A Resolution relating to a request pursuant to Section 20-3.4(B)(6) of the City of South
Miami Land Development Code for Special Use Approval, to locate a used merchandise

BACKGROUND
Pursuant to Section 20-3.4(B)(6) of the City'S Land Development Code (LDC), the applicant is
requesting Special Use Approval to operate a retail consignment store at 5770 Sunset Drive. The
location of the retail store will be in alcove of the ground floor retail space adjacent to 1 st
National Bank of South Miami (Figure 1).

STAFF ANALYSIS

Second Time Around is a chain of upscale consignment boutiques that carries new and gently
worn, high-end merchandise. Based in Boston, this retailer has established a national presence
with forty-one stores in twelve states, from Maine to Miami. Since opening in 1973, the
Company has grown into a national brand, offering high-end items at budget friendly prices. As
previously mentioned, Second Time Around will occupy the recessed retail area that is a part of
the 1 st National Bank of South Miami building (Figure 2).
Pursuant to the City's Land Development Code a Used merchandise (consignment goods)retail
store shall mean an establishment, not representing the original manufacture, distributor or
retailer, which sells previously-owned, secondhand or vintage goods, apparel or products for
their residual value as used merchandise by someone other than the current owner on a
commission basis.
The City's Specialty Retail (SR) district is designed to maintain the basic specialty retail
character of the Sunset Drive commercial area by encouraging comparison retail uses at the
pedestrian-oriented grade level. Additionally, the Hometown District Overlay that
encompasses the SR zoning district implements a mixed-use commercial/residential land use
category that is characteristic of traditional down-towns. It is intended to provide for different
levels of retail uses, office uses, retail and office services and residential dwelling units with
an emphasis on mixed use development. The general character of the surrounding area is mix
of residential, office, commercial-retail, and restaurant.

At the June 11,2013 Planning Board meeting following a public hearing, the Board voted
unanimously to recommend approval of the use to the City Commission.
SPECIAL CONDITIONS APPLICABLE:
The special use conditions used merchandise stores enumerated in Section 20-3.4(B)(6) states:
(a) No such establishment shall be located less than one hundred (l00) feet from any
adjacent residential district.
(b) No outside display of goods or merchandise shall be permitted.
(c) No such establishment shall be located less than five hundred (500) feet from another
such establishment.
In addition, the overall purpose of going through the special use process is to determine the
compatibility of the proposed use with the surrounding neighborhood. A special use must
comply with the conditions set forth in Section 20-5.8(B) in that the use:
a) Will not adversely affect the health or safety of persons residing or working in the
vicinity of the proposed use;
b) Will not be detrimental to the public welfare or property or improvements in the
neighborhood; and,
c) Complies with all other applicable Code provisions.
RECOMMENDATION
The proposed use meets the requirements of the special use conditions review and is in keeping
with the general character of the City's downtown shopping district. Staff recommends approval
of this special use request for "Second Time Around" to operate a retail consignment store at
5770 Sunset Drive.

11 the applicant, Second Time Around submitted to the Planning Board Application No. PB-13-014

16 WHEREAS, a consignment store is permitted as a special use in within the Specialty
17 Retail "SR", Hometown District Overlay "HD-OV" zoning district and is subject to meeting
18 general conditions specified in LDC Section 20-5.8 and subject to meeting special use
19 requirements set forth in LDC Section 20-3 .4(B( 6); and

21 WHEREAS, the approval of a special use requires a recommendation from the Planning
22 Board and the approval of the City Commission after a public hearing; and

24 WHEREAS, at their June 11, 2013 meeting, the Planning Board following a public
25 hearing heard application PB-13-014 and recommended unanimous approval of the special use
26 request; and

28 WHEREAS, the City Commission desires to accept the recommendation of the Planning
29 Board.

31 NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY
32 COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA THAT:
