An Ordinance relating to the year 2012 General Election of the
Mayor and City Commissioners for Groups, II and III; scheduling
the day, place and time of the election; providing for qualification of
candidates; providing for close of election books; approving the
official ballot; providing for notification.

Please bear in mind that any decision for conducting Early Voting must be
incorporated into this ordinance for purposes of informing the Elections Department in a
timely fashion.
The cost for conducting Early Voting is $3,000 per day (9:00 a.m. -5:00 p.m.), as
per attached estimate.

3 An Ordinance relating to the year 2012 General Election of the Mayor and
4 City Commissioners for Groups, II and III; scheduling the day, place and
5 time of the election; providing for qualification of candidates; providing for

9 WHEREAS, Article V, Section 2A, of the City of South Miami Charter provides
10 that the City Commission of the City of South Miami shall schedule a general election for
11 February of each even year, and that the Mayor shall be elected for a term of two (2)
12 years and commissioners shall be elected for terms of four (4) years at the general
13 election; and
14
15 WHEREAS, Article V, Section 2D, of the City of South Miami Charter provides
16 that no person may appear on the Ballot for Election as Mayor or City Commissioner if,
17 by the end of his or her current term of office, the person will have served (or, but for
18 resignation would have served) in office as the Mayor or as a City Commissioner for a
19 total of nine years or more; and
20
21 WHEREAS, the Charter requires the City Commission of the City of South Miami
22 to schedule the day, place and time of the general election by ordinance; and
23
24 WHEREAS, state law requires election books to close twenty-nine (29) days prior
25 to the election.

27 NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY
28 COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA:

30 Section 1. The 2012 General Election will be held on Tuesday, February 14,
31 2012. On that date, a mayor will be elected to serve a term of two (2) years, and two (2)
32 Commissioners, one from Group II and one from Group III, will be elected to serve a
33 term of four (4) years.
34 Section 2. The qualifying period for this election shall open Monday, January
35 9, 2012 at 9:00 a.m. and close Friday, January 13, 2012, precisely at 5:00 p.m.
36 Candidates shall qualify at the office of the City Clerk, 6130 Sunset Drive, South Miami,
37 Florida.

39 Section 3. Voting shall be conducted at City Hall in the City Commission
40 Chamber, 6130 Sunset Drive, South Miami, Florida. The polls shall open precisely at
41 7:00 a.m. and close precisely at 7:00 p.m.

Section 4. The sample ballot for the 2012 general election is annexed to this
ordinance.
Section 5. The election books shall close Monday, January 16,2012.
Section 6. The City Clerk shall publish notice of such general election once a
week for four consecutive weeks next preceding the general election in a newspaper of
general circulation in South Miami. The notice shall contain the date, time, and place of
the general election and identifY the Commission Groups.
Section 7. If any section, clause, sentence, or phrase of this ordinance is for any
reason held invalid or unconstitutional by a court of competent jurisdiction, the holding
shall not affect the validity of the remaining portions of this ordinance.
Section 8. All ordinances or parts of ordinances in conflict with the provisions
ofthis ordinance are repealed.
Section 9. This ordinance shall take effect immediately upon ennactment.
