An Ordinance relating to a request to amend the official zoning map of the City of South Miami
Land Development Code by changing the zoning use district for from "MOil Medium-Intensity
Office to "H" Hospital, for property located; Folio 09-4025-028-1820 and 09-4025-070-0020.
SUMMARY OF REQUEST
The subject rezoning request is an application submitted by Larkin Community Hospital in
conjunction with their previous unity of title approval (Resolution 41-12-13598) and Future Land
Use Map (FLUM) amendment request submitted by staff. The FLUM amendment was presented
to the City's Local Planning Agency on June 19,2012 to request a review and recommendation
of a map amendment [PB-12-0 19] for 6140 SW 70th Street, as well as the properties on the north
side of 70th Street, from Mixed-Use Commercial Residential (4 Story) to Hospital (H); the
recommendation was 3 ayes, 3 nays.
The property involved is Larkin's Osteopathic ManipUlative Medicine/Graduate Medical
Education Center, and School of Nursing. Please refer to items C 1 and C2 of the attached Plan
Sheet 2. The applicant is seeking to change the zoning use district on this entire property from
"MOil Medium-Intensity Office to Hospital (H). The training facilities located in this building
are permitted as ancillary uses to the principal hospital use on this unified site. The applicant is
requesting the zoning map amendment to unify the entire site under the Hospital(H) zoning
district. Although medical offices are permitted by right within MO zoning district, hospitals are
not. Please note that expansion of hospitals are subject special use approval, and to the
dimensional requirements applicable to the MO -Medium Intensity Office District.
The rezoning request went before the Planning Board on July 10, 2012, application PB-12-024,
and following a public hearing, the Board made a motion to recommend denial of the request to
the City Commission by a vote of7 ayes, 0 nay.

SITE LOCATION ANALYSIS
The total site area is 7,200 sq. ft. (0.17 acres mol), which is bounded by SW 70th Street and SW
61st Court, indicated on "Plan Sheet 1, as Lot CIt of the attached Larkin Site Map, with the
entrance to this facility off SW 70th Street. Based on the information submitted by the applicant,
there are no changes or expansion proposed to this facility.

Compatibility of Use: The site is currently part of the Larkin Community Hospital campus as
shown on Plan Sheet 2 (Larkin Campus Plan), and is adjacent to the main hospital facility
located at 7031 SW 62 Avenue, other Larkin owned property and surrounded by medical office,
commercial office, and parking uses. The site is approximately two blocks from the Metrorail
transit station and is within walking distance of the community center, a senior citizen center, a
library and an urban downtown. The property also is located within 400 feet from existing high
density residential developments. The existing future land use map category is currently Mixed
Use Commercial Residential, however, the applicant currently has a FLUM amendment request
pending before the City Commission to have this changed to the Hospital (H) category.

Public Facilities: This is a pre-existing Medical Office facility; no improvements or expansion
is being proposed at this time.
Parks / Recreation Concurrency
No impact.
Schools Impact
No impact.
Wastewater (Sewer)
The applicant will be required to obtain approval from the Miami-Dade Water and Sewer
Department for any proposed development on this site.
Transportation/Traffic
A development in this area of the City is not subject to transportation concurrency. Most of the
City of South Miami is within the County established Transportation Concurrency Exception
Area. Any future development or redevelopment of this site will have to comply with the traffic
impact analysis requirements of the land development code.
Comprehensive Plan:
While the proposed use as a unified hospital campus is compatible with the recent text
amendment to the City's Comprehensive Plan that reestablished the "H" hospital land use
category on November 1,2011 (Ordinance 37-11-2110), the current use could continue under the
current plan category. As previously noted, the applicant has a companion map amendment
application that is under review by the City Commission, to change the land use designation
fromMOto H.
Staff Recommendation:
This is an existing medical office facility whose use is conforming by the current zoning district.
While it is preferable to have the main portion of the hospital's campus with a consistent land use
and zoning designation, Larkin can continue to operate the medical uses and training facility
from this location without the need for an amendment to the zoning map. Staff cannot
recommend amending the official zoning map changing the zoning district for this property
from MO -Medium Intensity Office, to H -Hospital for the property located at 6140 SW 70th
Street.

WHEREAS, Application No. PB-12-024 was submitted to the Planning and Zoning
Department by Larkin Community Hospital, said application requesting to amend the official
zoning map of the City of South Miami by changing the zoning use district for property located
at 6140 SW 70 Street from Medium Intensity Office (MO) to the Hospital (H) zoning district;
and
WHEREAS, the current zoning designation does not permit hospitals, and the purpose of
the requested change in zoning is to unify the Larkin campus with the same zoning; and
WHEREAS, on July 10, 2012 after Public Hearing, the Planning Board determined that
the existing uses of the property could continue without necessitating a zoning map amendment;
and
WHEREAS, on July 10, 2012 after Public Hearing, the Planning Board recommended
denial of the requested zoning map amendment by a vote of 7 ayes 0 nay; and
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND THE CITY
COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA:
Section 1 Application No. PB-12-024 requesting to amend the official zoning map of
the City of South Miami by changing the zoning use district for property located at 6140 SW 70
Street from Medium Intensity Office (MO) to the Hospital (H) zoning district is hereby
Section 2 If any section, clause, sentence, or phrase of this ordinance is for any reason
held invalid or unconstitutional by a court of competent jurisdiction, this holding shall not affect
the validity of the remaining portions of this ordinance.
Section 3 All ordinances or parts of ordinances in conflict with the provisions of this
ordinance are hereby repealed.
Section 4 This ordinance shall be effective immediately after the adoption hereof.

Dear Mr. Brimo:
Please accept this application for rezoning of ,properties at 7031 SW 62 Avenue (the
'West Property") and 6140 SW 70 Street (the "East Property"). The West Property is currently
zoned TODD (MU-5), and the East Property is currently zoned "MO" (Medium Intensity Office).
Both properties are owned by Larkin Community Hospital, Inc. ("Larkiri"). Larkin also owns
land north of SW 70 Street (the "North Property"). Together, these three parcels will be
referenced as the "Larkin Properties".
Larkin ,hereby requests rezoning of both properties from TODD (MU-5) and MO to "Hi'
(Hospital District). This application, together with a City initiated redesignation of the
Comprehensive Plan for both properties, together with the North Property, to the new "HI!
(Hospital) category, will result in consistency between the Comprehensive Plan and Land
Development Code, ~nd consistency between these designations and the long-standing use of
the Larkin Properties:
The functional purpose of this application is to modernize emergency room services at
this Larkin facility. No hospital beds will be added as part of this work. The nature of the
proposed expansion, which will occur at the southeast corner of SW 70 Street and SW 62
Avenue, is illustrated on attached plans prepared by Naya Architects. Off-street parking that
serves the Property is primarily provided on the North Property.
This application to exPand and modernize larkin's facility on the Property will:
1. Not create additional traffic on adjacent residential streets;
