(Hometown District - Overlay); and providing an effective date.
APPLICANT'S REQUEST:
Pursuant to Section 20- 3.4(B)(4)(b) of the Land Development Code (LDC) the applicant
is requesting a Special Use Approval to operate a proposed general restaurant referred to
as the "Buffalo Wild Wings Grill & Bar" at the above referenced location. The specific
location would be at Tenant Space #B -13A on the first floor of the Shops at Sunset Place
and formerly occupied by Cheeseburger in Paradise. The Shops at Sunset Place is
located in the "SR (HD -OV)," Specialty Retail Hometown Overlay Zoning District
identified on the ,City of South Miami Zoning Map. A restaurant use is allowed in the
Specialty Retail Hometown Overlay zoning district. The proposed general restaurant
included in this application requires Special Use Approval by the City Commission.
The proposed use must meet the requirements for special uses contained under Section
20- 3.4(B)(4)(b)General Restaurant and Section 20 -5.8 Special Use Approval of the LDC.
A general restaurant is defined as an establishment where the principal business is the
sale of food and beverages to the customer in a ready -to- consume state and where the
design or principal method of operation shall provide a sit -down area for the customers
and are normally provide with an individual menu and food and beverages are generally
served in non - disposable containers by a restaurant employee at the same table or counter
at which said items are consumed.

SPECIAL CONDITIONS APPLICABLE:
The Land Development Code provides that special uses must be approved by the City
Commission after a public hearing and receipt of a recommendation from the Planning
Board. The purpose of the required public hearing is to determine the compatibility of
the proposed use with the surrounding neighborhood. Special use applications are
required to comply with the requirements set forth in Section 20- 3.4(B)(4)(b). In the case
of a general restaurant the following supplemental requirements are listed:
(i) All such establishments shall provide only inside or patio service on private
property. Public streets, rights -of -way, sidewalks and required setbacks may
not be used for patio or street -side services of any kind. A separate
application for outdoor- seating would be required.
(ii) No services of a drive -in or of a fast food nature shall be permitted.
(iii) The city commission shall review and recommend approval, disapproval or
modification of all site plans and project specifications for this special use
permit.
The requested special use must also comply with the standard LDC conditional
requirements set forth in Section 20 -5.8 in that the use:
a) Will not adversely affect the health or safety of persons residing or working in
the vicinity of the proposed use,
b) Will not be detrimental to the public welfare or property or improvements in
the neighborhood; and,
(c) Complies with all other applicable Code provisions.
STAFF ANALYSIS:
(1) The zoning district "SR HD -OV," Specialty Retail Hometown Overlay Zoning
District according to 20- 3.4(B)(4)(b)General Restaurant and Section 20 -5.8 Special
Use Approval of the Land Development Code permits general restaurants after
Special Use Approval by the City Commission.
(2) On April 1, 1997, the City Commission approved Resolution No. 64- 97- 10035,
allocating the Shops at Sunset Place a total of 61,250 square feet of restaurant space,
attached copy.
(3) The proposed area of the restaurant is located in the first floor at Tenant Space B-
13A, which is at the northwest corner of Red Road and Sunset Circle, the internal
driveway of the Shops at Sunset Place. The tenant space was previously occupied by
another general restaurant by the name of Cheeseburger in Paradise.
(4) The proposed general restaurant will occupy a total of 7,395 sq. ft.

