7 The City Commission of the City of South Miami, Florida met
8 in regular session on Tuesday, June 14, 2011, beginning at 7:21
9 p.m., in the City Commission Chambers, 6130 Sunset Drive.

16 our brief, since the owner decided they wanted to
17 continue with their petition for certiorari; what
18 they basically want to do is have the court find
19 that the property is not historic;
20 o On the FP &L case, we are getting prepared to file
21 our agency report which is due tomorrow;
22 o On the Moya litigation, which is the Federal Labor
23 Relations Act case concerning overtime pay, we are
24 continuing to do our research and due diligence so
25 that we will be prepared to advise the Commission
26 as to what our liabilities are;
27 o We have commenced to review the First National Bank
28 development agreement to see whether they have
29 complied with all the requirements.

43 South Miami Park; he also referred to the item relating to the
44 Pension Board term limits.

46 Marice Chael addressed the Commission regarding a community
47 bike ride which had been planned for Monday night.

1 Brad Cassel addressed the Commission in opposition of item
2 no. 11, saying that the package is deficient. He also spoke
3 about item no. 6 relating to Pension Board term limits.

6 Farmers' Market and also about the boards membership term
7 limits.

9 Dick Ward, Chair of the Parks and Recreation Board
10 addressed the Commission in support of item no. 6, speaking
11 about the importance of having continuity in boards.

13 John Edward Smith addressed the Commission about his own
14 experience of bike riding; he added that bike riding constitutes
15 a risk and that people have to abide by the laws of the State of
16 Florida and be careful.

43 then recommended directing the City Manager to explore
44 different options for obtaining donations; Dr.
45 Mirabile reminded the Commission that there is an
46 ordinance prohibiting serving alcoholic beverages in
47 parks; however, he said that we could ask them for
48 donations in order to place their banners.

19 restrictive as to where food vendors can sell their food; one of
20 the places where it is not allowed is Sunset Drive, impacting
21 all of the special events such as the arts festival, etc.;
22 therefore, this ordinance would allow vendors at our special
23 events without violating our code.

27 Sharon McCain requested some clarification. Dr. Mirabile
28 explained that all food vendors are required to have their
29 County vendor's permit; currently, our code only allows food
30 vendors in the industrial site of the City or any construction
31 site.

Commissioner Palmer said that she is not in favor of a two -
story clinic because she perceives it more as a hospital issue
where they would move it around.
Dr. Mirabile said that he has observed a large number of
clinics all around that are currently in strip malls. He then
cautioned about the future state when the trend may be moving
clinics into self - standing buildings that could be higher than
two stories.

