SUMMARY OF REQUEST The subject application PB -10 -019 is a Comprehensive Plan Future Land Use Map amendment initiated by the City (Local Planning Agency) as a small scale Future Land Use Map amendment. The City owned property consists of eight lots constituting three vacant parcels which are part of the Murray Park Community Center site. The property is located at the southwest corner of the Community Center site. The city has determined that the property will be the location of a new swimming pool and related facilities in the near future. An RFP soliciting professional design expertise has now been published. COMPREHENSIVE PLAN AMENDMENT: GENERAL INFORMATION A change in the Comprehensive Plan Future Land Use Map can be initiated by a property owner, the Local Planning Agency and the City Commission. An amendment to the City's Comprehensive Plan Document or the Future Land Use Map requires the adoption of an ordinance by the City Commission after receiving a recommendation from the City's Local Planning Agency (Planning Board). Following adoption of the application by the City Commission, (second reading of the ordinance) the application package is 2 then submitted to the Florida Department of Community Affairs (DCA). This amendment qualifies as a small -scale amendment and therefore DCA will not review or comment upon the application unless a compliance protest is filed within a specified time period. The review process for a Comprehensive Plan Future Land Use Map amendment differs from the process used to review zoning district changes, variances, and site plans. A future land use map amendment review is concerned with the following basic issues: 1) compatibility of the proposed use with surrounding uses; 2) compatibility of the proposed density and height to the limits contained in the Plan and to the immediate neighborhood; 3) impact of the proposed use on the City's infrastructure; and 4) is the amendment compatible with and does it advance the City's objectives and policies contained in the Comprehensive Plan, RECENT HISTORY OF THE SITE The City purchased the subject property prior to 1980 and it was made part of the Murray Park Community Center. The 2001 plans for the Community Center show the property being used as part of the baseball field. PROPOSED AMENDMENT REVIEW A small scale Future Land Use Map Amendment is required to change the designation of Mixed -Use Commercial Residential (Four Story) to the same Future Land Use Map Category as the Community Center which is Parks and Open Space. Compatibility of Density/Height: The property size is 0.67 acres (29,400 sq. ft.) The existing land use map category and the existing zoning district would allow for commercial and office buildings to be built if the property was available for development. The proposed future land use map category will allow only park and recreational uses. 3 3. Impact on Public Facilities: An important element of a future land use map amendment is to assess the impact of the change on the public infrastructure serving the site. For purposes of this report, presented below is a summary of the projected impact of the proposed land use map category on public facility capacity. a) Park/Recreation Facilities Increases acreage in the park and open space category. Positive impact b) Schools No impact. c) Solid Waste No impact. Wastewater (Sewer) Will require County approval for sewer connection Additional GPD (to be determined when pool size is known) d) Potable Water Will require County approval for water connection Additional GPD (to be determined when pool size is known) e) Traffic /Streets Will impact traffic and off street parking spaces Traffic and use data will determine extent (to be determined when pool size is known) 4. Compatible with Comprehensive Plan. A proposed Future Land Use Map Amendment should be compatible with and advance the goals and policies contained in the City's Comprehensive Plan. The proposed amendment is consistent with and supports the following goals and policies: RECREATION AND OPEN SPACE ELEMENT Goal 1 To ensure the availability of adequate park facilities and open space for citizens of South Miami. Policy 1.1.1 Retain the existing park acreage and facilities, thereby providing level of service standard of 4 acres per 1, 000 population. LAND USE ELEMENT Goal 1 To maintain and improve the City's neighborhoods, and the quality of life of existing and future residents. Objective 1.1 The City shall implement its Future Land Use Plan Map through its land development regulations. Uses that are inconsistent with Ell community character as set forth on the Future Land Use Map shall be eliminated....... Policy 1.1.2 In reviewing proposed amendments to this plan and the Zoning Map, compatibility with adjacent uses shall be the major determinant. FUTURE REZONING The approval of the proposed Future Land Use Map amendment is a pre- requisite for a future zoning district change, which will implement the Future Land Use Category. The current zoning district of "LO" Light- Intensity Office will need to be changed to the "PR ", Parks and Recreation Zoning District. STAFF OBSERVATIONS 1. The proposed amendment is consistent with the goals and policies of the City's Comprehensive Plan by adding open space acreage required to maintain the required level of service standard. 2. The amendment is needed in order to accurately reflect the use of the property on the City's official Future Land Use Map. 3. The use of the property is compatible with abutting land uses. 4. The proposed land use map category change will have a positive impact on Parks/ Recreational Facilities and no impact on schools or solid waste. The land use change and the pool development will impact potable water, traffic, and sewers to a degree to be determined when the pool size is known. PLANNING BOARD ACTION The Local Planning Agency at its August 10, 2010 meeting after a public hearing adopted a motion by the vote of 7 ayes 0 nays recommending approval the subject Future Land Use Map amendment RECOMMENDATION It is recommended that the proposed change of Comprehensive Plan Future Land Use Map category designation of Mixed -Use Commercial Residential (Four Story) for the pool area of the Community Center located at 5800 SW 66th Street to the "Parks and Open Space" category be approved. Action: Mrs. Yates read the item into the record. Mr. Youkilis stated that the item is another change of Land Use Category. He commented these three parcels are currently assigned the Land Use Category of Mixed -Use Commercial Residential that is the same category that is in the downtown area. This was done in 1997; the three lots are part of the Murray Park center. The vacant lots were made part of the community center many years ago however, the zoning and the Land Use was never adjusted. As of this moment, there is a commitment by the city to place a swimming pool in that area. The city is seeking money and it would not be appropriate for the pool to be located in a Mixed -Use Commercial Residential Land Use district. This area should be changed to Parks and Open Space. There is some impact on water, sewers and solid waste to be determined. The change will increase the acreage in the park and open space category. It will require county approval for sewer connection. Potable water will be determined when pool size is known. The change will impact traffic and off street parking spaces but the impact will be determined when the pool size is known. Staff recommends approval to allow the proposed change of Comprehensive Plan Future Land Use Map Category to the Parks and Open Space category. Mrs. Yates questioned this will come back to the Board for re- zoning at a future date. Mr. Youkilis responded yes. The Chair opened the public hearing. NAME ADDRESS SUPPORT /OPPOSE PROJECT Sharon McCain 7502 SW 58 Avenue Oppose Ms. McCain commented that there is a time and place for everything. The location of the pool has not been determined, it has not been voted on unanimously, and there is no maintenance cost or funding for the pool. There is no rush and a final decision should be made once the funds are in order before a decision is made. The Chair closed the public hearing.
