PUBLIC REMARKS (5 minutes) 27 28 Angie Fernandez, Community Outreach Representative with the State Attorney's Office 29 addressed the Commission regarding the various programs available to the residents. 30 31 Sharon McCain referred to the Mayor's pond. She then spoke about the proposed 32 community pool. 33 34 John Edward Smith referred to item no. 13, recommending a change in the language 35 from debates to forum. He then referred to the Environmental Review and Preservation 36 Board, recommending establishing a Design Review Board comprised of professionals. 37 38 Eda Harris referred to the Environmental Review and Preservation Board, saying that 39 this board serves the City better by being comprised of residents. 40 CITY COMMISSION MINUTES February 7, 2012 2 1 Beth Schwartz, a member of the Environmental Review and Preservation Board said 2 that the board should be comprised of architects as well as residents of the City. 3 4 Dick Ward spoke against unethical and unnecessary language towards the elected 5 officials. 6 7 Denise Covington expressed words of appreciation towards Commissioners Palmer and 8 Beasley who will not be seeking re-election at this time. 9 10 11 12 With no further speakers the public remarks section was closed. 13 L. Stoddard Mayor CITY OF SOUTH MIAMI OFFICE MEMORANDUM To: Honorable Mayor and City Commission Date: February 7,2012 afJ From: Hector Mirabile, Ph.D., City Manager (?; Re: Manager's Report A number of residents identified to staff that they were having poor reception of certain meetings which were televised on channel 77. The city's IT Department commenced an investigation to identify the problem of poor noise and picture reception and after two days of analysis it was determined that the problem was only with citizens having U-Verse. Today, AT&T came to City Hall and discovered that the problem was with one of their lines coming into the areas where the citizens reside. The verhal reason provided by the technician was that the line was too long and thus the transmission becomes garbled at times. AT&T is working on resolving the problem. This was not a City issue but IDC staff assisted the residents in identifying the true cause of the problem and moving through the bureaucratic landscape of AT & T. My office received numerous calls regarding campaign sign and their proper posting on private properties. Political signs are addressed in the Land Development Code, Section 24-4.3. After a careful review of the current City Ordinance and the Miami Dade County Ordinance on the placement of political signs, the Plamling and Zoning Director interpreted the ordinance to mean that a propeliy owner is able to place one (I) sign per campaign or specific proposed charter/constitutional amendment coming before the public for a vote. This would mean one sign per propelty for the mayor's race, plus one sign for each of the commission race (See attached interpretation). Additionally, the question on the same topic arose asking whether a property having a building or buildings, where the building or buildings are divided into individual units for rent are subject to only one sign per contiguous property. The Plaill1ing and Zoning Department asked the Miami Dade County Zoning staff how they interpreted the county code and they stated that as long as the signs were on the inside of the actual business unit they would be allowed to post political signs as per the zoning code (see above; attached interpretation). There are some citizens concerned about the proposed charter amendment relating to Article VI, Section 5. Franchise. The reason for the proposed change is that the City'S past practice has been to consider City Manager's Report to the Commission for February 7,2012 the granting or renewing the right to use real property or an interest I the real property relating to parks that are short term (less than one year) duration as a simple licensing process. With the advent of the latest City Attorney's opinion relating to franchises the opinion also extended to entities with a contract or any instrument providing that right to use real property which were routinely made for less than a year. The adverse impact of having baseball, tennis, soccer, yoga, dancing, etc. lumped into the concept of a franchise requirement would discourage the use of the parks by sports organizations since they would have to go through a highly stringent process. The City administration is hopeful that the citizens understand this limitation and would vote in favor of the charter change. The following are the accomplishments for the period ending February 7, 2012: i. Accomplishment. a. New IT IDC successes: L Built and configured 3 laptops for Police. Installed 4 desktops, 1 new and 3 rebuilt. Built and configured 3 new desktops. Rebuilt 9 laptops. 11. Installed and configured 2 new printers in the Police Dept. Ill. Installed GIS Server in rack and configured for remote access. iv. The AS-400 was down in order to install an upgrade necessary to proceed with the upgrade for OneSolution to 10.23. The upgrade was successful. v. We had some issues with missing reports in USA software. USA is non-responsive to support calls due to non-payment by the City. VI. IT was troubleshooting issues with AT&T and MFN uVerse due to issues on Channel 77' s broadcast. It has been determined that the issue is with the Tl line. This is currently being worked on. vii. IT is currently working on reconciling aircard inventory as well as laptop and desktop inventory. viii. IT has been working on planning the move for CRA and Central Services. IX. IT assisted with the setup for State of the City. x. IT has been working with cns to ensure the City of South Miami Police Dept is in compliance. xi. Completed training on OSS!. The training was a success. City Manager's Report to the Commission for February 7,2012 xii. Worked with GIS vendor to obtain maps for OSS!. b. Finance: Report for January 20 th through February 3rd • Total New Tickets: 41 Total Hours: 64 i. The Finance Department continues working with the auditors, which are currently completing the final stages of their respective field work. Finance is working with the City Manager's Office on completing the MD&A. The City remains on target to complete the external fmancial audit before March 15,2012. 