Re: Manager's Report
The following is my report for the commission meeting of June 14, 2011.
During some past commission meetings the question came up as to what is happening with the
67 Avenue project by Miami -Dade County. The street markings were temporary with the
permanent striping work being made including on- street parking spaces along SW 68th Street and
69t" Street. We are informed that the tree planting along this area is schedule for July 2011.
During the past month the City has received numerous calls regarding the White Fly situation in
South Miami. This is not a localized occurrence. We contacted Miami -Dade County and they
were willing to spray with pesticides but the pesticide would pose a risk to other wild life which
we did not want to risk. Mr. Baker contacted Dr. Meyer, from the University of Florida, who
suggested that we wait for the rain to come which would greatly alleviate the situation. The
Parks and Recreation Department is requesting Dr. Meyer to conduct a presentation on this
matter at City Hall during the day which will be recorded and televised for the citizens to view
and be informed.
The Parks and Recreation Department reports that the city currently has four groups scheduled
for swimming programs once a week. The schedule is Mondays: kindergarten and first graders;
Tuesdays: second and third graders; Wednesdays: fourth and fifth graders; and Thursdays:
sixth and up. The number of children enrolled in the program is as follows:
Paying residents: 78
Paying non - residents: 23
CRA scholarships: 46
Total 147
Residents pay $30 and non - residents pay $75 per week. The swimming classes are conducted by
Tamiami Park staff.
City Manager's Report to the Commission for June 1.4, 2011
There were requests made by citizens to extend, the hours_ of operation and lighting of the tennis
courts at Marshall Williamson Park until 9:00 pm. The city is accommodating this request.
1. Accomplishment.
a. New IT IDC successes:
i. Granicus was tested and is operational as it relates to the structure. The ability
to watch live meetings and record them to the Granicus archive has a
projected completion time of Friday, June 17, 2011.
ii. Setup Granicus training for the 16t' (Tentative)
iii. 9 out of 11 USA Software issues were resolved
iv. Provided training on the City.WebSite. .
v. Moved IBM Chain printer and installed.
vi. Built and configured 4 new police laptops and 2 new systems for Parks and
Recreation
vii. Assisted with video and photos of officer training
b. Finance:
i. Finance continues working with Public Works GIS to have a complete and
accurate list of properties for the stormwater billing. GIS is having issues with
the current GIS computer workstation, with the adoption of the Stormwater
Ordinance, Finance and Public works may continue to work on the property
study.
ii. Finance completed, with the assistance of the Financial Advisor, the bid
proposal to solicit banks for loans, as required by the IRS settlement, for the
2002a and 2006 FMLC bonds and potentially the SunTrust note. The RFP is
posted online.
iii. We expect to complete the electronic check scanning and deposit program
with First National Bank of South Miami by Thursday, June 16, 2011. This
will enable the City to make deposits timelier and reduce the administrative
time and the number of NSFs.
iv. Finance continues to prepare financial studies related to the City union
negotiations.
v. The Budget and Finance Committee were provided the budget workbooks and
the next scheduled meeting is scheduled for Thursday, June 16, 2011.
City Manager's Report to the Commission for June 14, 2011
c. Grants and Sustainable Initiatives:
FY 2011 Miami -Dade County Parking Fines Reimbursement Program
resulted in the reimbursement of $11,012 to improve ADA accessibility and
equal opportunity to qualified persons who have disabilities in the
municipality and to conduct disability public awareness programs.
i. The Florida Department of Transportation granted a 6 month extension for
Sunset Drive Phase IV road improvements from June 30, 2011 to December
31, 2011.
ii. Requested 3 month extension from Miami Dade County - Office of Capital
Improvements for Safe Neighborhood Parks grant to extend Dison Park
Project to September 30, 2011.
iii. Submitted letter to Miami Dade County requesting an extension to the Murray
Park Pool project and awaiting response (See Attachment F).
iv. Commenced inquiry into the application submission and utilization of funds
totaling approximately $150,000 by the Non - Violence Project USA, Inc. (See
Attachment G) The City received the grant application, the project
programmatic budget, and the audit report from the Children's Trust (See
Attachment G continuation). The document shows that the grant was awarded
for two criteria: 233 -Youth Development Programs and 544 -POWER
(Positive Outcome With Effective Results). The specified geographic area to
be served is Miami -Dade County Wide with specific mention of three CRA
areas. Specifically, City of Miami Beach CRA, City of Miami Omni CRA,
and City of Miami Southeastern Parkwest/Overtown CRA. The total
requested funding from the Children's Trust was $150,000. Under
partnerships table they listed YES Institute, Homestead Middle School,
Homestead Senior High School, Miami Edison Middle School, Miami Edison
Senior High School, Region VI Education and Transformation Office, and
The Division of Student Services and its TRUST Program. Conclusion: This
particular grant is designed for Miami -Dade County wide services with
specific services provided to the partners aforementioned. The City of South
Miami is not a direct beneficiary of the grant but it may have remote indirect
benefit to its citizens should they attend one of the partner programs.
Additionally, the City of South Miami is not mentioned. The Children's Trust
shows no other grants approximating the $150,000 to the Non - Violence
Project.

