Ord No 15-14-2193ORDINANCE No.15-14-2193 An Ordinance amending Section 20-3.4(B)(10)(a),(b)and (c)of the City of South Miami Land Development Code concerning special uses to clarify the conditions required for car washing operations. WHEREAS,Section 20-3.4 (B)(10)sets forth the conditions for "AUTO WASH OPERATIONS"and subsection (a)requires thatall such uses "shallbe conducted ina fully enclosed structure";and WHEREAS,the condition requiringafully enclosed structure prevents the use of automated and un-automated car washing operations in the Cityof South Miami,in spite of the fact that the City has authorized such uses in the past;and WHEREAS,the current automated operations in the City are conducted in structures thatonlyhave three sides with anopeningatboth ends to allow vehiclestobedrivenor pulled through the washing operation;and WHEREAS,an automated car wash has mechanical parts and there isarational basis for requiring that it be contained withina structure and that it be located at least 100 feet froma residential district duetothenoisegeneratedbysuchoperations;however,ahandcarwashing operation does not create anysignificantnoiseand there does not appear tobearational basis to require such operations to be contained withina structure or restricted toa set distance from a residential district;and WHEREAS,an automated carwashusuallyhasvehicles stacked up waiting to enter the carwashstructure;whereas,ahandcar washing operation doesnot require suchanassembly line foritsoperationsince vehicle donotneedtoenterandtravel through aset line of operations;and NOW,THEREFORE,BE IT ORDAINED BY THE MAYOR AND THE CITY COMMISSION OFTHECITYOFSOUTH MIAMI,FLORIDA: Section 1.Section 20-3.4 (B)(10)(a)ofthe City ofSouth Miami Land Development Code is hereby amended to read as follows: (10)AUTO WASH OPERATION (a)All such uses involving an automated car washing operation shall be conducted inafully enclosed structure enclosed on three sides. (b)All suchuses involving an automated car washing operation shall have storage lanesadequatetoaccommodate four (4)vehicles for each bay. (c)No such use involvingan automated car washing operation shallbe located less thanone hundred (100)feetfromanyresidential district. Section 2.Codification.Theprovisionsofthis ordinance shall become andbe made partoftheCodeofOrdinancesofthe City ofSouth Miami asamended;thatthesectionsofthis ordinancemayberenumberedor re-lettered to accomplish such intention;andthatthe word "ordinance"maybechangedto "section"orother appropriate word. Ord.No.15-14-2193 Section 3.Severability.If any section,clause,sentence,or phrase of this ordinance is for any reason held invalidor unconstitutional bya court of competent jurisdiction,this holding shall not affect the validity of the remaining portions of this ordinance. Section 4.Ordinances in Conflict.All ordinances or parts of ordinances and all sections and parts of sections of ordinances in direct conflict herewith are hereby repealed. However,itisnot the intent of this section to repeal entire ordinances,or parts of ordinances, that give the appearance of being in conflict when the two ordinances can be harmonized or when onlya portion of the ordinance inconflict needs to be repealed to harmonize the ordinances.If the ordinance inconflict can be harmonized by amending its terms,itis hereby amended to harmonize the two ordinances.Therefore,only that portion that needs tobe repealed to harmonize the two ordinances shall be repealed.