(5) The total 7,395 square footage of the proposed new restaurant will not result in the
Shops at Sunset Place exceeding the 1997 approve maximum allocation for
restaurant use of 61,250 square footage. The required parking for all restaurant use
was included in the initial approval of the Shops and based upon this analysis there
are no additional spaces required.
(6) The proposed general restaurant consists of an indoor space of 6,530 sq. ft. with 229
dining seats and an outdoor patio space of 865 sq. ft. with 53 outdoor patio seats, for
a total of 7,395 sq. ft. The maximum number of outdoor seats as per the LDC shall
not exceed 80% of the number of indoor seats, maximum allowed number of seats in
this outdoor patio are 183 seats. Therefore, based on this analysis the proposed 53
patio seats are in compliance.
(7) The proposed restaurant will not adversely affect the health or safety of persons
residing or working in the vicinity; and the proposed use will not be detrimental to
the public welfare or property or improvements in the neighborhood.
PLANNING BOARD ACTION:
The Planning Board at its May 10, 2011 meeting adopted a motion by a vote of 6 ayes 0
nays recommending approval with conditions of the special use request.
RECOMMENDATION:
It is recommended that the subject application be approved with the following conditions:
(1) All signage for the new establishment is subject to approval by the Environmental
Review and Preservation Board (ERPB); external signage for the new establishment
is limited in size and location to the existing signage for the previous occupant of
spaces.
(2) Any and all exterior renovations or modifications for the new establishment is subject
to approval by the ERPB.
(3) Adhere to the Special Conditions applicable in Section 20- 3.4(B)(4)(b)General
Restaurant and Section 20 -5.8 Special Use Approval of the Land Development Code,
listed.
(4) A separate application for outdoor dining would be required as per Section 20-
3.3(E)(2) Outdoor Seating / Dining for all commercial Properties, of the Land
Development Code.

(5) If the subject general restaurant is determined by the Planning and Zoning Director in
the future, to be adversely affecting the health or safety of persons residing or
working in the vicinity of the proposed use, or to be detrimental to the public welfare
or property or improvements in the neighborhood, or not be in compliance with other
applicable Code provisions, the special use approval may be modified or revoked by
the City Commission upon notification and a public hearing.

RESOLUTION NO.
A Resolution of the Mayor and City Commission of the City of South Miami, Florida,
relating to a request pursuant to Section 20- 3.4(11)(4)(b) of the Land Development Code for

WHEREAS, TD Gulfstream Partners, LLC., has filed Application No. PH- 11 -012 requesting
Special Use Approval to allow for a Buffalo Wild Wings Grill & Bar restaurant to be located at 5701
Sunset Drive, at Space # B -13A on the first level of the Shops at Sunset Place, in the in the "SR(HD-
OV)" Specialty Retail Hometown District Overlay zoning district; and
WHEREAS, a Buffalo Wild Wings Grill & Bar restaurant is allowed as a special use in the
"SR(HD -OV)" Specialty Retail Hometown District Overlay zoning district subject to meeting special
requirements set forth in Section 20- 3.4(B)(4)(b) of the Land Development Code and subject to meeting
general conditions specified in Section 20 -5.8 of the Land Development Code; and
WHEREAS, the approval of a special use requires a recommendation from the Planning Board
and the approval of the City Commission after a public hearing; and
WHEREAS, at its May 10, 2011 meeting the Planning Board, after public hearing, voted 6 ayes
0 nays to recommend approval with conditions of the special use request; and
WHEREAS, the Mayor and City Commission of the City of South Miami desire to accept the
recommendation of the Planning Board.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION
OF THE CITY OF SOUTH MIAMI, FLORIDA:
Section 1: The applicant, TD Gulfstream Partners, LLC., submitted an application for special use
approval to allow for a general restaurant referred to as the Buffalo Wild Wings Grill & Bar restaurant to
be located at 5701 Sunset Drive, at Space # B -13A on the first level of the Shops at Sunset Place, in the
"SR(HD -OV)" Specialty Retail Hometown District Overlay zoning district is hereby approved subject to
the following terns and conditions as well as all applicable City ordinances, codes, rules and regulations:
(1) All signage for the new establishment is subject to approval by the Environmental
Review and Preservation Board (ERPB); external signage for the new establishment is
limited in size and location to the existing signage for the previous occupant of spaces.
(2) Any and all exterior renovations or modifications for the new establishment is subject to
approval by the ERPB.

Section 2: The applicant agrees to submit an employment and training plan which provides for the City of
South Miami residents to have a priority in obtaining jobs at the business.

City of South Miami Ordinance No. 08 -06 -1876 requires all lobbyists before engaging in any lobbying
activities to register with the City Clerk and pay an annual fee of $500 per Ordinance No. 44 -08 -1979. This
applies to all persons who are retained (whether paid or not) to represent a business entity or organization to
influence "City" action. "City" action is broadly described to include the ranking and selection of
professional consultants, and virtually all- legislative, quasi - judicial and administrative action.