d. Central Services:
i. Murray Park Community Pool Operator RFP: Request for a twelve (12)
month extension on the CDBG grant funding for the pool project was
submitted and the City awaits response to the same. If said extension is
granted a new Pool Operator RFP will be slightly modified and reissued.
ii. Purchasing Ordinance: The City Attorney is reviewing the procedures
necessary for implementing the purchasing ordinance without conflict with
the City's charter and will advise so we can proceed accordingly.
iii. Landscaping RFP: A final draft RFP remains under review and once
approved it will be posted. Once confirmed, the pertinent dates will be
provided to Commission.
iv. Towing Services RFP: The City Attorney is in communication with Police
and the former Assistant City Attorney concerning the Towing Ordinance
and issues with the same. Once the ordinance is revised, the towing services
RFP based on the same will be prepared and issued. Again, once confirmed,
the pertinent dates will be provided to Commission.
V. Tennis Court Operator RFP: No change at this time.
vi. Insurance Broker RFP: Development of an insurance broker scope of work
commenced for the draft RFP. Once confirmed, the pertinent dates will be
provided to Commission.
e. Police:
Uniform Patrol Division
Total of 14 arrests: 6 felonies, 5 misdemeanors, 2 traffic and 1 warrant served
ii. Of those 14 arrests, 2 were narcotics related:
iii. The Patrol Unit with the assistance of the Criminal Investigations Unit and the
Miami Dade School Police Department enhanced police visibility in the area of the
South Miami Middle and Elementary Schools. The purpose was to ensure safety
and to detour criminal activity during the release of students on the final three days
of school. Officers were assigned to strategic areas around the schools as well as
along streets and in neighborhoods commonly used for students walking home. In
addition, officers were assigned to SW 60th St & 67h Av to assist with getting the
cars and buses out from in front of the schools on SW 6001 St in an expeditious
manner. During the three day operation, there were no reported incidents and no

unusual behavior or activity observed. Note: On Monday, June 13, 2011, a meeting
was held with Captain Horgan from the Miami Dade County Schools Police
Department regarding the future partnership that both departments will have for
next years school patrols especially at South Miami Middle School.
iv. On Friday June 17 "', members of the Uniform Patrol Division will conduct a
city wide DUI Saturation Patrol.
Criminal Investigation Division
i. On Thursday, 06 -02 -11 (wider case # 1101920) S.I.U. with the assistance of
G.I.U., and members of the Uniform Patrol Division conducted a controlled
buy /bust operation. A subject, whom we had intelligence on of being a
narcotics dealer, was contacted and asked if he would sell a specified amount
of illegal narcotics to a potential customer. The customer was a South Miami
undercover police detective. The subject showed up as scheduled and the
purchase /sale was performed. Before the subject could leave the area he was
detained and subsequently arrested. The subject was charged with felony
possession of illegal narcotics with intent to sell and possession of drug
paraphernalia. He sold the undercover operative, 24.7 grams of marijuana,
which has a street value of $270.00. A search of the subject's vehicle
revealed another 67.5 grams of marijuana (street value of $850.00), 1
psilocybin mushroom (street value $20.00), .09 grams of hashish (street
value of $10.00), a digital scale and numerous clear plastic baggies. All
contraband was impounded and is being held as evidence. The subject's
vehicle is a 2002 Volvo and was used by him to transport his narcotics as
well as where he made the sale from. Therefore, his vehicle was impounded
and is being held pending possible forfeiture.
ii. On Thursday, 06 -02 -11 the Criminal hwestigations Division (C.I.D.) with the
assistance of members of the Professional Compliance and the Uniform
Patrol Divisions conducted a special vehicle burglary detail. A total of six
police personnel were used in an undercover capacity (dressed in civilian
clothing and using civilian vehicles). This operation was conducted in
response to an increase in the amount of vehicle burglaries being experienced
Miami -Dade County wide. We concentrated our efforts in areas of our city
where we currently have open vehicle burglary investigations. The detail
was conducted after hours and ran for three hours from beginning to end. No
arrests were made. The SMPD was able to obtain quality intelligence on the
vehicle burglaries and other crimes for future operations. This is detail
number three of several to come.
iii. On Monday, 06 -06 -11 a South Miami Parking Violations Officer (P.V.O.)
discovered a vehicle parked in The South Miami Municipal Parking Garage.
A computer check of the vehicle tag revealed the tag to have a tow order for
unpaid parking citations. The P.V.O. was in the process of removing the
vehicle's tag. The owner of the vehicle responded and entered his vehicle.
The P.V.O. made eye contact with the vehicle owner and requested that he