11. Conducting system reviews at each ofthe respective departments. SunGard will be providing in mid-February, an updated version of OneSolution which will correct certain iss11es that were encountered in the implementation training phase. The go- live date is scheduled for March 2012. lll. Completed and billed storm water customers, which are currently not being billed by Miami-Dade County, for a total 321. The storm water charges cover January thru December 2012. iv. Continue billing customers for false alarms on a monthly basis. After establishing the current £"llse alarm billing program, Finance was able to increase collections in excess of three-fold. v. Continue working with IDC to implement the OnePoint Point-of-Sale cash register. Finance is looking to accept credit card transactions at the finance window and via online. VI. Finance continues working with Code Enforcement and Public Works on an official magistrate process for all outstanding excess trash fees. Finance provided the final list of outstanding invoices to Public Works so they may verify the proper support is available for confrrmation. Once complete, .Finance will be submitting invoices with a Magistrate set date should the customer like to appeal. Vll. Currently working to complete the financial monthly report for January 2012. We expect the report posted online before the second meeting of February. viii. Completed all end-of-year required tax forms which were submitted to the IRS. c. Grants and Sustainable Initiatives: 1. Co-hosted an Energy Savings Workshop with Miami-Dade County, Office of Sustainability at South Miami City Hall on Wednesday, January 25, 2012. City Manager's Report to the Commission for February 7,2012 ii. Assisted the Department of Finance in providing grant information for the FY 2011 fiscal audit. iii. Coordinated efforts with the Office of the City Clerk and the City Attorney to ensure the location of the Farmers Market is outside of the 100 ft solicitation zone during early election on Saturday, February 11,2012. iv. Coordinated efforts with Public Works and the Florida Department of Transportation to ensure that the City receives the remaining reimbursement in the amount of $97,597.00 for Sunset Drive, Phase IV project. v. Coordinated efforts with BioPlanet USA Corp and Miami-Dade County to initiated the Million Trees Miami, Restaurant Participation and Sponsorship Program in South Miami for the month of March 2012. Vi. Facilitated grant contract development with SFHIDT A (South Florida High Intensity Drug Trafficking Area) Program to retain the services of the Deputy Director of South Florida. vii. Coordinated efforts with Public Works and Florida Power and Light to increase light wattage along the following corridors: 1. SW 68 th Street between 58 th Place and 59 th Place 2. SW 61 5t Street between 66 th Street and 58 th Place viii. Attended an interactive, informational workshop on the Green Corridor PACE district, hosted by Y grene Energy Fund Florida, LLC on Tuesday, January 31, at the Cutler Bay Council Chambers. IX. Coordinated with City Attorney to ensure that Ocaquatics II contract is in compliance with the Community Development Block Grant contract for the Murray Park Pool project. x. Submitted progress reports for the following projects: 1. General Obligation Bond Program, Building Better Communities, Water Distribution System Extension 2. Safe Neighborhood Parks, Murray Park Pool d. Central Services: City Manager's Report to the Commission for February 7, 2012 I. Central Services is in process of securing accreditation from the National Institute of Governmental Purchasing (NIGP). The accreditation program formally recognizes excellence in public purchasing through the confirmation and documentation of a body of standards that exemplify a solid purchasing program. Submission of the accreditation application scheduled by March 30, 2012. ll. The first copier from our new Canon program with Oce' North America, was delivered on Monday, February 6, 2012 to Central Services. The Central Services copier will act as the beta site for installation and to monitor the networking process prior to receiving the balance of the copiers for each department. Once the copier is up and running, the copiers located in City Hall will be delivered followed by copiers at off-site 10catiollS. This new program is expected to generate a cost savings of $42,000 or 31 % over current costs. iii. Three fax phone lines were transferred from AT&T to Windstream that will produce an annual savings of $977. AT&T is eliminating certain pricing plans that would have increased the monthly charge to $213 vs $121 for Windstream. The savings also include a one-time set-up fee. IV. Assisted the Police Department by soliciting quotes for a planned illuminated wall sign for HQ's. The quotations are being reviewed by the department. v. An on-site inspection was conducted of the Mobley Building, the site