Request: Approval of the Budget for the fiscal year 2012-2013, as submitted by the City Manager, including the capital improvement and pay plan, in a total amount of $19,410,709. Independently identified as: FY 2012-2013 General Fund Stormwater Drain Trust Fund Local Option Gas Tax Peoples Transportation Debt Service Hometown Improvement Fund Capital Improvement Program Emergency Reserve State Forfeiture Federal Forfeiture TOTAL Appropriation Amount 16,037,703 329,978 244,000 493,000 1,238,881 o 445,269 o 22,000 599,878 19,410,709 1 ORDINANCE NO. ___ _ 2 3 An Ordinance adopting the Capital and Operating Budget of 4 $19,410,709 and pay plan for the fiscal year 2012/2013. 5 6 WHEREAS, the City Manager has submitted a proposed budget together with a 7 budget message and supporting schedule including a pay plan; and 8 ~ 9 WHEREAS, pursuant to Chapter 200, Florida Statutes, the Mayor and City 10 Commission are required to adopt a tentative, and thereafter, a final budget for the City. 11 12 NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY 13 COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA THAT: 14 15 Section I. The Budget for the fiscal year, as submitted by the City Manager, 16 including the pay plan, as filed in the City Clerk's Office, in an amount of $19,410,709, be and 17 the same is hereby approved. Any amount encumbered during Fiscal Year 20 I 1-2012, but paid in Fiscal 21 Year 2012-2013 shall be transferred in accordance with GAAP and reflected in the 2012-2013 22 budget. 23 24 Section 3. Severability. If any section, clause, sentence, or phrase of this 25 ordinance is for any reason held invalid or unconstitutional by a court of competent jurisdiction, 26 this holding shall not affect the validity of the remaining portions of this ordinance. 27 28 Section 4. Ordinances in Conflict. All ordinances or parts of ordinances and all 29 section and parts of sections of ordinances in direct conflict herewith are hereby repealed. 30 However, it is not the intent of this section to repeal entire ordinances, or parts of ordinances, 31 that give the appearance of being in conflict when the two ordinances can be harmonized or 32 33 34 35 36 37 38 39 40 41 42 43 44 45 46 47 48 49 50 51 52 53 54 55 56 57 when only a portion of the ordinance in conflict needs to be repealed to harmonize the ordinances. If the ordinance in conflict can be harmonized by amending its terms, it is hereby amended to harmonize the two ordinances. Therefore, only that portion that needs to be repealed to harmonize the two ordinances shall be repealed. Section 5. Effective Date. This ordinance shall become effective upon enactment PASSED AND ENACTED this __ day of September, 2012.