wait a moment while he retrieved the fee amount that the vehicle owner
would need to pay in order to get his tag back. The owner of the vehicle
began to back his vehicle out, even though the P.V.O. was behind the
vehicle. After repeated requests from the P.V.O. to stop, the driver stepped
on the accelerator, speeding backward with no regard for the P.V.O.'s safety,
nearly striking him. The P.V.O. had to jump out of the vehicle's backward
path. The driver then fled the area. G.I.U. Detectives were assigned the case.
Armed with the vehicle tag, a computer check gave them the owner's
information. The Driver was arrested (under case # 110971) and charged
with a felony; Aggravated Assault with a Motor Vehicle on a Parking
Enforcement Officer.
iv. On Wednesday, 06 -08 -11 S.I.U. detectives assisted the Miami -Dade Police
Department's Narcotics Unit (under case # 1102004) in the arrest of a South
Miami property owner for possession of marijuana and for possession of a
firearm while committing a felony. Both offenses occurred in Un-
Incorporated Dade County and are being investigated by M.D.P.D. The
search of the subject's residence revealed one pound of marijuana, with a
street value of $2,500.00 and approximately 25 additional firearms. The
subject is allegedly a legitimate gun dealer. However, all weapons will be
computer checked. Miami -Dade Detectives will keep us posted of their
findings.
V. On Wednesday, 06 -08 -11 S.I.U. detectives working with D.E.A. and the
Hialeah Police Department, received information of possible marijuana grow
house. The residence was surrounded; a search warrant was requested and
granted. The search of the residence revealed 21 plants, weighing in at 192
lbs and had a street value of $768,000.00. No arrests were made, however
subjects are presently being sought.
vi. On Thursday, 06 -09 -11 (Confidential Case # 1101820) G.I.U. detectives
were assigned several cases involving juvenile on juvenile crimes such as
battery, bullying and even robbery. State law mandates that all cases
involving juveniles are to be kept confidential for their protection. It is our
duty and obligation to do just that. With that said, G.I.U. Detectives arrested
a juvenile for Battery and Attempted Strong -arm Robbery, without incident.
Parking Enforcement
i. The Parking Enforcement Unit issued a total of 1,212 citations from the time
period of June 6m thru June 12`h. Total fine amount for these citations:
$23,570.00.
ii. There was 1 citation issued for trucks unlawfully parked or willfully
obstructing traffic.

Code Enforcement Division:
Working in collaboration with the Building Department to process and
submit 2 additional abandoned homes tagged as "unsafe structures" to the
Miami -Dade County Unsafe Structures Board meeting scheduled for June 20,
2011. If the Board approves the demolition and the City subsequently funds
the project these blighted, unsafe structures will potentially be demolished in
July 2011.
ii. The dilapidated red fence on 71 & 65 Avenue was finally replaced with a
brand new fence.
iii. CE is reviewing, revising, and updating all operational forms to ensure that
staff has the proper tools to provide an effective and efficient level of service.
This is in line with the City Manager's and Chief's efforts to identify and
provide the tools necessary to improve the City's level of service to the
property and business owners.
iv. Responded to a citizen's nuisance complaint against the re- habilitation
homes located on 7311 & 7321 SW 63 Ct. Working in collaboration with
Police to address noise, littering, and loitering complaints. Code requested a
meeting with the property owner to review the State contract. Thus far, no
violations were observed.
CE is actively addressing the deteriorated wall on 64 Street and 62 Avenue
with the property owners.
vi. Carmen Baker, CE and Chris Brimo, P &Z met with Ross University
representatives to review the basis for the City's denial of the Certificate of
Use (CU) for PH -B & PH -M. Ross University agreed to reconfigure the non-
compliant use of PH -M to administrative offices; the CU denial appeal was
withdrawn. Pursuant to the Land Development Code, the re- configuration
should bring the requested use to a permitted use.
vii. Held a Special Magistrate pre - conference with the City to review Palmetto
Bugs VW Club's appeal.
viii. Thirteen (13) lien search requests were received and processed in a timely
manner. CE collected $1,290.00 in revenues for these requests.
ix. CE received and responded to 7 citizen complaints within 24 hours.
x. CE received, processed, and issued 11 new Business Tax Receipts (licenses)
and collected $2,566.47 in business tax revenue. The new BTR's are a direct
result of proactive field inspections.

