6 WHEREAS, the City Manager has submitted a proposed budget together with a
7 budget message and supporting schedule including a pay plan; and

9 WHEREAS, pursuant to Chapter 200, Florida Statutes, the Mayor and City
10 Commission are required to adopt a tentative, and thereafter, a final budget for the City.

12 NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY
13 COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA THAT:

15 Section I. The Budget for the fiscal year, as submitted by the City Manager,
16 including the pay plan, as filed in the City Clerk's Office, in an amount of $19,410,709, be and
17 the same is hereby approved. Independently identified as:

20 Section 2. . Any amount encumbered during Fiscal Year 20 I 1-2012, but paid in Fiscal
21 Year 2012-2013 shall be transferred in accordance with GAAP and reflected in the 2012-2013
22 budget.

24 Section 3. Severability. If any section, clause, sentence, or phrase of this
25 ordinance is for any reason held invalid or unconstitutional by a court of competent jurisdiction,
26 this holding shall not affect the validity of the remaining portions of this ordinance.

28 Section 4. Ordinances in Conflict. All ordinances or parts of ordinances and all
29 section and parts of sections of ordinances in direct conflict herewith are hereby repealed.
30 However, it is not the intent of this section to repeal entire ordinances, or parts of ordinances,
31 that give the appearance of being in conflict when the two ordinances can be harmonized or

when only a portion of the ordinance in conflict needs to be repealed to harmonize the
ordinances. If the ordinance in conflict can be harmonized by amending its terms, it is hereby
amended to harmonize the two ordinances. Therefore, only that portion that needs to be
repealed to harmonize the two ordinances shall be repealed.
Section 5. Effective Date. This ordinance shall become effective upon enactment