Mrs. Lourdes Cabrera explained that the request is for special use of approval, governed under
the Land Development Code section 20- 3.4(B)(4)D. The new owners are taking over where
Cheeseburger and Paradise used to be located. The proposed location is a first floor, 10 -13-13A
off of 57`" Avenue.
The shops in the area are located within the Specialty Retail Hometown Overlay zoning district.
These Shops at Sunset Place are also governed under an approval of resolution 64 -97- 10035,
which was approved by the City Commission in April 1, 1997. It allowed 61,250 square feet of
restaurant space. Copy of resolution is attached for reference.
The restaurant is only allowed 80% of the number of seats outside of what is allowed to in the
interior. The restaurant is governed under section 23 -4b4, it also must comply with section 20-
5.8 that has additional requirements, which are:
i. The restaurant must comply and will not adversely affect the health or safety of
persons residing or working in the vicinity of the proposed use.
ii. The restaurant will not be detrimental to the public welfare or properties or
improvements in the neighborhood and complies with other applicable codes
provisions.
Staff recommends approval with the following conditions:
• Exterior signage is subject to the approval of the Environmental Review and Preservation
Board. (ERPB)
• Any or all exterior modification or renovations are subject to ERPB's approval.
They must adhere to special conditions applicable in the following sections:
• Section 20- 3.4134D - General restaurant,
• Section 20 -5.8 - Special use approval of the land development code,
• Section 20 -3.3E2 - Outdoors dining and seating floor for commercial property is
required.
• If subject "General Restaurant" is determined by Planning and Zoning Director in the
future not to be in compliance with modification and renovation, or will affect the health
and safety, will be detrimental to public, or could not be in compliance with code
provision the special use approval will be modified or revoked by the City Commission
upon notification and public hearing.
Mr. Whitman inquired to Mr. Pepe about swearing for anyone giving testimonies.
Ms. Marrero, attorney for the applicants, introduced herself and gave a brief plan and the future
plans of the new establishment including what it will bring to the neighborhood. She further gave
a brief presentation of the new establishment showing its location, seat arrangements, etc.
Mr. Whitman called for questions from either Board/Staff or owners.
Mrs. Yanoshik inquired about who is responsible for the exterior maintenance. She gave a list
questionable buildings and sites in the location to be taken in consideration. She talked about the
inconsistency in the exterior maintenance such as debris, junk in vacant spaces, broken down

escalator and exterior views. She also explained about some buildings that have been in that
condition since 2005 and wanted to know about their action plan on the issue.
Mr. Cadamson approached the stand, was sworn in by Mr. Pepe and responded to Mrs.
Yanoshik's question saying it was an operational matter. Its a process in stages and he will look
into it.
Mr. Dundorf asked Mr. Cadamson as to how long he has been managing shops in the area.
Mr. Cadamson—answered over 10 years. Mr. Dundorf further asked about the master
plan/direction of the business and how the board could help.
Mr. DeKanter took over from Mr. Cadamson after being sworn in and gave a brief idea of the
operation of the future restaurant as family friendly, TV sports bar -sit down restaurant. The
establishment will have affordable food cost and it will also be a fun and safe environment. He
assured that it will not be a drive through or an after hours bar.
He will be involved in fundraisers for schools, and the community.
Mr. Dundorf asked about interior space and what portion will be outer seating.
Mr. DeKanter referred to the brief summary of floor plan and explained about the seating
arrangement.

Mrs. McCain stated to the board that she supports the launch of the new establishment.
She further explained that she is aware of the franchise (Buffalo Wings) and that especially since
the food is affordable cost. She also expressed her concerns on the problem issue of loading and
unloading in the neighborhood and the interference with traffic. She concluded by supporting
Mrs. Yanoshik's concerns about exterior maintenance in buildings.

