10I() 1 ORDINANCE NO. _____ _ 2 3 An Ordinance amending Chapter 2 -Administration, adding Sec. 4-2.2- 4 "State ofthe City Address". 5 6 Whereas, the City of South Miami (Athe City@) like many others, has the tradition of the 7 mayor delivering an annual State of the City Address; and 8 9 Whereas, this address has been delivered in January, shortly before elections in alternate 10 years; and 11 12 Whereas, the City Commission desires this address to objectively reflect the state of the 13 City's finances, processes, and people, rather than being influenced by ongoing political 14 campaigns within the City; and 15 16 Whereas, the City Commission wishes to make this address equally accessible to all 17 citizens of South Miami; and 18 19 Whereas, the Miami-Dade Commission on Ethics and Public Trust has specifically 20 recommended that the City not charge individuals for admission to South Miami's State of the 21 City Address as it did in past years. 22 23 NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY 24 COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA: 25 26 Section 1: The Code of Ordinances is hereby amended to add Sec. 4-2.2 -State of the 27 City Address, which shall read as follows: 28 29 Sec. 4-2.2 -State of the City Address 30 31 a) A State of the City Address shall be delivered each fiscal year by the Mayor, and 32 shall reflect the state of the City's finances, processes, and people. 33 34 b) The State of the City Address shall be delivered during the 60-day period 35 following final approval of the annual budget. No State of the City address may 36 be delivered at any other time of year. 37 38 c) No fee shall be charged and no donation shall be solicited from anyone III 39 association with the State of the City Address. 40 41 Section 2: Effective Date. This ordinance shall go into effect immediately following the 42 approval of the 2012-13 annual budget. 43 44 Section 3: Codification. The provisions of this ordinance shall become and be made 45 part of the Code of Ordinances of the City of South Miami as amended; that the sections of this Page 1 of2 ,;' 1 ordinance may be renumbered or re-Iettered to accomplish such intention; and that the word 2 "ordinance" may be changed to "section" or other appropriate word. 3 4 Section 4: Severability. If any section, clause, sentence, or phrase of this ordinance is 5 for any reason held invalid or unconstitutional by a court of competent jurisdiction, this holding 6 shall not affect the validity of the remaining portions of this ordinance. 7 8 Section 5: Ordinances in Conflict. All ordinances or parts of ordinances and all section 9 and parts of sections of ordinances in direct conflict herewith are hereby repealed. However, it is 10 not the intent of this section to repeal entire ordinances, or parts of ordinances, that give the 11 appearance of being in conflict when the two ordinances can be harmonized or when only a 12 portion of the ordinance in conflict needs to be repealed to harmonize the ordinances. If the 13 ordinance in conflict can be harmonized by amending its terms, it is hereby amended to 14 harmonize the two ordinances. Therefore, only that portion that needs to be repealed to 15 harmonize the two ordinances shall be repealed. 16 17 Section 6: Effective Date.
