2 A Resolution to place a non-binding question on the February 14, 2012 election
3 ballot to allow voters to express their approval or disapproval of a City pool to be
4 constructed, maintained and operated by the City.
5 WHEREAS, the Mayor and City Commission of the City of South Miami desire
6 to have the benefit of the voter's opinion as to whether the City should build, maintain and
7 operate a pool.
8 NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY
9 COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA:
10 Section 1. The following question shall be submitted to the electors of the City of South
11 Miami at the next election to take place on February 14, 2012:

13 Title: Non-binding City Swimming Pool Capital
14 Improvements Project Referendum.

16 Ballot Question: The City of South Miami has
17 considered, as part of its capital improvements projects,
18 to build, maintain and operate a swimming pool. If the
19 question is approved by a majority of the voters voting at
20 the February 14, 2012 election, the City may decide to
21 build, maintain and operate a pool at the taxpayer's
22 expense. Would you favor such a project now or in the
23 future?

28 Section 2. If a majority of voters voting in the election approve the referendum
29 question, the City may decide to build, maintain and operate a pool at the taxpayer's expense.

31 Section 3. Severability. If any section, clause, sentence, or phrase of this resolution is
32 for any reason held invalid or unconstitutional by a court of competent jurisdiction, this holding
33 shall not affect the validity of the remaining portions of this resolution.

35 Section 4. Effective Date. This resolution shall become effective upon approval by the
36 vote ofthe Commission.

An ordinance camng for a voter referendum to amend Article V, Section 2, subsection
B of the City of South Miami Charter, deleting the provision for election conducted on
a group basis and providing for one vote for each seat and an election base on the
candidate(s) who receive the highest number of votes.
An Ordinance authorizing the City Manager to enter into a franchise contract with Earth
Leaning, inc. for the operation of a Farmers Market on City of South Miami property.