Mrs. Beckman asked the staff about the how the parking is broken down.
Mrs. Cabrera responded that it is all broken down depending on the square footage. The
breakdown and the ratio is I parking space per 100 square feet. Mrs. Beckman, it was confirmed
by Mrs. Lourdes Cabrera that the new establishment has that requirement. Mrs. Lourdes Cabrera
further explained that the outdoor is calculated by 80% seat of the indoor seats. There are
additional guidelines in code section 20 -3.3 that they would also need a separate outdoor dinning
application and there is fee for every application.
Mrs. Beckman further expressed her concerns on the traffic flow in the area and was assured by
Mrs. Cabrera that the traffic problem is not an issue as this is a contained area and there is no
additional traffic flow.
Mrs. Beckman inquired about the balance of "retail v/s restaurant" space.
Mr. Vitalini clarified the question that the total number of square feet for the entire shop area
was what Mrs. Beckman was asking.
- Mrs. Cabrera explained it was all part of the mall during its designed and approval:
The representative for the establishment answered that the ratio is 61 under 40,000.

Mrs. Beckman asked about the price affordability and the owner assured her that the prices are
really affordable, lunch $8 -$10 and dinner less than $16. She further asked about the programs, .
if any, that the new establishment will bring to the City such as jobs.
Mr. DeKanter said he will start with 150 -175 employees then as business will get steady, will
have 60 -90 full time steady employees. He will employ locals up to 15 miles out. As the initial
planning continues he will provide further updates.
Mr. Dundorf asked when the new establishment is proposing to launch, Mr. DeKanter said he is
shooting for September 2011. Mr. Dundorf referred his second question from the presentation
regarding the windows on Red Road and was assured that it will remain a window area.

Shops at Sunset Place exceeding the 1997 approve maximum allocation for
restaurant use of 61,250 square footage. The required parking for all restaurant use
was included in the initial approval of the Shops and based upon this analysis there
are no additional spaces required.
(6) Tile proposed general restaurant consists of an indoor space of 6,530 sq. ft. with 229
dining seats and an outdoor patio space of 865 sq. ft. with 53 outdoor patio seats, for
a total of 7,395 sq. ft. 'file maximum number of outdoor seats as per the LDC shall
not exceed 80% of the number of indoor seats, maximum allowed number of seats in
this outdoor patio are 183 seats. Therefore, based on this analysis the proposed 53
patio seats are in compliance.
(7) The proposed restaurant will not adversely affect the health or safety of persons
residing or working in the vicinity; and the proposed use will not be detrimental to
the public welfare or property or improvements in the neighborhood.
RECOMMENDATION
it is reconunended that the subject application be approved with the following conditions:
(1) All signage for the new establishment is subject to approval by the Environmental
Review and Preservation Board (ERPB); external signage for the new establishment
is limited in size and location to the existing signage for the previous occupant of
spaces.
(2) Any and all exterior renovations or modifications for the new establishment is subject
to approval by line ERPB.
(3) Adhere to the Special Conditions applicable in Section 20- 3.4(B)(4)(b)General
Restaurant and Section 20 -5.8 Special Use Approval of the Land Development Code,
listed.
(4) A separate application for outdoor dining would be required as per Section 20-
3.3(E)(2) Outdoor Seating / Dining for all commercial Properties, of the Land
Development Code.
(5) if the subject general restaurant is determined by tine Planning and Zoning Director in
the future, to be adversely affecting the health or safety of persons residing or
working in the vicinity of the proposed use, or to be detrimental to the public welfare
or property or improvements hi tine neighborhood, or not be in compliance with other
applicable Code provisions, tite special use approval may be modified or revoked by
the City Commission upon notification and a public hearing.

