APPLICANT'S REOUEST
Located in the Low-Intensity (LO) zoning district, the applicant is requesting approval to
open a barbershop at the above listed property.
STAFF ANALYSIS
Pursuant to Section 20-3.3(D) of the Land Development Code (LDC), a barber shop is a
permitted use in the LO zoning district via the special use process. Section 20-3.4(A) of
the LDC provides that special uses may be approved by the City Commission via a public
hearing following review and recommendation by the Planning Board.
Located in the Mobley Building, which is presently owned by the South Miami
Community Redevelopment Agency (SMCRA), the applicant proposes to open a barber
shop that would service the local community and the South Miami area. Mr. Williams,
the applicant, wishes to open his business in the first bay/section of the building, which is
shown as bay 1B on the attached Mobley Building Floor Plan.
Section 20-4.4(B)(1l) of the Land Development Code, stipulates that the parking
requirement for a beautylbarbershop is one space per 300 square feet of gross floor area;
the proposed barbershop with be approximately 150 square feet. Based on this
information, one (1) parking space will be required for the proposed use. The attached
boundary survey for the Mobley Building indicates approximately 6,405.6 square feet.
Using the parking ratio for a professional office use, which is one space per 250 square
feet of gross floor area, the SMCRA is required to provide at least twenty-six (26)
parking spaces for its tenants. Per the attached site plan there are a total of twenty-three
(23) parking on site spaces. The use of three (3) additional on-street parking spaces was
approved by the City Commission through Resolution 73-09-12882. These three (3)
spaces count towards the minimum parking requirement for Mobley Building. Based on

the available on-site parking and previous approval granted by the City Commission, the
minimum parking requirement for the proposed barbershop will be met.

In addition to the regulations that are listed in 20-3.4(A) of the LDC, the special
requirements must be met for the proposed use as well. Section 20-3.4(B)(16) of the LDC
provides the following special requirements for a barber shop.
(16) ACCESSORY RETAIL AND SERVICE USES. Within any permitted principal
building in LO or MO districts, accessory retail or service uses may be permitted
provided that:
(a) Such uses are located entirely within the principal building for the
convenience of the occupants of or visitors to the principal use;
(b) Such uses do not occupy more than ten (10) percent of the gross floor area of
the principal building in which located; and
(c) Such uses shall not have any signs or advertising visible from outside the
principal building.
Staff reviewed the application against the regulations listed above and finds that the
request is in compliance with these provisions. The only signage that the tenant will have
will be the business name on the master signage directory that was previously approved
by the Enviromnental Review & Preservation Board (ERPB). Because of this regulation,
the additional signage that was approved by the ERPB (nameplate next to the entrance to
the unit to be occupied) will not be permitted for use by the proposed barbershop at this
time, unless accompanied by a recommendation for approval by the Planning Board.
At the October II, 2011 Planning Board meeting after a public hearing on Case PB-II-
028, the board voted unanimously to recommend approval of the special use application
to the City Commission. The board also addressed the question of an additional
nameplate sign next to the entrance of the unit, and voted [6 yes, 1 no -Beckman] to
recommend that the business be allowed the additional sign.
SPECIAL CONDITIONS APPLICABLE:
The overall purpose of going through the special use process is to determine the
compatibility of the proposed use with the surrounding neighborhood. Therefore, a
special use must comply with the conditions set forth in Section20-5.8(B) in that the use:
a) Will not adversely affect the health or safety of persons residing or working in
the vicinity of the proposed use;
b) Will not be detrimental to the public welfare or property or improvements in
the neighborhood; and,
c) Complies with all other applicable Code provisions.
RECOMMENDATION:
Staff recommends that the Commission approve the special use application for a
barbershop, located at 5825 SW 68 Street.

7 WHEREAS, pursuant to Section 20-3.4(B)(16) of the Land Development Code (LDC),
8 the applicant, Rodney Williams submitted to the Planning Board Application No. PB-1I-028
9 requesting a Special Use Approval to operate a barber shop to be located on the ground floor of
10 an existing mixed use building at 5825 SW 68 Street within the "LO," Low-Intensity Office
II Zoning District; and

13 WHEREAS, a barber shop is a professional service which is permitted as a special use in
14 within the "LO," Low-Intensity Office Zoning District; and is subject to meeting general
15 conditions specified in LDC Section 20-5.8 and subject to meeting special use requirements set
16 forth in LDC Section 20-3.4(B)(16); and

18 WHEREAS, the South Miami Community Redevelopment Agency on September 19,
19 2011 by Resolution CRA 48-11-518, authorized a startup business grant in order to process the
20 special use approval application; and

22 WHEREAS, the approval of a special use requires a recommendation from the Planning
23 Board and the approval of the City Commission after a public hearing; and
24
25 WHEREAS, at its October 11, 2011 meeting the Planning Board, after public hearing,
26 unanimously adopted a motion recommending approval of the special use barber shop request.