xi. Attended the CM's meeting with the Building and Planning & Zoning
Department's to continue to review and streamline the internal processing of
permits and applications to ultimately codify the process system.
Accreditation
We are now at 83% complete with regards to the SMPD Policies. The Majors are working hard
on these policies. The Chief hopes to have this project completed by the end of the week if their
schedules allow it. If so, we can publish the policies this month and have them effective in
August 2011.

f. Human Resources:
The Human Resources Department successfully hired seven new Summer
Recreation Aides in coordination with the Parks & Recreation

Public Works position. We encourage all qualified candidates to apply.
iii. We have a continuous open announcement for participants in the Reserve
Police Officer Program. Certified law enforcement officers who are
interested in working with the South Miami Police Department are
encouraged to apply.
iv. We are in the interview process for the full -time Office Support position in
the Human Resources Office. We are looking forward to the selection of
the most qualified candidate to complete our team.

h. EAR Consultant for 2012: On April 18, 2011 the Planning and Zoning
Department received a signed contract from Henry Iler.
ii. Land Development Code Amendments: The Planning and Zoning Department
together with the Planning Board continued its program of updating the Code.
iii. Planning Board:
(A) Special Use Application:
(i) A Special Use Application was filed on April 8, 2011, by TD Gulfstream
Partners LP, represented by Ines Marrero - Priegues, Esq., to operate a Buffalo
Wild Wings Grill & Bar restaurant at the Shops at Sunset Place, 5701 SW 72
Street, (previous restaurant that occupied this location was Cheeseburger in
Paradise). On Tuesday, May 10, 2011, the Planning Board held an advertised
public hearing (quasi judicial) and is recommending approval. This item is
presented to the City Commission on June 14, 2011, (tonight) as a carryover from
the Last meeting.
iv. Environmental Review and Preservation Board (ERPB): On June 7, 2011, the first
regular meeting agenda of the month consisted of three items reviewed by the
ERPB. One item, ERPB -11 -036 was for an exterior renovation at South Miami
Hospital. The exterior impact is the removal of one window due to interior
renovations to create a new nursery on the third floor of the existing east tower at
SMH.
Currently, there are two (2) vacancies on the ERPB.
v. Historic Preservation Board: On April 4, 2011, the City Commission deferred
amendments to historic preservation provisions in the Land Development Code
and is now being forwarded to the Historic Preservation Board meeting on the
next regular meeting Monday, July 25, 2011. (FYI — As per LDC, no HPB
meeting on the month of June.
Currently, there are four (4) vacancies on the HPB.
A. Comprehensive Plan Amendments: Update
(A) Local Planning Agency:
(i) On Tuesday, May 24, 2011, a total of five (5) items listed below were
presented to the Local Planning Agency (LPA), LPA -11 -018 thru LPA -11 -022
and the results are noted in the attached spreadsheet below. Three items are
presented to the City Commission for first reading on June 14, 2011 (tonight),
except for the following two items that were deferred. The two (2) deferred
items, LPA -11 -018 and LPA -11 -020 are noted in the attached spreadsheet below
and will be restudied and presented to the Local Planning Agency (LPA) on June

