An ordinance amending the fee schedule to increase some, adding new, and deleting
some fees from the schedule.
The city administration periodically reviews the city's fee schedule. The city
administration is proposing changes within five sections of the schedule of fees.
Below please find the specific five sections along with a description outlining the
details for revising the particular fee.
FINANCE DEPARTMENT FEE SCHEDULE
CREDIT CARD PROCESSING FEE
This fee is a pass-through fee. The city is charged by the credit card companies a fee
to process all credit card transactions. The fee charged to the city varies depending
on the card; Visa, MasterCard or Discover and which type, gold, platinum, etc. The
average fee charged to the city, taking into account the necessary processing
supplies, is approximately $3 per transaction.
COST PER CHECK ISSUED
The city at this time issues checks to all vendors. Once the new finance system is
fully operational, and in an effort to comply with the city's efforts of going-paperless,
Finance will be providing vendors with free electronic payment options; the E-
payables program and ACH payments. Assuming the vendors choose not to join the
two free electronic forms of payment and choose to receive a check, they will be
charged a fee to cover the costs associated with the check processing. This fee will
only be charged to companies which do business with the city. Individuals obtaining a
refund for payment or a one-time check will not be subject to the cost per check
fee.
SUPPORT:
PARKS AND RECREATION FEE SCHEDULE
AFTER SCHOOL HOUSE PROGRAM AND CAMPS
Fees for the After School House Program as per the Commissioners direction are for
residents to pay $25 per month and non-residents $40 weekly.
FOOTBALL & CHEERLEADING
The fee associated with this activity now reflects the insurance cost which was always
charged to participants, but is now reflected in the actual schedule of fees. All
participants in the football and cheerleading programs are required to pay an
insurance fee.
WEEKLY MEMBERSHIP
Creating this new fee may increase revenues to cover costs associated with the
Fitness Center. The new membership category would be on a weekly basis, providing
another option to individuals interested in participating.
PUBLIC WORKS & UTILITIES FEE SCHEDULE
TEMPORARY FULL ROAD AND/OR SIDEWALK CLOSURE
The City of South Miami is revising the existing road and sidewalk closure fee in an
effort to formulate a fee consistent with fees currently being charged by other
municipalities within Miami-Dade County. The city administration believes the existing
formula currently being applied is excessive and does not foster any community
special events.
TRASH COLLECTION
The fee amount originally placed for the pickup of appliances was incorrectly stated at
$500 per appliance. The proposed change will correct the error and place the fee at
$50, as originally intended.

9 WHEREAS, the cost of services for Parks & Recreation, Public Works and Finance and other related
10 fees increased considerably in the past year with new services being requested; and,
11
12 WHEREAS, the Mayor and City Commission desires to amend Section 2-7(c) of the City's Code of
13 Ordinances to delegate the power and authority to the City Manager to set fees and amend the City's Fee
14 Schedule from time to time, provided the change made or fee set by the City Manager to the Fee Schedule is
15 supported by the cost of the goods or services for which the fee is being charged.

17 NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COMMISSION OF
18 THE CITY OF SOUTH MIAMI, FLORIDA THAT:

20 Section 1: The City's current Fee Schedule as set forth in Ordinance No. 04-11-2077 shall be
21 repealed upon the effective date of the Fee Schedule established by the City Manager pursuant to the
22 authority vested in him by this ordinance.

24 Section 2: Section 2-7, titled "Administration department; functions and duties." is
25 hereby amended to read as follows:

27 Sec. 2-7. -Administration department; functions and duties.
28 The administration department shall operate directly under the supervision of the city
29 manager and shall consist of the following divisions and duties:

31 (c) The city manager shall establish fees to be charged for the furnishing of
32 copies of city records and documents and. The city manager shall establish fees to be
33 charged for participation in city sponsored programs, including but not limited, to those
34 conducted by the recreational department; a different schedule of fees may be established
35 for nonresidents of the city. ¥ihere services are perrorrnesby the city ans a fee not
36 establishes by the commission, the city manager shall establish sueh fee. The power and
37 authority to amend the City's Fee Schedule is hereby delegate to the City Manager to increase fees,
38 decrease fees or to set the amount ofa fee established by any fnture ordinance, provided the
39 change made or fee set by the City Manager to the Fee Schedule does not exceed the cost of the
40 goods or services for which the fee is being charged. The change in the Fee Schedule shall only
41 become effective the day after the change is presented to the City Commission in the City
42 Manager's Report, or otherwise in writing, at or before the meeting of the City Commission and
43 subject to any revision to the Fee Schedule approved by motion and a majority vote of the
44 Commission. The City Commission retains the right to change the Fee Schedule at anytime on its
45 own initiative in accordance witll the normal procedure for changing a city ordinance. Any fees
46 listed in the City's Fee Schednle may be waived or reduced by resolution. A list of all fees and
47 charges established by the C"ity Mmanager shall be on file with the C"ity C"lerk together

1 with all amendments and changes thereto and available for public inspection. All fees and
2 charges established pursuant hereto shall be predicated upon the actual cost to the Ccity
3 and subject to review by the Ccity Ccommission .

4 Section 3. The provisions of this ordinance shall become and be made part of the
5 Code of Ordinances of the City of South Miami as amended; that the sections of this ordinance
6 may be renumbered or re-lettered to accomplish such intention; and that the word "ordinance"
7 may be changed to "section" or other appropriate word.
8 Section 4. If any section, clause, sentence, or phrase of this ordinance is for any
9 reason held invalid or unconstitutional by a court of competent jurisdiction, this holding shall not
10 affect the validity of the remaining portions of this ordinance.
11 Section 5. All ordinances or parts of ordinances and all section and parts of sections
12 of ordinances in direct conflict herewith are hereby repealed. However, it is not the intent of this
13 section to repeal entire ordinances, or parts of ordinances, that give the appearance of being in
14 conflict when the two ordinances can be harmonized or when only a portion of the ordinance in
15 conflict needs to be repealed to harmonize the ordinances. If the ordinance in conflict can be
16 harmonized by amending its terms, it is hereby amended to harmonize the two ordinances.
17 Therefore, only that portion that needs to be repealed to harmonize the two ordinances shall be
18 repealed.
19 Section 6. This ordinance shall take effect immediately upon enactment.
