RESOLUTION NO. ______ _
A Resolution of the City of South Miami, Florida, relating to the Police
Department. The Commission firmly disavows any and all attempts by
individual members of the Commission to outsource the South Miami Police
Department to Miami-Dade County.

7 WHEREAS, in the interest of transparency it is important for the entire Commission to
8 voice their intentions regarding the South Miami Police Department (SMPD) rather than working
9 independently behind the scenes and creating false perceptions in the community; and
10 WHEREAS, Commissioner Bob Welsh has stated publicly and was quoted in the Miami
11 Herald as to his intent to outsource the SMPD to the County without the endorsement of his
12 actions by the majority of this Commission; and
13 WHEREAS, it is the belief of this Commission that no single member of this
14 Commission has the expertise to conduct and present a complete and accurate assessment of the
15 SMPD; and
16 WHEREAS, Commissioner Bob Welsh's actions indicate that this Commission supports
17 and endorses his attempts to use his position as "Commissioner" while visiting other
18 municipalities to gain information and conduct independent analysis of the data to support his
19 position; and
20 WHEREAS, the indecision of retaining or outsourcing the SMPD by this commission
21 has created divisiveness and problems with the morale of all city staffers and the South Miami
22 Police Department; and
23 WHEREAS, the common good and safety of all residents, business owners, and visitors
24 should be paramount to this commission.
25 NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY
26 COMMISSION OF THE CITY OF SOUTH MIAMI:
27 Section 1. The City Commission, as a public body, has no intention of outsourcing the
28 South Miami Police Department and it commends the exemplary performance of the South
29 Miami Police under the leadership of Chief Orlando Martinez De Castro along with Majors Anna
30 Baixauli and Rene Landa.
31 Section 2. The Commission desires to restrict any individual member of the
32 Commission from acting as a representative of this body without the consent of the majority.
33 Section3. The commission desires to prohibit any member of the Commission from
34 acting independently in making or publishing statements or statistics as substantiated fact

1 without staff review, review by an independent consultant hired by the Commission, or by an
2 endorsement from the majority of the commission.
3 Section 4. If any section clause, sentence, or phrase of this resolution is for any reason
4 held invalid or unconstitutional by a court of competent jurisdiction, the holding shall not affect
5 the validity of the remaining portions of this resolution.
6 Section 5. This resolution shall take effect immediately upon adoption.
