Trust Fund for each space required but not provided shall be one thousand dollars ($1,000.00) per parking space per year payable at the time of renewal of the occupational license. Given the potential annual cost of meeting the parking requirement, the applicant has also filed a companion application for a "special exception" to obtain a waiver on the total number of parking spaces required. Dixie Hwy Special use approval -General Restaurant June 12, 2013 Page 3 of3 At their June 11,2013 Planning Board meeting, and following a public hearing, the board voted unanimously to approve the request for a special use to operate a general restaurant "Rice House of Kabob", located at 5818 S. Dixie Highway. The board's recommendation for approval was tied to their previous recommendation of approval for the special exception waiving strict compliance with the district's parking requirements. SPECIAL CONDITIONS APPLICABLE: The overall purpose of going through the special use process is to determine the compatibility of the proposed use with the surrounding neighborhood. A special use must comply with the conditions set forth in Section 20-5.8(B) in that the use: a) Will not adversely affect the health or safety of persons residing or working in the vicinity of the proposed use; b) Will not be detrimental to the public welfare or property or improvements in the neighborhood; and, c) Complies with all other applicable Code provisions. RECOMMENDATION A recommendation of approval of this special use is dependent on the favorable outcome of the companion application [PB-13-016] for a special exception for a parking waiver. Should the request for a waiver to the parking be approved by the Commission, staff recommends approval of the special use to locate a restaurant at 5818 South Dixie Highway.
