A Resolution relating to a waiver of Planning & Zoning Department application fees for a
South Miami Community Redevelopment Agency sponsored L.E.E.D. certified affordable
housing development project; authorizing a waiver of application fees in the approximate
amount of $25,879 for thirteen (13) lot development variances required to construct six
(6) new single-family affordable homes on SMCRA conveyed properties identified as
Folio Numbers 09-4025-010-0060; 09-4025-010-0070; 09-4025-010-0080; 09-4025-010-
0090; 09-4025-028-0200; and 09-4025-009-0240.
Background
During the December 8, 2009 City Commission Meeting, the Commission approved Resolution
224-09-13033 establishing a policy to waive building permit fees and other City fees for South
Miami Community Redevelopment Agency (SMCRA) sponsored projects in the Community
Redevelopment Area (See Exhibit A). Resolution 224-09-13033 also acknowledges the
importance of providing incentives towards City revitalization efforts including the
construction of much needed affordable housing in the South Miami's Community
Redevelopment Area.
During the October 10,2011 Meeting of the South Miami Community Redevelopment Agency,
the SMCRA Board approved CRA Resolution No. 53-11-523 authorizing the construction of
six (6) Silver L.E.E.D. certified single-family affordable homes by the Miami-Dade Affordable
Housing Development Foundation (See Exhibit B). It should be noted that each of the
approved affordable housing development lots were platted prior to 1920. Based on a recent
review by the City'S Planning & Zoning Department, it was determined that up-to thirteen (13)
individual lot variances will be required to complete housing construction. Based on the current
Planning & Zoning Department fee schedule, the approximate total cost of the thirteen
individual variances would be $25,879.
In accordance with the guidelines established by City Commission Resolution No. 224-09-
13033 and based on the goal of providing sustainable, "affordable" housing opportunities for
residents of the City of South Miami, it is recommended that the above listed variance
application fees in the approximate amount of $25,879 be waived for this SMCRA sponsored,
non-for-profit affordable housing development project.

application fees for associated variances required to construct six (6) Silver L.E.E.D.
certified, affordable homes on South Miami Community Redevelopment Agency
conveyed "blighted" properties identified as Miami-Dade Count Folio Numbers 09-
4025-010-0060; 09-4025-010-0070; 09-4025-010-0080; 09-4025-010-0090; 09-4025-

Section 2. This resolution shall become effective immediately upon adoption

created to redevelop and revitalize a certain portion of the City of South Miami; and
WHEREAS, the Mayor and City Commission desire to establish a policy waiving
all building permit fees, and other City fees, under limited circumstances, pertaining to
projects within the SMCRA area, which projects are actually funded and/or operated by
the South Miami Community Redevelopment Agency (SMCRA).
NOW THEREFORE BE IT RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA;
Section 1. A policy is established waiving City of South Miami building permit
fees, and other City fees, under limited circumstances, pertaining to projects within the
SMCRA area, which projects are actually funded and/or operated by the South Miami
Community Redevelopment Agency (SMCRA).
Section 2. This policy shall be retroactive and apply to any period from
September 30,2009.
Section 3. Any permit or fee waiver exceeding $5,000 shall be presented to the
Cit'j Commission for approval.
Section 4. This resolution shall take effect immediately upon approval.

BACKGROUND AND ANALYSIS
The attached Resolution, sponsored by Commissioner Palmer establishes a Policy
waiving building permit fees and other City fees by the City of South Miami for projects
actually funded andlor operated by the South Miami Community Redevelopment Agency
(SMCRA).
Our own SMCRA will be able to go further with their limited budget if the City waives
building permit fees and other City fees. It is totally inconsistent to the goals of South
Miami to seek to provide affordable housing or other projects for the eRA area, while at
the same time unduly burdening our own SMCRA with the costs and expenses of
building permit fees and other fees.
Moreover, the Resolution urged by Cotrunissioner Palmer does not at all depart from
existing City Policy. As early as August 15, 2000, then Vice Mayor Foliu sponsored a
similar Resolution, #i 60-00-11 053 establishing a policy waiving Code Enforcement

Liens in an amount not to exceed $5,000.00 for those properties identified suitable for the
CRA Infill Housing Program.
Thus, the suggested Resolution follows the previmls established City policy, giving the
CRA all possible help to provide affordable housing or other worthwhile SMCRA
projects.

authorizing the SMCRA Director to enter into a property
conveyance agreement with the Miami-Dade Affordable Housing
Development Foundation for the construction of six (6) new
single-family, LEED certified, affordable homes on Agency owned
properties known as Folio Numbers 09-4025-010-0060; 09-4025-

disbursement in an amount not to exceed $5,000 to the Affordable

WHEREAS, during the August 15, 2011 Meeting, the Board authori~ed the
SMCRA Director and legal to negotiate contract tenns with the Miami-Dade
Affordable Housing Foundation for the conveyance of six (6) Agency owned housing
lots for the construction of six new single-family affordable homes; and
WHEREAS, in collaboration with General Council and with the Miami-Dade
Afford;lble Housing Foundation, staff negotiated formal development tenus with the
Miami-Dade Affordable Housing Foundation for construction of the six new single-
family, LEED certified, affordable homes; and
WHEREAS, the terms are based on the timely construction of LEED certified,
single-family affordable homes as well as the subsequent conveyance of the homes to
eligible "low" to "moderate" income households as defined by Miami-Dade
CountlHUJ) Affordable Housing Income Guidelines; and
WHEREAS, as part of their request for proposal, the Miami-Dade Affordable
Housing Foundation also acknowledged the fact that one Agency owned undersized lot
known as Folio No. 09-4025-009-0240 would require additional design costs to
produce construction drawings base based on the size of the lot; and
WHEREAS, the SMCRA Board desires to provide truly affordable housing
opportunities for residents of the SMCRA Community through the construction of
LEED certified, single-family affordable homes and to facilitate this goal, authorizes
the conveyance of six (6) SMCRA owned, blighted housing properties for new single-
family home construction.

REDEVELOPMENT AGENCY OF THE CITY OF SOUTH MIAMI,
FLORIDA THAT:
Section 1. The South Miami Community Redevelopment Agency
authorizes the SMCRA Director to enter into the affordable housing property
conveyance agreement attached as Exhibit A with the Miami-Dade Affordable
Housing Foundation Inc. for the conveyance of six (6) SMCRA owned blighted
housing lots identified as Folio Numbers 09-4025-010-0060; 09-4025-010-0070;
09-4025-010-0080; 09-4025-010-0090; 09-4025-028-0200; and 09-4025-009-0240
for construction of six (6) single-family, LEED certified affordable homes and
subsequent sale to six (6) eligible affordable income households as defined by
Miami-Dade County Affordable/HUD Affordable Housing Income Guidelines.
Section 2. The SMCRA Board additionally authorizes a funding
disbursement to the Affordable Housing Foundation in an amount not to exceed
$5,000 for architectural fees required to develop one complete set of construction
drawings for one Agency owned, undersized lot identified as Folio No. 09-4025-
009-0240 and charging Account No. 610-1110-553-31-20 (Affordable Housing
Design Services Account).
Following funding disbursement, the remaining balance in Account No. 610-1110-
553-31-20 will be $20,000.
Section 3. This resolution shall take effect immediately upon adoption.