the CRA department will temporarily re-locate to from Sylva Martin to accommodate the Central Services employees and equipment due to the remediation work to eliminate the presence of mold. Public Works, IDC and CRA were in attendance to ensure networking and phone lines are available for CRA. In addition, quotatiollS from moving companies were solicited to determine the most cost effective and timely process vs performing the move in-house. VI. The Purchasing Ordinance review is continuing with the City Attorney. The review will verify that the necessary procedures for implementing the purchasing ordinance are without conflict of the City's charter or Florida State Statute. e. Police: Unifonn Patrol Division I. Total of 27 arrests: 3 felonies, 12 misdemeanors, 6 traffic arrests, and served 6 warrants ll. Of those 27 arrests, 10 were narcotics related. iii. The Uniform Patrol Division has a DUI Saturation Patrol scheduled for February 17 th • This saturation will consist of approximately 10 members of the Patrol Division. Its purpose is to heighten public awareness of enforcement activities to reduce traffic violations and to detect and apprehend impaired drivers. City Manager's Report to the Commission for February 7,2012 iv. On Saturday January 28 t h, the city held its annual Martin Luther King Parade. The parade route was secured by members of the Patrol and Criminal Investigations Division. In order to make this event a safe and successful one, there were a total of 17 officers on overtime, 15 of which received a minimum 3hrs each and 2 received 8hrs in order to provide security at the community center following the parade. There were also 5 reserve officers and 10 police explorers that participated. Thanks to a coordinated effort between these officers and explorers, the parade route was secure and safe for the participants as well as the citizens who came out to enjoy the event. Criminal Investigation Division 1. As a follow-up to the previous City Manager's report regarding a 16 year old runaway from Montana who was found working at BT's Gentlemen's Club. The 16 year old runaway made statements that she gave birth to a baby in Miami-Dade County and stated the baby was staying somewhere in South Carolina. It was determined by medical testing that the 16 year old had never had a child. The case was turned over to the FBI and South Carolina authorities for Human Trafficking investigation. 11. SIU personnel detached with DEA as part of an on-going investigation seized $454,329 worth of assets and/or US currency. The City of South Miami is expected to receive approximately $96,082 as part of its asset forfeiture sharing agreement with DEA upon completion of the civil forfeiture process. Ill. On January 31 SIU personnel assigned with the DEA completed an investigation and served a search warrant in the City of North Miami. During the search 3 firearms were recovered along with a postal key which was stolen during a robbery of a postal employee. IV. On February I, 2012, OlU, SIU, and Patrol personnel (a total of six officers) participated in an on-duty burglary surveillance for six hours at the Red Road Commons Apartment. This surveillance was conducted after several break-ins to vehicles at the location and upon conducting an analysis of crime stats in the area. No suspicious activity was o bserved in the area. v. On February 3, 2012 GIU, SIU and Patrol personnel (a total of six officers) conducted an on-duty surveillance of the Shops at Sunset Place to concentrate on bicycle thefts. Thc operation was conducted for six hours utilizing a decoy bicycle. No suspicious activity was observed in the area. Parking Enforcement 1. The Parking Enforcement Unit issued a total of 3,765 citations from the time period of January 16 th thru February 5th • Total fme amount for these citations: $73,391.00 City Manager's Report to the Commission for February 7,2012 11. CE issued 38 courtesy notices; 5· notices of civil infractions with fines; and removed 102 snipe/illegal signs from the City's right-of-ways, and successfully closed 13 cases: • 4 out of 5, of the 102 signs were political signs from the National Campaign; none were for the local campaign. • Snipe/illegal signs are signs placed/stuck on the city's right of ways advertising a variety of things such as homes for sale, classes, etc. • The 13 closed cases include courtesy cases complied with and fines paid for. xi. Continued removal of small graffiti notices fi'om throughout downtown with biodegradable product. xii. Continued to work in collaboration with the Public Works department to address the handling of cases of outstanding excess garbage fees. These cases will be scheduled for hearing in March 2012. xiii. CE received, processed, and issued 150 new Business Tax Receipts (licenses). The new licenses are a direct result of proactive field inspections. The Department continues reviewing the Land Development Code, working in conjunction with the Planning Board and the City Attorney to provide recommended updates. a. The Planning Board at its January 31, 2012 regular meeting reviewed and recommended approval of certain changes to Section 20-8.9; Special Exceptions within the TODD, which was referred back to the Board by the City Commission. This item will be back before the City Commission for "First" reading on February 21,2012. b. An additional amendment to the Hometown District will be proposed to the Plalming Board at their February 28, 2012 regular meeting, addressing the time limit for development that is proposed to be reduced from 5-years for substantial completion, to 3-years. This is being