add-onRESOLUTION NO. __________ 1 2 A Resolution calling for the Mayor and City Commission to carry out 3 performance evaluations of the City Manager and the City Attorney prior to 4 consideration of contract modification. 5 6 WHEREAS, Section 2-4.4 of the City Code of Ordinances calls for annual evaluation of 7 the City Manager “each year within sixty (60) days before the city manager's contract 8 anniversary date.” 9 10 WHEREAS, The City Manager has been employed by the City of South Miami for just 11 over one year without a formal performance evaluation by the City Commission, and no 12 evaluation is currently scheduled; and 13 14 WHEREAS, The City Attorney has been employed by the City of South Miami for half 15 a year without a formal performance evaluation by the City Commission, and no plan or 16 statutory provision exists for such an evaluation prior to contract expiration; and 17 18 WHEREAS, The City Charter provides that City Manager and City Attorney serve at the 19 pleasure of the Commission; and 20 21 WHEREAS, Responsible supervision of employees and contractors requires careful and 22 thoughtful performance evaluation; and 23 24 WHEREAS, the Human Resources Director has expertise in matters of employee 25 evaluation; and 26 27 WHEREAS, The City Commission may wish to extend or renew the contracts of the 28 City Manager and the City Attorney in manners reflecting consideration of their performance; 29 30 NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY 31 COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA, THAT: 32 33 Section 1. 39 The City Commission hereby requests of the City Manager that the 34 Director of Human Resources work directly with the City Commission (rather than through the 35 City Manager who is to be evaluated) in crafting an annual performance evaluation instrument 36 that can be used effectively to evaluate the City Manager as per the terms of Section 2-4.4 of the 37 City Code of Ordinances, and to guide the Commission in its effective administration. 38 Section 2. 44 The City Commission hereby requests of the City Manager that the 40 Director of Human Resources work with the City Commission in crafting an annual performance 41 evaluation instrument appropriate to evaluate the City Attorney’s fulfillment of his contractual 42 duties, and to guide the Commission in its effective administration. 43 Page 2 of 2 Section 3. 4 The City Commission shall complete a careful performance evaluation of 1 the City Manager and the City Attorney this year prior to extending or renewing the contract of 2 either. 3 Section 4. 9 The City Clerk shall, in coordination with the City Commission, schedule 5 future evaluations of the City Manager and City Attorney to be completed by the City 6 Commission on an annual basis to permit timely and thoughtful performance feedback and 7 contract consideration by the City Commission. 8 Section 5. 13 An ordinance amending Section 2-4 of the City Code of Ordinances and 10 providing for annual evaluation of the City Attorney shall be drafted for consideration and vote 11 of the Commission. 12 Section 6. 15 This resolution shall take effect immediately upon adoption. 14 Passed and adopted this ___ day of October, 2011. 16 17 ATTEST: APPROVED: 18 19 20 _________________________ ___________________________ 21 CITY CLERK MAYOR 22 23 COMMISSION VOTE: 24 Mayor Stoddard: 25 Vice Mayor Newman: 26 Commissioner Palmer: 27 Commissioner Beasley: 28 Commissioner Harris: 29 READ AND APPROVED AS TO FORM 30 AND SUFFICIENCY: 31 32 33 ____________________________ 34 CITY ATTORNEY 35
