A Resolution appointing members to the Budget and Finance Committee for the
Fiscal Year 2012-2013for a term ending September 30, 2012.
I
WHEREAS, the City of South Miami recognizes that a key function of government is sound
fiscal management and careful budget preparation in order to be able to provide a high level of municipal
services to its residents and businesses; and
WHEREAS, the preparation of the City's budget is a highly specialized area of endeavor
requiring expertise and/or experience which is normally limited to professionals within the financial
management, accounting, auditing and municipal management fields; and
WHEREAS, the Mayor and Commission recognize the important contributions made by those
who serve on the various city boards and committees, and wish to appoint a full complement to each of
the active boards and committees; and
WHEREAS, the City Commission desires to appoint the members for the Budget and Finance
Committee for the 2012-2013 fiscal year budget, as established by Section 2-26.8 of the City's code of
ordinances, and pursuant to Article II, Section 8 of the Charter, as amended on February 9, 2010.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION
OF THE CITY OF SOUTH MIAMI, FLORIDA, THAT:
Section 1. The City Commission hereby appoints the following individuals to serve on the
committee to commence upon passage ofthis resolution for a term ending September 30, 2012:

Pursuant to the City of South Miami Code of Ordinance, Section 2-2.1.-Rules of procedure of city
commission; I reviewed the proposed resolution appointing members to the Budget and Finance
Committee for Fiscal Year 2012-2013 for a term ending September 30, 2012. In performing the
review part of the process is to review the respective nominee's committee application to
determine eligibility as specified in City of South Miami Code of Ordinance, Section 2-26.8.-
Budget and finance committee, subsection (c) Membership, terms, to wit: Members of the
committee shall be appointed by the mayor as provided for by the City Charter. The mayor shall
attempt to include representatives of the local business community, residents, and accounting and
finance experts, in the membership of the committee~ .. Additiol1ally, part of the review process is
to ensure that any nominee, through the nomination process, does not knowingly violate the
Charter; City Code of Ordinance, laws of the state or U.S.A., or violate any contracts the City may
currently be under.
In reviewing the nominees for the Budget and Finance Committee I found that Ms. Yvonne
Beckman, a South Miami resident, completed the City of South Miami Board/Committee
Application and provided the pertinent information. From the makeup of the proposed group that
would be making up the Budget and Finance Committee Ms. Beckman would be a qualified
candidate as a citizen.
It is with the deepest regret though that I must report that a series of emails generated by Yvonne
Beckman along with other emails generated by others in the community causes much concern to
me regarding their motives and actions. On March 10, 2012 Ms. Beckman wrote an email to
pinukh@gmail.com, Lorie, valerienewman09@gmail.com regarding Ms. Lorie Yanoshik's
resigning from the City' Planning Board. In the email Ms. Beckman alludes to the "Cuban mafia"
who have done exactly the same. This statement in and of itself is not an issue but it does begin a
course of national origin attack upon certain people. Two emails from Ms. Yanoshik dated April
15 and May 26, 2012, where she makes disparaging remarks relating to the ethnicity of the Chief
of Police and his relationship with others. In the two emails she specifically refers to "Cuban
Mafia." In the two emails it is apparent that she is aware, of a drive to make a Charter change as it
relates to the Chief of Police and the Finance Director positions and that she believes that there is
a Cuban Mafia composed of employees' of the City and non city employees. Additionally, in the
email from Sharon McCain to Lori Yanoshik dated April 14, 2012, the question is asked by Ms.
McCain, " ... who on the commission is behind this story and once again didn't want to dirty their
finger nails?" Ms. Yanoshik responds, "Stoddard, of course. Followed by the dynamic duo."
On June 28, 2012, an email was sent by Commissioner Bob Welsh to Nkenga Payne, Assistant
City Clerk, to forward a one way communication to the rest of the members of the Commission.
The email deal with the calling of a special commission meeting to discuss an ordinance to put on
the next election ballot a proposed charter change to add to the officers of the commission listed
in Article II, Section 7 (Officers), A (appointments) a fourth officer of the Commission, that of
Chief of Police, who would serve at the pleasure of the Commission yet on a daily basis comply
with the instructions of the City Manager. The reason stated is, "to make the Chief of Police more
responsive to the will of the people." On July 5, 2012 there was a second email from
Commissioner Welsh detailing 5 points of which point 4 dealt with in part with the
aforementioned charter change of the Chief of Police being a chartered officer. On July 13,2012,
Ms. Yvonne Beckman sent a letter to the Chief of Police of South Miami regarding an incident
that occurred on May 2012 and mentions Michael Schmich's arrest as being questionable and her
own incident of being arrested for allegedly unlawful reasons.
On July 15, 2012, a writing from Commissioner Welsh was printed on the Miami Herald where
he describes . the ethics violation complaint filed by this writer as the City Manager. He
marginalizes his indiscretions by stating that, "The city manager was looking for a 100-yard kick-
off return and had to settle for a safety." In the same writing he mentions Commissioner Valarie
Newman as allegedly saying, "Shame on You" on YouTube, referring to Commissioner Welsh.
On ,July 17, 2012, Commissioner Welsh places a public records request for all email
conversations written and received by Valerie Newman, written and received by Hector Mirabile,
PhD, and Written and received by Orlando Martinez, from September 2010 to the present. On
July 18, 2012, Mr. David Sanguesa wrote a highly defamatory and "hatred" letter about the Chief
of Police and I for our being Cuban and refers to the Cuban Mafia which is the term that Ms.
Beckman used in her March 10th email.
From the writings provided by Commissioner Welsh, Ms. Yanoshik and Beckman, and Mr. David
Sanguesa; and the times that they were sent; as well as their conduct it is apparent that the four
are conspiring to violate the civil rights of Chief Orlando Martinez De Castro~ Hector Mirabile,
PhD, and Commissioner Valerie Newman by intentionally selecting their victims, and their (Chief
Orlando Martinez De Castro and Hector Mirabile, PhD) contractual rights to work in the City of
South Miami, because of their actual or perceived national origin; to wit Cuban heritage.
Additionally, it is also apparent that the four are conspiring to force the Chief of Police to take
action in not prosecuting Mr. Michael Schmich for his arrest by the South Miami Police; which
may be considered obstruction of justice. The e-mails form the basis of what is commonly know
in US and State law as a "Hate Crime" and are at minimum considered slanderous.
It is illegal in this country to discriminate on the basis of race, creed, sexual orientation or
National origin.
Therefore, I recommend that Ms. Beckman's application for appointment into the Budget and
Finance Committee not be ratified by the Commission.
