BACKGROUND
Pursuant to Section 20-3.4(B)(4)(b) of the Land Development Code (LDC) the applicant, MIXT,
LLC is requesting Special Use Approval to operate a new general restaurant at the above
referenced location. The location of the restaurant will be in the southwest comer of the one
story structure, fronting SW 59th Avenue, indicated on the sketch below. The restaurant is
located in the "SR" Specialty Retail, "HD-OV" Hometown District Overlay zoning district which
allows restaurants if approved through the special use process. The LDC provides that special
uses must be approved by the City Commission after a public hearing and receipt of a
recommendation from the Planning Board. Pursuant to the requirements for special use
application review, the applicant provided notification via certified mail to the surrounding
property owners of their intent to file said application; documentation is on file with the Planning
& Zoning Department.

STAFF ANALYSIS
The proposed restaurant is intended to be a small bistro called MIXT, being launched by the
executive chef of Trattoria Sole. The restaurant will be located on the comer of SW 72 Street and
SW 59th Avenue [Figure 2]. The applicant's letter of intent is attached for your review. It is
proposed that MIXT will occupy approximately 700 square feet of this building, in the space that
was previously occupied by tty ogen Fruz". This building is also occupied by Trattoria Sole and
BIu By Best Friends [Figure 1]. Besides Yogen Fruz, the space was previously occupied other
food service operations.
The general character of the surrounding area is commercial-retail, restaurant and office uses,
which are consistent with the City'S central business district. The proposed use is consistent with
the zoning use district and surrounding uses. Based on the square footage this restaurant will
require approximately seven (7) parking spaces (1 space per 100 sq. ft.). Although there is
metered on-street parking on SW 59th Avenue and throughout the general area, the applicant is
still required to comply with the City's parking requirements. If the applicant is unable to provide
on-site parking, then they must either apply for and receive a special exception pursuant to
Section 20-7.51 of the City'S Land Development Code, waiving the number of required spaces,
or pay into the Hometown District Improvement Trust Fund [Section 20-7.6(C)(2)(b) and (c)].
The property owner has initiated a parking agreement with the City for the required spaces per
Section 20-7.6(C)(2)(c). The agreement will be processed and payment made upon final approval
of this application by the City Commission.

The application PB-13-007 was presented to the Planning Board for review and recommendation
at public hearings on March 12, 2013 and March 26, 2013. However the Board was unable to
conduct a public hearing due to a lack of quorum.
Staff is moving the item directly to the Commission pursuant to Section 20-6.1(B)(4)(a)(iii) of
the Land Development Code (LDC) that states, recommendations on all items before the board
shall be transmitted to the city commission within forty-five (45) calendar days of the time that
the item first appears on a regularly scheduled board agenda. If the board has not reached a
decision on the item before it during said period, then the item shall be transmitted forthwith to
the city commission with a "No Comment" recommendation.
SPECIAL CONDITIONS APPLICABLE:
The overall purpose of going through the special use process is to determine the compatibility of
the proposed use with the surrounding neighborhood. A special use must comply with the
conditions set forth in Section 20-5.8(B) in that the use:
a) Will not adversely affect the health or safety of persons residing or working in the
vicinity of the proposed use;
b) Will not be detrimental to the public welfare or property or improvements in the
neighborhood; and,
c) Complies with all other applicable Code provisions.
It is important to note that the use must also comply with Department of Health, Hotels and
Restaurants and/or Department of Agriculture requirements, and must be licensed by one or
more of these agencies prior to obtaining a City license.

8 WHEREAS, pursuant to Section 20-3.4(B)(4)(b) of the Land Development Code (LDC),
9 the applicant, MIXT, LLC submitted to the Planning Board Application No. PB-13-007
10 requesting a Special Use Approval to operate a general restaurant to be located at 7209 SW 59
11 Avenue, within the Specialty Retail "SR", Hometown District Overlay "HD-OV" zoning district;

14 WHEREAS, a general restaurant is permitted as a special use in within the Specialty
15 Retail "SR", Hometown District Overlay "HD-OV" zoning district and is subject to meeting
16 general conditions specified in LDC Section 20-5.8 and subject to meeting special use
17 requirements set forth in LDC Section 20-3 .4(B)( 4 )(b); and

19 WHEREAS, the approval of a special use requires a recommendation from the Planning
20 Board and the approval of the City Commission after a public hearing; and

22 WHEREAS, at both the March 12, 2013 and March 26, 2013 regular meetings, the

(2) The parking agreement between the applicant and the City for a total of seven (7) parking
spaces must be completed prior to the issuance of the Business Tax Receipt for the
general restaurant.
(3) All signage for the new establishment is subject to approval by the Environmental
Review and Preservation Board (ERPB); external signage for the new establishment is
limited in size and location to the existing signage for the previous occupant of spaces.
(4) Any and all exterior renovations or modifications for the new establishment is subject to
approval by the ERPB
(5) A separate application for outdoor dining would be required as per Section 20-3.3(E)(2)
Outdoor Seating / Dining for all commercial Properties, of the Land Development Code.
(6) If the subject general restaurant is determined by the Planning and Zoning Director in the
future, to be adversely affecting the health or safety of persons residing or working in the
vicinity of the proposed use, or to be detrimental to the public welfare or property or
improvements in the neighborhood, or not be in compliance with other applicable Code
provisions, the special use approval may be modified or revoked by the City Commission
upon notification and a public hearing.
Section 2: This resolution shall be effective immediately after the adoption hereof.
