1515 1 2 RESOLUTION NO. ______ _ 3 4 A Resolution directing the City Manager to seek an extension of the 5 December 31, 2012 deadline imposed by the pool construction grant for 6 "substantial completion" of the pool and to obtain a legally binding definition 7 of "substantial completion" from the entity that administers the grant. 8 9 10 WHEREAS on April 3, 2012, the Commission of the City of South Miami voted in the 11 affirmative to request $50,000 from the South Miami Community Redevelopment Agency 12 ("SMCRA") for staffing, insurance, maintenance and other costs of operation of a municipal 13 pool; and 14 15 WHEREAS on April 9, 2012, the Board of the SMCRA voted in the affirmative to spend 16 $100,000 of its funds to pay for Architectural and Engineering drawings for a community pool; 17 and 18 19 WHEREAS on April 9, 2012, the Board of the SMCRA voted in the affirmative to spend 20 $50,000 annually for the staffing, insurance, maintenance and other costs of operation of a 21 community pool; and 22 23 WHEREAS this is the first time in 40 years that any Commission of the City of South 24 Miami has voted in the affirmative to spend any money for the staffing, insurance, maintenance 25 or costs of operation of a municipal pool. 26 27 NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY 28 COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA: 29 30 Section 1. The City Manager is hereby directed to seek an extension of the December 31 31 st, 2012 deadline imposed by the pool construction grant for "substantial completion" of the 32 pool and to obtain a legally binding definition of "substantial completion" from the entity that 33 administers the Grant. 34 35 Section 2. The City Manager is hereby directed to contact Congresswoman Ileana Ros- 36 Lehtinen and ask her to inform the Federal department that funds the grant which will be used to 37 build the pool that the Community Redevelopment Agency of the City of South Miami is 38 seeking approval to allocated funds for the first time in 40 years to pay for the cost of operations 39 of a community pool in South Miami. 40 41 Section 3: If any section clause, sentence, or phrase of this resolution is for any reason 42 held invalid or unconstitutional by a court of competent jurisdiction, the holding shall not affect 43 the validity of the remaining portions of this resolution. 44 45 Section 4. This resolution shall become effective immediately upon adoption by vote of 46 the City Commission.
