An Ordinance of the Mayor and City Commission of the City of South Miami, Florida, relating to
an amendment to the South Miami Code of Ordinances Section 15C -1 entitled "Valet Parking
Permits for Use of Public Property" in order to remove a provision in Sec. 15C- 1(2)(b) which sets
forth a specific rental fee for use of public on- street curbside spaces; the rental fee to be placed in
the City's Permit Fee Schedule; providing for severability; providing for ordinances in conflict; and
providing an effective date.
BACKGROUND
The City maintains a Permit Fee Schedule Ordinance which sets forth user fees for municipal services.
The Permit Fee Schedule is now set forth in Ordinance No.44 -08 -1979 and is updated periodically in
order to keep fees current. It is also City policy to remove fees from the Land Development Code and City
Code and place them in the Permit Fee Schedule. Locating all municipal fees in one document will allow
adjustments to be made on a more regular basis and will be helpful to citizens and City personnel in
determining correct fees.
City Code (LDC) Section. 15C- 1(2)(b) entitled "Rental fees for Public on /street curbside spaces" sets
forth a fee for the use of on- street metered parking spaces used for the ramping area as part of a valet
parking operation. This fee will be placed in the Permit Fee Schedule Ordinance, once it is removed from
the City Code.
RECOMMENDATION
It is recommended that the attached draft ordinance be adopted on first reading.

23 NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND THE CITY
24 COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA:

26 Section 1. That Section 15C -1 (2)(b) entitled "Valet Parking Permits for Use of Public
27 Property" as set forth below is hereby amended as follows:

31 (2) Rental and Operation of Municipal Parking Spaces

33 (a) Rental of Public Spaces for Ramping.

35 (b) Rental Fees for Public OnlStreet curbside spaces. The fee for use of rented
36 spaces shall be . set forth in
37 the City's Permit Fee Schedule ordinance. Fees shall be paid in advance on a monthly
38 basis, commencing on the date the locations are rented to the valet operator by the City.
39 Advanced payment for meter rentals shall not be made for a period exceeding one month.
40 All additions or changes to existing leased public on- street/curbside parking spaces for
41 ramping, shall be paid upon request. All valet space lease requests shall be required in
42 writing to the City Manager or his/her designee, twenty -four hours in advance, and
43 received no later than 3:00 P.M., daily. Exceptions and lease cancellations not made within
44 the prescribed period will be assessed a $20.00 processing fee. The rental fee structure will
45 be reviewed and may be adjusted periodically by the city.

47 Section 2. All ordinances or parts of ordinances in conflict with the provisions of this
48 ordinance are hereby repealed.

Section 3. If any section, clause, sentence, or phrase of this ordinance is for any reason
held invalid or unconstitutional by a court of competent jurisdiction, this holding shall not
affect the validity of the remaining portions of this ordinance.
Section 4. This ordinance shall be effective immediately after the adoption hereof.