proposed to be consistent with the TOD District amendment. II. The Miami Dade Affordable Housing Foundation sUbmitted applications for the development of several properties in the CRA. The properties, donated by the CRA to the Foundation for the construction of Silver LEED affordable homes, are all nonconforming lots of record that require variances prior to construction. These properties were reviewed by the Plal1l1ing Board on January 31, 2012, and were all recommended for approval. The City Commission will review the site plans at the February 21, 2012 regular meeting. Following Commission review and approval, the site plans will be forwarded to the ERPB for review prior to permitting. lll. The Miami Dade Affordable Housing Foundation will be submitting three (3) more development proposals for single-family properties in the CRA, once demolition of the two existing structures is completed, and the title policies are fmalized. This is expected to be completed by February 10,2012. These three lots are also substandard lots of record that will require variance review and approval prior to construction. iv. The Planning Board echoed Commissioner Pahner's request for additional language to be considered, allowing substandard lots of record to proceed to permit review without the need for lot variances. This proposal would not lessen yard setback, or other building massing and coverage requirements. Staff will be submitting proposed language for review at the February 28,2012 Plal1l1ing Board meeting. v. Manor Lane Traffic Calming Project: A Notice to Proceed was issued to the designer on February 3,2012 to conduct a traffic study that consists offield data collection, evaluation and recommendation of traffic calming devices and locations. Commerce Lane Road Resurfacing and Streetscape Project: Pursuant to CRA's Commission directive (January 9, 2012) to perform drainage and roadway improvements to the area, the designer is expected to submit the 50% drawings to CRA by the end of the week. Progress Lane Drainage Improvements: Public Works reviewed and offered comments to the 50% design drawings to the designer on December 29, 2011. The 100% drawings were submitted on January 31,2012. Plans were also submitted to the County's Public Works/Waste Management Department and the Department of Permitting, Environment and Regulatory Affairs for review and permitting. Pinecrest Villas: Survey ballot activities are ongoing. 50% of the survey ballots were returned for SW 79 th Street (between SW 59'h Avenue and SW 62"d Avenue). Ballots for the remaining areas along SW 58'h Avenue (between SW 74 Terrace and SW 80th Street) and SW 76 Street (between SW 58 th Avenue and SW 59 th Avenue) were delivered to residents. SW 64th Street Corridor Sidewalk Repair Project: Sidewalk repair work along SW 64tll Street is complete. Work is continuing on feeder streets fi-om SW 57'h Court to SW 59th Avenue. Citywide Roadway Resurfacing Project (Phase I): Road resurfacing work on the supplemental areas is complete. Public Works is preparing a punch list of items to be rectified or repaired before project close-out. Citywide Road Resurfacing Project (Phase II): Pursuant to an evaluative process, a vendor is selected and a resolution is prepared for the next Commission meeting. Stormwater Master Plan Update: The Selection Committee met on January 26,2012 and proposals were ranked based on the proposal's design approach and completeness. Negotiation meetings with the top ranked designer are ongoing. City Hall Septic Tank Sewer Connection: Because the Pump Station located behind City Hall is under a moratorium (i.e. no new sewer hook-ups are allowed at this time), DERM is requiring the City to file with the County's Clerk of the Courts an "Application and Acceptance of City Manager's Report (0 the Commission for February 7, 2012 Conditional Building Permit and Estoppel Notice" that provides reasonable assurance that the City will not connect until the moratorium is lifted. Once this application is filed, DERM will provide a conditional certification letter to the City that will allow the permitting process to continue with the Water and Sewer Department. Mango Terrace Traffic Calming Project: Field data collection activities were conducted on January 10,2012. The data is currently under review and the findings will be presented to Public Works within the next few weeks. Sunset Drive Median -Downtown: Comments to the 75% drawings were transmitted to the designer on January 20, 2012. Public Works is working with the Planning Department to submit this project for ERPB review. Citywide Sidewalk Repair Project Phase II (Downtown): The project is 75% completed. The. project addressed areas with severe cracks or damage caused by heaving of tree roots. Root pruning and root barrier installation were conducted to improve the longevity of the sidewalks. South Miami Bike Rack Initiative (Citywide): The City is in the process of procuring approximately 14 bike bollards to be installed in downtown Sunset Drive. The City's Land Development Code allows one (1) sign as provided io the Miami-Dade County Code of Ordinances. Subsequent to discussions with the County, it is my interpretation that the followiog would be permissible. One (1) sign per campaign and/or issue would be allowed to be displayed inside the window or storefront of each leased multi-tenant space,jor each authorized election. Since the City's Code refers to the County Code, the general size of these signs enumerated in the County Code is 22 inches by 28 inches. Additionally, businesses may only cover up to 10% of the window with signage.
