8 The City Commission of the City of South Miami, Florida met
9 in special session on Tuesday, September 28, 2010, beginning at
10 7:45 p.m., in the City Commission Chambers, 6130 Sunset Drive.

12 A. Roll Call:
13 The following members of the City Commission were present:
14 Mayor Philip K. Stoddard, Ph.D, Vice Mayor Valerie Newman and
15 Commissioners Velma Palmer, Ph.D, Brian D. Beasley and Walter A.
16 Harris.

18 Also in attendance were: City Manager Hector Mirabile, Ph.D,
19 Deputy City Attorney Mark A. Goldstein and City Clerk Maria M.
20 Menendez.

29 Dr. Mirabile conducted a presentation for the FY 2010 -2011
30 budget. (See presentation information attached)

32 During his presentation, Dr. Mirabile referred to the
33 direction given to staff by the Commission at the first budget
34 hearing to lower the millage rate even further. He said that
35 after given consideration to this request he realized that this
36 would potentially place the City at a risk factor because of
37 certain mediating concepts, such as: existing employment
38 lawsuits; City parking garage refinancing; bargaining agreement
39 negotiations; annual property reassessment; Murray Park pool
40 operations; the cost of pension reform.

4 1. An Ordinance of the Mayor and City Commission of the
5 City of South Miami, Florida, levying the millage of
6 4.9526 which is 3.74% lower than the rollback rate of
7 5.1452 and resulting in 0.00% change in property tax
8 rate in the City of South Miami, Florida, for the
9 fiscal year 2010/2011; providing for severability,
10 ordinances in conflict and an effective date. 3/5

13 Moved by Commissioner Beasley, seconded by Mayor Stoddard to
14 approve this item.

16 At this time the public hearing was opened.

18 Sharon McCain asked for clarification regarding the HR
19 classification and the increase in salary for the department; she
20 said that she did not understand the need for a larger HR
21 Department for such a small city; regarding the CIP and traffic
22 calming, indicating that the work at Pinecrest Villas is
23 scheduled to start in two more years and that the neighbors did
24 not expect to have to wait for so long; she then said that the
25 $100,000 for the Farmers' Market should be left in the CRA.

27 A Pinecrest Villas resident said that they urgently need
28 traffic tables on SW 78 and SW 76 streets, between 59th and 62nd
29 avenues.

31 Yvonne Beckman concurred with Ms. McCain against the
32 increase in the HR Department; she said that the Police
33 forfeiture funds may be used to keep kids off the street and
34 engage them in government and in the Farmers' Market.

36 Brad Cassel urged the City Manager to consider giving
37 priority to the highly needed traffic calming projects for
38 Pinecrest Villas over the ones remaining for Mango Terrace.

40 With no further speakers the public hearing was closed.

42 Vice Mayor Newman asked whether the traffic calming projects
43 could be moved around, the response from the Finance Director was
44 that they could be moved around. The Vice Mayor then said that
45 she did not feel comfortable voting for $100,000 for the Farmers'
46 Market.

1 Dr. Mirabile said that the $100,000 line item for the
2 Farmers' Market will be pulled as per the direction of the
3 majority of the Commission.

5 Vice Mayor Newman said that her position is that any money
6 over $3.3 million is going back to the taxpayers next year.

8 Mayor Stoddard referred to all the requests from residents
9 about the need for traffic calming on SW 62nd Avenue and SW 42nd
10 Street, as well as some parts of SW 80th Street, asking staff to
11 look into it so that it is taken care of as soon as possible. He
12 then referred to the opposition expressed by some speakers
13 regarding the budget increase in the HR Department. Dr. Mirabile
14 explained that by having a labor attorney heading that department
15 could save the City money since that person can help with the
16 research and the preparation of legal opinions and then submit it
17 to the City Attorney for review and approval.

19 Commissioner Palmer asked the City Manager whether there
20 will be a need for a labor attorney next year. Dr. Mirabile said
21 that you can never totally take out the labor attorney external
22 consultant.

24 Commissioner Harris asked why maintenance is going up so
25 much when we keep buying new equipment. Mr. Riverol explained
26 that maintenance equipment includes the expenditure that used to
27 be in MIS to run the software for the Police and that is the
28 reason for the dramatic increase.

31 passed by a 5 -0 vote:

47 Moved by Commissioners Beasley, seconded by Mayor Stoddard
48 to approve this item.

Sharon McCain addressed the Commission opposing to the
countdown method of timing speakers.
Yvonne Beckman again expressed opposition to the budget
increase in the HR Department.
With no further speakers the public hearing was closed.
With some further comments, the motion to approve this item
passed by a 5 -0 vote:
