221 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 Ordinance No. An Ordinance of the Mayor and City Commission of the City of South Miami, Florida, amending the City Code by creating Sec. 2 -8.1 to authorize the use of cooperative purchasing to acquire goods and services required by the City; Providing for conflict and an effective date. Whereas, cooperative purchasing allows vendors to take advantage of economies of scale and offer lower pricing than might be available to a single government entity, and Whereas, utilizing cooperative purchasing to acquire goods or services provides the City with the ability to immediately purchase from existing contracts of other government entities and alleviates the need to obtain bids and/or proposals which can require numerous hours of labor and delay the purchasing process, and Whereas, cooperative purchasing gives the City access to the evaluations of technical experts of larger government entities, with support from their technical, financial and legal experts. Now, therefore, be it Ordained by the Mayor and City Commission of the City of South Miami, Florida: 19 Section 1. New Section 2 -8.1 of the City Code is created to read: 20 21 22 23 24 25 Sec. 2 -8.1. Cooperative purchases. Unless prohibited by Florida Statutes the City may purchase any goods or services under contract with the federal state county, municipal school board or any other governmental agency or political subdivision providing the vendor extends the same price, terms and conditions of the contract to the City and provided Yhat the original contract was established by an open and competitive procurement process. If any word, phrase, clause, section or subsection of this Ordinance is 2 ruled invalid or unconstitutional by a court of competent jurisdiction, the invalidity thereof shall 3 not affect the validity of the remaining portions of this Ordinance. 4 Section 3. All sections or parts of sections of the City's Code of Ordinances, or 5 Resolutions that conflict with this Ordinance are repealed, but only to the extent of the conflict. 6 Section 4.
