BACKGROUND
Pursuant to Section 20-3.4(B)(4)(b) of the Land Development Code (LDC) the applicant is
requesting Special Use Approval to operate a walk up restaurant at the above referenced
location. The location of the restaurant will be in the ground floor retail-office space of Red
Road Commons Apartments , Units EI08-113. (Figure 1). This proposed use is located in the
"PUD-R" Residential Planned Unit Development which allows restaurant, office and retail uses
on the ground floor as a part of the amended development agreement that was approved on
November 17, 2009. The City's Land Development Code (LDC) provides that special uses must
be approved by the City Commission after a public hearing and receipt of a recommendation
from the Planning Board. Pursuant to the requirements for special use application review, the
applicant provided notification via certified mail to the surrounding property owners of their
intent to file said application; documentation is on file with the Planning & Zoning Department.

STAFF ANALYSIS
The majority ofthe existing tenant space at Red Road Commons is currently vacant with the
exception of the leasing office. Pursuant to the amended development agreement, the extent of
retail, office and restaurant uses shall be limited by the capacity of provided parking. There are
approximately 958 parking spaces; 891 spaces are assigned for residential uses with 67 retail,
office and restaurant use. The restaurant called "Spot Coffee", is intended to be quick service
establishment, designed and operated as a "community-oriented cafe". The applicant's letter of
intent and restaurant profile are attached for your review. It is proposed that Spot Coffee will
seat approximately 85 patrons, and occupy approximately 2,657 square feet of the building
consisting of Units E108-EI13 fronting SW 57 Avenue (Red Road), which is currently vacant
(Figure 2).
Pursuant to the City's Land Development Code a walk-up restaurant shall mean an establishment
where the principal business is the sale of food and beverage to the customer in a ready-to-
consume state and where the design or principal method of operation is that of a storefront
restaurant offering quick food service to pedestrian where orders are taken at a counter, where
food is generally served in disposable wrapping or containers, and where food and beverages
may be carried out or consumed at tables in a patio area on private property. This use excludes
any service to a customer in a motor vehicle.
The general character of the surrounding area is mix of residential, office, commercial-retail,
restaurant and industrial uses, on the northwest side of US 1 (South Dixie Highway) and SW
57th Avenue (Red Road), with the City of Coral Gables and the University of Miami to the
east ofSW 57th Avenue. Most of the restaurant development in the City has been along USl
and in the downtown (Hometown Overlay) district. This proposal would provide additional
choices for the residents living at Red Road Commons and the surrounding area. Based on the
square footage this restaurant will require approximately 27 parking spaces (1 space per 100
sq. ft.). Although this proposed restaurant functions primarily as a walk-up restaurant,
sufficient surplus parking exists on-site to comply with the City'S parking requirements.

Following a public hearing at the May 14,2013 Planning Board meeting, the Board discussed
the location of the proposed restaurant and voted unanimously to recommend approval to the
City Commission.
SPECIAL CONDITIONS APPLICABLE:
The overall purpose of going through the special use process is to determine the compatibility of
the proposed use with the surrounding neighborhood. A special use must comply with the
conditions set forth in Section 20-5.8(B) in that the use:
a) Will not adversely affect the health or safety of persons residing or working in the
vicinity of the proposed use;
b) Will not be detrimental to the public welfare or property or improvements in the
neighborhood; and,
c) Complies with all other applicable Code provisions.
RECOMMENDATION
This use is permitted within the approved development agreement for the Red Road Commons
planned unit development (as revised), and meets the requirements for special use approval. Staff
recommends approval of this special use request for a walk-up restaurant (Spot Coffee), to be
located at 6600 SW 57 Avenue (Red Road Commons Units EI03-E108).

8 WHEREAS, pursuant to Section 20-3.4(B)(4)(b) of the Land Development Code (LDC),
9 the applicant, Gables Spot, LLC submitted to the Planning Board Application No. PB-13-010
10 requesting a Special Use Approval to operate a walk up restaurant to be located at 6600 SW 57
11 Avenue, Units El08-E1l3, within the Planned Use Development -Mixed Use (PUD-M) known
12 as Red Road Commons; and

14 WHEREAS, a walk up restaurant is permitted as a special use in within this PUD-M
15 pursuant to an amended development agreement approved on November 17, 2009, and is subject
16 to meeting general conditions specified in LDC Section 20-5.8 and meeting special use
17 requirements set forth in LDC Section 20-3.4(B)( 4)(b); and

19 WHEREAS, the approval of a special use requires a recommendation from the Planning
20 Board and the approval of the City Commission after a public hearing; and

22 WHEREAS, at the May 14, 2013 Special Meeting, the Planning Board following a
23 public hearing heard application PB-13-0 1 0 and recommended unanimous approval of the
24 special use request; and

26 WHEREAS, the City Commission desires to accept the recommendation of the Planning
27 Board.

29 NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY
30 COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA THAT:

32 Section 1: Special Use Application (PB-13-01O) submitted by applicant Gables Spot,
33 LLC for approval to operate a walk up restaurant located at 6600 SW 57 Avenue, Units EI08-
34 E1l3, within the Planned Use Development -Mixed Use (PUD-M) known as Red Road
35 Commons, is hereby subject to the following terms and conditions as well as all
36 applicable City ordinances, codes, rules and regulations:

38 (1) Adhere to the Special Conditions applicable in Section 20-
39 3.4(B)(4)(b)General Restaurant and Section 20-5.8 Special Use Approval of the Land
40 Development Code, listed.

42 (2) All signage for the new establishment is subject to review and approval by
43 the Environmental Review and Preservation Board (ERPB).

45 (3) Any and all exterior renovations or modifications are subject to review
46 and approval by the ERPB

2 (4) A separate application for outdoor dining would be required as per Section
3 20-3.3(E)(2) Outdoor Seating / Dining for all commercial Properties, of the Land

6 (5) If the subject walk up restaurant is determined by the Planning and Zoning
7 Director in the future, to be adversely affecting the health or safety of persons residing or
8 working in the vicinity of the proposed use , or to be detrimental to the public welfare or
9 property or improvements in the neighborhood, or not be in compliance with other
10 applicable Code provisions, the special use approval may be modified or revoked by the
11 City Commission upon notification and a public hearing.

13 Section 2. Severability. If any section clause , sentence, or phrase of this resolution is for
14 any reason held invalid or unconstitutional by a court of competent jurisdiction, the holding shall
15 not affect the validity of the remaining portions of this resolution.

17 Section 3. Effective Date. This resolution shall become effective immediately upon
18 adoption by vote of the City Commission.

City of South Miami Ordinance No . 08-06-18 76 requires all lobbyists before engag in g in any lobbying activities
to register with the C ity Clerk and pay an annual f ee of $500 per Ordinance No. 44-08-19 79. This applies to all
persons who are retained (whether paid or not) to repres ent a business entity or org anization to influence "City"
action. "City " action is broadly described to include the ranking and selection of professional consultants, and
virtually all-legislative, quasi-judicial and administrative action.
I. Call to Order and the Pledge of Allegiance to the Flag
Action: The meeting was called to order at 7:58PM

Applicant: Gables Spot, LLC
A Resolution relating to a request pursuant to Section 20-3.4(B)(4)(b) of the Land
Development Code for Special Use Approval to locate a walk up restaurant at 6600 SW 57
Avenue; Units E-I08-113, within the Planned Unit Development -Mixed Use (PUD-M)
known as Red Road Commons.

Mrs. Beckman read the item into the record.
Mr. Brimo presented the item to the Board.

Ms. Fischer asked Mr. Brimo what was there in that location before. Mr. Brimo responded that it
has always been vacant space. Dr. Philips stated that those 67 spaces are for everybody that may
be a retailer. Mr. Brimo replied correct; so as uses come in and fill the space we take away from
the total parking availability. Dr. Philips then stated that this use has the right to take as many
spaces as they need right now. Mr. Brimo responded that is correct; they are only required to
have 26 parking spaces based on their square footage which is according to the Land
Development Code (LDC). Mrs. Beckman stated that the parking for this establishment is
located inside the garage. Mr. Brimo responded that yes their parking garage is setup in such a
way that the access to the residential parking spaces is limited and require card access beyond a
certain point. He also stated that there is a section of the parking garage that is designated for
these uses that don't require card access. He then stated that the traffic for this use will produce
pedestrian traffic as opposed to drive in traffic.
Mr. Greiner stated his concern of there being outdoor seating for this establishment. Mr. Brimo
responded no there is no outdoor seating at this time; if outdoor seating is allowed that will be a
separate application that will go through the Planning Department and the City Manager.
Dr. Philips stated that it does look like you are planning to put about four tables outside. The
applicant stated that they do plan on providing some outdoor seating and they will go through the
necessary application process to do that. He also stated that they are trying to promote pedestrian
traffic and due to layout of Red Road Commons, the ramps that lead up and down have made it
rather difficult to get a second means of ingress/egress out of this space. Dr. Philips stated that it
is unlikely that people are going to drive to this location because of the distance from the garage.
He then stated that Spot Coffee is a unique mix between Starbucks and Panera Bread and their
desire is to cater to the community of South Miami and Coral Gables not necessarily drive in
traffic but more so pedestrian traffic.
Dr. Whitman asked the applicant if the parking will be free of charge to the customers of this
establishment. The applicant responded that he does not know if it will. He stated that the
building controls the parking garage and the fees associated. Dr. Whitman stated that he would
hope that it would be free. He then stated that with the Shops of Sunset one of the factors for
their lack of success was the fee for parking. Mr. Brimo stated that he will speak with the owners
of Spot Coffee about parking validation being an option. Dr. Whitman then asked the applicant if
this business is corporately owned or owned by a franchise. The applicant stated that he is unsure
but believes that it may be franchised with a district manager over the State of Florida. Mr.
Greiner stated that when he was Planning Director in Buffalo New York, he approved a Spot
Coffee that was located there. He stated that they run a great operation: quality coffee, they
manage the place on the interior and the exterior extremely well, they are not a mega chain and I
believe that this will be mostly walk-up traffic. He also stated that this was a family owned
company that was bought out by a Canadian Corporate Interest. He then stated that it's not really
a pure franchise, it has heavily involved owners that are corporate and maintain a fair amount of
the control.

Motion: Dr. Philips motioned for approval of the item as presented. Mrs. Beckman seconded the
motion.
Ms. Fischer stated that it seems that this item will be going in to Red Road Commons and this
sounds like it will be a great business and asset to South Miami. She then stated that the landlord
of Red Road Commons having this space filled of approximately 2600 square feet. She also
stated her concern of their promises of affordable housing and the trees along Red Road; she
would like for the City of South Miami to speak with the landlord of Red Road Commons to
allocate some of the housing as affordable and add the trees. Mr. Pepe stated that this use is not
coming to us from Red Road Commons and you cannot state that the approval or the rejection of
this item be conditional.
The Chairman then read the Special Use Conditions cited in the Land Development Code (LDC)
Section 20-3.4:
General Requirements.

All such uses shall comply with all requirements established in the appropriate
zoning use district, unless additional or more restrictive requirements are set forth
below or by the city commission.
All such uses shall be determined to be of a compatible and complementary
nature with any existing or planned surrounding uses.
A public hearing shall be held by the city commission to determine the overall
compatibility of the use with the surrounding neighborhood.
If a special use is, in the future, determined by the Director of Planning, to be
adversely affecting the health or safety of persons residing or working in the
vicinity of the proposed use, to be detrimental to the public welfare or property or
improvements in the neighborhood, or to be not in compliance with other
applicable Code provisions, the special use approval may be modified or revoked
by the City Commission upon notification and public hearing.
He then stated this is not up for negotiation, the conditions are restrictive and we cannot hold this
application hostage on the basis of something else that does not really apply to it. Mr. Brimo
stated that the conditions that Ms. Fischer is referring to cannot be applied to the review of this
restaurant use, what she is referring to is a separate issue that is reviewed by the City
Commission annually and has no bearing on this application. He then asked that the Board not
use that in consideration in coming to a decision on this item.
