SUMMARY OF REOUEST The applicant, Larkin Community Hospital, Inc., is requesting review and approval of their request for Unity of Title for the following parcels; Lots I through 9, and Lots 18 through 20, less the West 10 feet of Lots 1,18,19, and 20, Block 1, Larkin Center, Plat Book 27,Page 67, of the Public Records of Miami-Dade County ("Western Property"); also known as 7031 SW 62 Avenue, South Miami, Florida, and Lots 1-3, Block 2, Larkin Center, Plat Book 27,Page 67, of the Public Records of Miami-Dade County, Florida ("Eastern Property"); also known as 6140 SW 70 Street, South Miami, Florida (collectively both properties will be referred to as "Property") for the purposes of operating a nursing school at 6140 SW 70 Street. BACKGROUND Larkin Hospital submitted a request to unify the title of the referenced property in December 2011, and a revised document in February 2012. The request is to allow the use of the facility located at 6140 SW 70th Street as a nursing school/training facility. While the City of South Miami Land development Code (LDC) does not specifically address post secondary teaching/training facilities, under the current LDC defmition of "Hospital", you are allowed to operate a training facility that is " .. .incidental and subordinate to the main use and must me an integral part of the hospital use." Section 20-2.3; Definitions: Hospital. Shall mean a building, or group of buildings, having room facilities for one (1) or more overnight patients, used for providing services for the in-patient medical or surgical care of sick or injured humans, and which may include related facilities such as laboratories, out-patient departments, training facilities. central service facilities, and staff offices; provided, however, that such related facility must be incidentaland subordinate to the main use and must be an integral part of the hospital operations. 2001 In addition, since the proposed use is not housed within the main hospital building, then a unity of title is necessary for tying that site/use to the principal hospital use as stipulated in the above definition. This incidental use must also comply with all other City of South Miami codes not specifically enumerated herein, i.e. department review, parking, occupational licensing, etc., as well as any applicable Florida Building and Fire Code requirements. 20-5.16 -Unity of title submittal and procedures. A Unity of Title, as defined in Section 20-2.3, shall be required as specified below and shall be a prerequisite to the issuance of a building permit. (A) Required. A unity of title shall be required in the following cases: I. Whenever the building site consists of more than one lot or parcel and the main building is located on one lot or parcel and auxiliary or accessory use buildings are located on the remaining lot or parcel comprising the building site. 2. Whenever the building site consists of more than one lot or parcel and the main building is located on one or more of the lots or parcels and the remaining lots or parcels encompassing the building site are required to meet the minimum zoning requirements. 3. Whenever a unity of title is required by a provision within this Code or is specifically required by an ordinance or resolution passed and adopted by the city commission. (B) Submittal. A unity of title shall be submitted to the planning and zoning department. (C) Approval. Once a unity of title is approved by the city attorney as to form and content, it shall be subject to approval by the city commission. (D) Recording. A unity of title shall be recorded in the public records of Miami-Dade County prior to the issuance of any building permit. The nnity of title shall run with the land and shall be binding upon the property owner, his/her successors and assigns. The owner shall pay the fee as required for recording a unity of title in the public records of Miami-Dade County. (E) Release. Any unity of title required by this section shall not be released except upon approval by resolution passed and adopted by the city commission, after a public hearing, and executed by the city manager and the city clerk. The release of the unity of title is contingent upon a cessation of the conditions and/or criteria which originally required the execution of the subject unity of title. RECOMMENDATION It is recommended that the Commission approve the unity of title request, then said unity of title shall be recorded in the public records of Miami-Dade County prior to the issuance of any building permit. Rule 6E-1.0032, Florida Administrative Code (FA C.) - Fair Consumer Practices has been amended to include a new subsection [6E-1.0032(12)] requiring the development of a training program for all staff who recruit prospective students or who participate in the admissions of prospective students. All institutions submitting an application for an institutional license are required to submit this training program for Commission approval. This requirement began with the July 2011 Commission meeting. In order for your Provisional License application to be complete, please provide the following: A training program for all staff who recruit prospective students or who participate in the admissions of prospective students. This may be accomplished by choosing one of the following two options: 1. Develop an in-house training program based on Rule 6E-1.0032(12), or 2. Contract with a training provider that has been approved by the Commission. Submit documentation that the institution has contracted with a training provider. A training program developed in-house would be placed on the Commission agenda. A training program developed by a training provider would not be placed on the Commission agenda.