28 WHEREAS, at its October II, 2011 meeting, the Planning Board after public hearing,
29 adopted a second motion recommending that the City Commission permit the barber shop to
30 have one additional small identifying sign on the building.

RECOlVIMENDA TION
The requested special use approval for the barbershop at the above listed location is an
appropriate use for the Mobley Building because of the low impact nature ofthis specific use; its
compatibility with the district, the compatibility with the existing tenants in the Mobley Building
and the surrounding neighborhood. Because of this, staff recommends approval of the request.

Agency (SMCRA) relating to Economic Development;
authorizing the SMCRA Director to enter into the Start-Up
B'usiness Grant agreement with Mr. Rodney Williams for the
disbursement of Start-Up Business grant funding in an amount
not to exceed $3,000 for payment of a required City of South
Miami Special-Use application fee and disbursement on a
reimbursable basis to Mr. Rodney Williams in an amount not to
exceed $2,000 for marketing and advertising expenditures
associated with establishing the start-up business and charging
the total amount to Account No. 610-1110-551-99-33 (Start-Up
Business Grant Program Account),
WHEREAS, during the August 15, 2011 Meeting, the SMCRA Board
recommended utilization of the Agency's Start-Up Business Assistance Program
for payment of a required City application fee for special use approval of barber
shop in the SMCRA owned Statt-Up Business & Community Service Facility
known as the Mobley Building; and
WHEREAS, Start-Up Business applicant, Ml', Rodney Williams recently
submitted a start-up business grant application and associated funding request for
SMCRA Board consideration; and
WHEREAS, based on approval of the grant funding request, a total funding
amount of $3,000 shall be disbursed to the City of South Miami Planning &
Zoning Department for payment of the required special use application fee and an
additional funding disbursement shall be disbursed to Mr. Rodney Williams on a
reimbursable basis for marketing and adveltising expenditures associated with the
establishment of the start-up business; and
WHEREAS, the SMCRA Board desires to facilitate the goals and objectives
contained in the Agency's adopted redevelopment plan including assisting local start-up'
businesses and expanding economic development opportunities.
NOW THEREFORE BE IT RESOLVED BY THE COMMUNITY
REDEVELOPMENT AGENCY OF THE CITY OF SOUTH MIAMI,
FLORIDA THAT:
Section I, The South Miami Community Redevelopment Agency
authorizes the SMCRA Director to enter into the Start-Up Business Grant
agreement attached as Exhibit B with Mr. Rodney Williams for the disbursement
of Start-Up Business Program grant funding in an amount not to exceed $5,000 for
payment of a required City of South Miami Special-Use application fee and

Letter ofIntent
Mr. Rodney Williams would like to open and operate a Barber Shop in the Mobley
building that is owned by South Miami Community Redevelopment Agency that has
recently been renovated. The first section or bay is currently reserved for start up
business; the area that I am requesting is approximately 150 square feet. There is no
Barber Shop within the CRA area that serves this section and this would be an asset to
the community. I am a license barber and I will also provide job creation, counseling and
mentoring which is needed. Thank you for the opportunity to use this location and to
serve our community.

You are hereby notified that an application has been submitted to the City of South Miami
Planning & Zoning Depaliment by the City of South Miami Community Redevelopment
Agency (SMCRA) on behalf of SMCRA start-up business applicant, Mr. Rodney Williams
for approval of a special-use permit· to operate a barber shop in SMCRA owned Office
Space #101 of the Agency's Business Incubator & Community Service Facility located at
5825 SW 68 th Street, South Miami, Florida 33143. The facility is also known as the
Mobley Building and is cunently located in the "Low Intensity Office" (LO) zoning
district.
The Soutb Miami Community Redevelopment Agency currently leases office space to
three (3) small start-up businesses within individual business offices of approximately 150
square feet in area (See Attllchcd Building Flool' Plan). Start-Up Business applicant, Mr.
Rodney Williams recently applied to the SMCRA for use of the remaining start-up
business space for the proposed small business use of barber shop.
Pursuant to Section 20-3.3(D) of the South Miami Land Development Code a barber shop
is permitted as Special Use in the "Low Intensity Office" (LO) Zoning District. The
proposed special use permit application will be reviewed by the City's Planning Board and
the City of South Miami City Commission. The Planning and Zoning Department, at 6130
Sunset Drive, South Miami, will have on file all documents, plans and supporting materials
pertaining to this application. In addition, the City's Planning and Zoning Department will
prepare and mail the required notices of public hearing in accordance with the notice
requirements of the City of South Miami Land Development Code.