21, 2011. These two items will be forwarded to the City Commission for first
reading on July 19, 2011.
vu. The following is a proposed schedule for completing the City's outstanding
comprehensive plan amendments listed in the attached spreadsheet.
Line items 11, 13 and 14 [LPA -11 -019, LPA -11 -021, LPA -11 -022] were
recommended to move forward to the City Commission for first
reading /transmittal hearing to the DCA. These items are on the Commission
agenda for June 14, 2011.
Line items 8 and 12 [LPA -11 -018 and LPA -11 -020] were recommended to be
deferred by the LPA and will be forward back to the LPA on June 21, 2011. Staff
anticipates these items will be on the Commission agenda for July 19, 2011.
i. Commission directives or issues:
a. Pension: Staff continues reviewing so as to align with negotiations.
b. Parking reform: No change in status.
c. Master Park Plan: No change in status.
d. Welcome to South Miami signs: (No change) Requesting from the
Commission for a COW or workshop so the design could be shown
and other ideas explored. Post the design discussion an engineering
firm would have to be hired and a cost analysis conducted.
e. Hiring project for South Miami residents with certain criminal
pasts: The City's HR Department is finalizing the position audits with
the assistance of the Department of Parks and Recreation. Once the
audit is finalized and approved the jobs will be posted for the required
one week period and the hiring process can commence.
f South Miami Hospital permits. The City Commission directed the
City Manager to provide all the permits issued to South Mianii
Hospital. See Attachment D for status of the permits.
g. Farmers Market financial reporting: See Attachment E.

requested assistance to address mosquito problems in the downtown area. Preliminary
eradication process began at First National Bank of South Miami. Other business
owners have been notified to call 311.
iii. Serviced / repaired (20) vehicles and heavy equipment at the Motor Pool.

Engineering and Construction Division
Sunset Drive Improvements Repairs: Due to a lack of progress by the contractor, a
chronological report was provided to the City Attorney for review and possible enforcement
action.
SW 66 th Street Improvements Phase II: No change since last report.
City Manager's Report to the Commission for June 1.4, 2011
SW 64th Street Sidewalk Repair Project & SW 66th Street Improvements Phase 1I: Earlier
today, the City received approval from Miami -Dade County's Department of Housing and
Community Development to proceed with public bidding. Bid documents are being prepared and
will be forwarded to Central Services for review.
SW 62nd Avenue Improvements (Miami -Dade County): Road improvements performed by
the Miami -Dade County designated contractor is progressing as scheduled. Permanent striping
work has commenced including on- street parking spaces along SW 68th Street and SW 69ffi
Street, The City has been informed that tree planting along this area has been tentatively
scheduled for July 2011.
Pump Station 177 upgrades: A pre - construction meeting was held between City Public Works
Department Staff, Water and Sewer Department and the Contractor that is to perform the
upgrades. Logistics and coordination matters were discussed as well as the construction
schedule for the completion of work. At this time, WASD representatives are indicating that the
project should take 8 months to complete. The approximate commencement start date is
scheduled to begin in August 2011.
ARRA Bus Shelters: Construction for the approved bus shelters continues. The concrete base
was constructed. The structure of the shelter is pending delivery by the manufacturer.
SW 64th Court Drainage: The project is currently out for bid. An addendum is being issued to
address the questions from the pre -bid meeting.
Pinecrest Villas: Public Works continues to receive survey responses. At this juncture, 85% are
in favor of the speed tables. Based on the responses received, the City submitted this
information to MDC Public Works Department with a request for approval.
Cocoplum Terrace: Miami Dade County initiated striping for on -street parking at SW 68th and
69th Street. Currently there are three spaces on the south side of SW 68t" Street, and three spaces
on the north side of SW 69h Street. The County's Public Works Department will be sending us
an updated pavement marking plan of the SW 62nd Avenue project that will include the
aforementioned streets.
Manor Lane: A status update request was submitted to MDC Public Works. The City submitted
the study report on 3/9/2011.
Mango Terrace: Pursuant to commission request, Public Works staff confirmed that an
Interlocal agreement was executed, approving the traffic calming devices recommended in the
study. A request for proposals for the design and permitting of this project was issued. The
selected consultant will be presented at the next commission meeting for approval.
Roadway Resurfacing and Sidewalk Repairs: A Pre -bid meeting is scheduled for June 15,
2011.
City Hall Sewer Connection: No change since last report.
MDC SW 57th Drainage Improvements: No Change since last report.