9619, PROVIDING FINDINGS OF FACT, CONCLUSIONS OF
LAW AND AN ORDER; PROVIDING AN EFFECTIVE DATE.
WHEREAS, the Mayor and the City Commission of South Miami
previously approved a Special Exception by Resolution No. 70 -95-
9619, as amended by Resolution No. 164- 95-9713 and Resolution No.
165 -96 -993.9 (jointly the "Special Exception "), for a project known
as the Bakery Centre redevelopment; and
WHEREAS, Bakery Associates, Ltd. has applied for a
modification of the Special Exception to replace up to 14,250
square feet of retail space with up to 14,250 square feet of
restaurant space.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA:
Section 1. Findings of Fact Conclusions of Law and Order.
1. The recitals in the Whereas clauses are incorporated into
and made a part- of these findings of fact.
2. The developer, of the Bakery Centre project shall have the
option, at its determination, of constructing tupaltof 61,250
additional square feet of restaurant space, up to a
square feet of restaurant space at the development,provided that
for each additional square foot of restaurant space constructed at
the project, the exact amount of approved retail space in the
project shall be reduced from the present total of 350,460 square
feet to not less than 336,210 square feet.
EXHIBIT "A"
3. Based on the application for amendment to the Special
Exception and the representations of the applicant at the public
hearing, the applicant has satisfied its burden of demonstrating
that
a. The Bakery Centre redevelopment, as modified, will
continue to contribute to, promote and encourage the
improvement of the Hometown District and catalyze other
development as envisioned in the Hometown District
regulations.
b. The proposed redevelopment is still compatible with
the land uses and development intensities prescribed by all
applicable city regulations.
C. The proposed modification to the Special Exception
is compatible with the design criteria established for the
Hometown District and with the overall image of the City.
d. The proposed modification does not impair the
effective management of traffic, parking, lighting, noise and
waste generated by the development, nor does said modification
create adverse impacts on public facilities and services.
e. The proposed modification does not expand the
permitted uses within the Hometown District.
f. The proposed modification will not have an
unfavorable effect on the economy of the City of South Miami.
g. The proposed modification, when considered
cumulatively with other development, both present and future,
within the Hometown District, will not create excessive
overcrowding or concentration of peopla or population.
4. Accordingly, pursuant to subsection 31 of Resolution No.
75 -95 -9619, the request to amend the Special Exception to allow the
modified plan of development is approved.
5. Resolution No. 70 -95 -9619, as amended by Resolution No.
164 -95 -9713, Resolution No. 165 -96 -9919 and by this Resolution,
shall remain in full force and effect.
Section 2. Severability .
if any phase, clause, sentence, paragraph or section of this
Resolution shall be declared unconstitutional or is otherwise held
invalid by a court of competent jurisdiction, the determination
shall not affect the remaining phases, clauses, sentences,
paragraphs and sections of this Resolution.

This letter of intent accompanies the application by TD Gulfstream Partners, LLC for a
Special Use approval for a Buffalo Wild Wings Grill & Bar restaurant at Space # B -13A on the
first level of The Shops at Sunset Place center, which shopping center is located at 5701 Sunset
Drive. This request is being filed with the authorization of Bakery Associates, Ltd., a Florida
limited partnership and Simon Property Group, L.P. its general partner, as owners of The Shops
at Sunset Place.
As you know, The Shops at Sunset Place retail center is zoned "SR" Specialty Retail in the
City's Zoning Map. According to Sections 20 -3.3 and 20- 3.4(4)b of the Land Development
Regulations ( "LDRs ") of the City of South Miami, general restaurants are permitted in the SR
District after Special Use approval,
This application respectfiilly requests a Special Use approval for a 7,395 total square foot
restaurant on the first level of the retail center on that portion located along S.W. 57' Avenue
( "Red Road ") and Sunset Circle, the internal driveway of the center. Specifically, the restaurant
proposes 229 indoor dining seats within 6,530 square feet of interior space and 53 outdoor patio

seats in the existing 865 square foot patio area located entirely within the retail center's private
property, as required by Section 20- 3.4(4)(b) i, The restaurant will not include any drive - through
service as required by Section 20- 3.4(4)(b) ii.
The Buffalo Wild Wings Grill & Bar restaurant is proposed at the location previously
occupied by the Cheeseburger in Paradise restaurant. Because that restaurant closed in 2009,
more than two years ago, a new Special Use approval for a restaurant at the exact location is
required by the City's Land Development Regulations.
This new restaurant for the location, Buffalo Wild Wings Grill & Bar, is a national
restaurant featuring Buffalo, NY -style wings and sports bar menu selections in a casual
environment surrounded by big screen televisions. This franchise is the I 01 largest growing
restaurant franchise in the United States. The restaurant's signature item is Buffalo, NY- style
wings, but the menu includes popular sports bar fare including burgers, sandwiches and salads.
Copies of the restaurant's menu are included with this submittal.
The proposed hours of operation for the restaurant are 11:00 a.m. to 12:00 midnight on
Sundays through Thursdays; and 11:00 a.m. until 2:00 a.m. on Fridays and Saturdays. All solid
waste and trash removal takes place after the retail center closes. The retail center has
established loading areas and garbage dumpsters that will serve the restaurant.