City of South Miami Planning Board Members:
During the 2009-2010 Fiscal Year and based on the direction of the South Miami
Commnnity Redevelopment Agency (SMCRA) Board, the Agency established a statt-up
business and not-for-profit community service office initiative. The intent of the Start-Up
Business and Community Service Program is to encourage and promote eligible businesses
and comlllunity service providers in the Redevelopment Area. The Redevelopment Area was
originally established based on an adopted Findings of Necessity Repot1 identifying a
dramatic need in the Community Redevelopment Area for social, economic and structural
improvement.
The program is cUlTentlr. housed in the newly constructed SMCRA owned Mobley Building
located at 5825 SW 68" Street, South Miami, Florida 33143 (See Exhibit A). The Mobley
Building is approximately 6,100 square feet in area and is divided into thirteen (13) separate
office spaces currently being leased by eligible start-up businesses and not-for-profit
c011)munity service providers in the SMCRA Area (See Exhibit B -Building Site Plan &
Floor Plan).
The Mobley Building is also located in the "Low Intensity Office" (LO) zoning district
which Ct.IlTently allows several different office related uses including the use of Beauty 01'
Barber Shop which requires "special-use" approval. SMCRA staff recently received a start-
up business proposal from Mr. Rodney Williams which requests the lease of currently
available start-up business space in the SMCRA owned Mobley Building. The preliminary
start-up business proposal· was also reviewed by the South Miami Community
Redevelopment Agency Board during their June 13, 2011 Meeting and received a general
consensus in favor of the proposed start-up business use.
In ihe effort to encourage and promote aspiring start-up businesses in the Community
Redevelopment Area, SMCRA staff recommends approval of the attached Special-Use
application from Mr. Rodney Williams for the use of Beauty or Barber Shop in designated
start-up business space # 1B in the SMCRA owned Mobley Building located at 5825 SW 68'11

City of South Miami Ordinance No. 08-06-1876 requires all lobbyists before engaging in any lobbying activities
to register with the City Clerk and pay an annual fee of$500 per Ordinance No. 44-08-1979. This applies to all
persons who are retained (whether paid or not) to represent a business entity or organization to influence "City"
action. "City" action is broadly described to include the ranking and selection of professional consultants, and
virtually all-legislative, quasi-judicial and administrative action.

III. Administrative Matters
Dr. Whitman notified the public that Planning Board Item #PB-II-025 has been withdrawn.
Mr. Brimo notified the Board that the next scheduled meeting of the Planning Board (September 13,
2011) is on the same day as the first Budget Hearing for the City. Mr. Brimo then stated that the
meeting should be rescheduled for a late.r date. Because there were scheduling conflicts between the
Board members, Mr. Brimo stated that he would check the availability of the Commission Chambers
and notifY the Board of these dates.

Location: 5825 SW 68 Street
A Resolution relating to a request pursuant to Section 20-3.4(B)(16) of the Land
Development Code for Special Use Approval to locate a barber shop at 5825 SW 68 Street
within the "LO" Low-Intensity Office zoning district; and providing an effective date.
Ms. Beckman read the item into the record.
Mr. Brimo presented the item to the Planning Board.
Mr. Dundorf stated his concern of the existing carpeting not being consistent with the barber shop
and wants to know if it will be removed or replaced.
Mr. Brimo responded that the carpet would be removed due to it not being conducive to the barber
shop use. Should the use no longer exist and the space become office use then carpeting would go
down again or it would remain with hard flooring.
Mr. Dundorf asked if this would be at the discretion of the City of South Miami or the Community
Redevelopment Agency's (CRA). Mr. Brimo responded that it would be at the discretion of the CRA
Dr. Philips asked if the City of South Miami is responsible for the furnishings for the barber shop.
Mr. Brimo responded no we are not responsible.
Dr. Philips asked ifthe business is licensed. Mr. Brimo responded yes, the business will be licensed.
If this item is granted approval the barber shop would have to go through the licensing process of the
City of South Miami.
Dr. Philips stated that the applicant would not have to be a licensed barber. Mr. Brimo then
responded that if the applicant is practicing to cut hair that he is required to be licensed. Dr. Philips
asked if this Board is responsible for ensuring the licensing process. Mr. Brimo responded no not this
Board.
The Chairman opened the public hearing:
The applicant Mr. Rodney Williams addressed the Boards questions. He stated that he currently has a
mobile barber license by Miami-Dade County and the City of South Miami.
Ms. McCain stated that she supports this business in the Mobley building; her only concern is if there
is sufficient parking at the Mobley building for the clientele.
The Chairman closed the pnblic hearing:
Ms. Beckman asked the applicant if he attended any small business classes to ensure his success as a
business owner. She then asked if he had a proposed one year or a five-year plan.
The applicant responded to Ms. Beckman he stated that he received grants in the past from Miami-
Dade County, a part of the requirement was to take a classes in small business. He has a five-year
business plan for the proposed barber shop.
She also asked the applicant who will he pay rent to.
The applicant responded the rent will be paid to the CRA. Ms. Beckman asked the applicant how
much the rent will be a month. The applicant responded the rent will vary between the shared spaces
within the building.
Mr. Brimo responded that once this item is recommended for approval by this Board then it will go
before the City Commission Board.
Mr. Dundorf asked if signage will go up on the building.
Mr. Brimo responded that there will be a pile on sign to identify the uses of the building.
Mr. Dundorf asked the applicant if there were any road blocks OT did he experience any difficulty.
The appiicant responded that staff and the CRA were very helpful in this endeavor.
Motion: Mr. Dundorf motioned to approve the special use as presented. Mr. Cruz seconded the
motion
Vote: Yea: 6; Nay: 0
Second Motion: Dr. Whitman motioned to recommend the City Commission to allow a small
secondary sign to the exterior of the business. Ms. Philips seconded the motion.

Simple tips to prevent
fraud on the Internet

week I want to share with
you information being
provided by our Miami FBI
office. This is a real eye-
opener, and we thank the
FBI for keeping us in-
formed and giving us the
ability to help stop fraud in
its tracks.
In 2010, Floridians flled
almost 20,000 complaints
and suffered $37 million in
losses through fraudulent
activities on the Internet
For the past eight years, the
FBI has designated October
as National Cyber Security
Awareness Month to high-
light the importance of
protecting our cyber net-
works. The FBI leads the
national effort to investi-
gate Internet criminal ac-
tivity, called cyber crime,
including cyber-terrorism,
computer intrusion. online
sexual exploitation and
major cyber frauds. This
column focuses on cyber
frauds.
Internet criminals seek
to defraud victims through
a variety of schemes. The
more commonly used
methods include auction
fraud. credit card fraud,
identity theft. phishing
attacks and holiday/charity
scams. Here are a couple of
examples of these scams:
• In auction fraud, In-
ternet criminals post classi-
fied ads and auction an-
nouncements for products
they do not have and rip off
buyers by
creative use
of stolen
credit cards.
Fraudsters
receive a
victim's
order;
charge the
victim's
credit card
for the amount of the order,
then use a separate, stolen
credit card for the actual
purchase. They pocket the
purchase price obtained
from the victim's credit
card and have the mer~
chant ship the item directly
to the victim. Consequent-
ly, an item purchased from
an online auction, but re--
ceived directly from the
merchant, is a strong in-
dication of fraud. Victims
not only lose the money
paid to the fraudster, but
may be liable for receiving
stolen goods.
• In phishing schemes. a
fraudster poses as a bank
or other legitimate entity
and uses emails and scam
websites to obtain a vic-
tim's personal information.

bers and Social Security
account information. In
this scam. fraudsters direct
victims to follow a link or
call a number to update an
account or correct an a]~
leged problem. The link
directs the victim to a
fra,udulent website that
appears legitimate; Instead.
the site allows the fraudster
to steal the victim's person-
al information. Bottom line,
only go to the official web-
site to check accounts and
be leery of emails claiming
there is a problem with
your fmancial accounts.

temet scams in use today.

register your complaint.
