A Resolution opposing the award of Tax Credits under the 2011 Universal 3
Application, Housing Credit Program for the development of a ninety-one 4
unit multifamily senior affordable housing project located at 6101 Sunset 5
Drive, South Miami, Florida 33143 as well as the Hometown Station and to 6
draft an ordinance placing a moratorium on multifamily development 7
pending appropriate studies of absorption and vacancy rates as well as 8
transportation and parks concurrency. 9

WHEREAS, Beneficial Communities submitted an application under the 2011 Universal 11
Application for housing tax credits; and 12

WHEREAS, Beneficial Communities proposes to develop a 91-unit senior affordable 14
multifamily project as Metro South Senior Apartments, LLC, to be located at 6101 Sunset Drive 15
within the City of South Miami, Florida; and 16
17
WHEREAS, the City Commission is requesting analysis of the existing number of 18
available multifamily, affordable units within the City; and 19
20
WHEREAS, the City Commission is requesting an absorption rate and vacancy rate 21
study of housing units within the City before additional projects are approved for development; 22
and 23
WHEREAS, that although the City's Land Development Code currently allows for 24
multifamily use at the 6101 location, it does not allow for such use at the Hometown Station, the 25
City Commission has expressed concerns on the impact of additional multifamily units on the 26
City's infrastructure of all new multifamily development; and 27

WHEREAS, the roadway levels of service (LOS) for principal and minor arterials within 29
the City are designated at LOS "F"; and 30

WHEREAS, the City is presently working to select a qualified consultant or consulting 32
firm to conduct a transportation capacity analysis, update its current roadway levels of service 33
and the impacts of its designation as a Transportation Concurrency Exception Area, which upon 34
completion and coupled with any necessary amendments to the City's Comprehensive Plan and 35
Land Development Regulations shall serve to further guide land use and development so that 36
development within the City will further the City's goal of sustainability; and 37

WHEREAS, the City Commission in its capacity as the legislative body that approves all 39
comprehensive land use planning and land development code changes, has reviewed this 40
Resolution. 41

NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY 43
COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA THAT: 44

. The City of South Miami, Florida, hereby adopts by reference all of the above 1
recitals and expresses its opposition to the award of housing tax credits for the Metro South 2
Senior Apartments, LLC, 91-unit senior affordable multifamily project located at 6101 Sunset 3
Drive and any tax credits that may have been requested by other entities for the Hometown 4
Station until such time as the City has conducted the necessary data and analysis enumerated 5
herein. 6

. The City Attorney shall draft an ordinance placing a moratorium on 8
multifamily development pending appropriate studies and to conduct the necessary data and 9
analysis enumerated hereinabove concerning transportation and parks concurrency as well as, but 10
not limited to, absorption and vacancy rates. 11

This resolution shall be effective immediately upon adoption. 13
