A Resolution of the Mayor and City Commission of the City of South Miami, relating to a request

providing for an effective date.
APPLICANT'S REQUEST
Pursuant to Section 20- 3.3(D) of the Land Development Code (LDC) the applicant, American Car
Detailing, is requesting Special Use Approval to operate a mobile car wash in the parking garage of Plaza
57, an office building at the above referenced location. The proposed use is within the "SR(HD -OV)"
Specialty Retail (Hometown District Overlay) which allows Mobile Automobile Wasb/Wax Service if
approved through the special use process. The LDC provides that special uses must be approved by the City
Commission after a public hearing and receipt of a recommendation from the Planning Board.
STAFF OBSERVATIONS:
(1) The proposed car wash will be located on the ground floor of the parking garage in an area that was
reserved for a future bank drive thru - teller operation. The car wash will not occupy any space that was
reserved for required parking. Attached is a copy of the ground floor site plan (Exhibit "A ") indicating the
location of the car wash operation. There is no required parking for the car wash use.
(2) A mobile automobile wash/wax service is a special use which has special requirements (pre -set
conditions) listed in LDC Section 20- 3.4(B)(20). These conditions limit the location of the service, the
hours of operation, signage, and require certain environmental controls. Attached is a copy of the pre -set
requirements listed in the LDC.
(3) Special condition Sec. 20- 3.4(B)(22)(e) limits hours of operation to two hours a day, two days a week
at one location; however, an exemption to this limitation is allowed for mobile service vendors located
within approved parking structures. The subject applicant qualifies for this exemption.
(4) The applicant has submitted the car wash lease agreement with the property owner (7300 Investments,
LLC) of 7301 SW 57 Court.
(5) The City Commission at its February 4, 2003 approved by Resolution No. 17- 03- 11566, a similar car
wash service which has been operating to date in the parking garage at the Shops at Sunset Place.

PLANNING BOARD ACTION:
The Planning Board at its July 13, 2010 meeting adopted a motion by a vote of 5 ayes 1 nay (Ms.
Beckman) recommending approval of the special use mobile car wash with three conditions.
RECOMMENDATION
The requested special use is recommended for approval with the following supplemental conditions:
1) This approval is valid for American Car Detailing, the designated tenant, subcontracted to provide
carwash services. At any time in the future that the tenant shall change, the new tenant shall agree to
these conditions of approval as a requirement for obtaining an occupational license for this location;
2) Car washing shall only occur in the designated car wash area on the ground floor;
3) If the subject car wash is, in the future, determined by the Director of Planning, to be adversely
affecting the health or safety of persons residing or working in the vicinity of the proposed use, to be
detrimental to the public welfare or property or improvements in the neighborhood, or to be not in
compliance with other applicable Code provisions, the special use approval may be modified or
revoked by the City Commission upon notification and public hearing.

WHEREAS, pursuant to Section 20- 3.4(B)(4)(b) of the Land Development Code (LDC),
the applicant, American Car Detailing has submitted Planning Board Application No. PB -10 -011
requesting a Special Use Approval to operate mobile car wash to be located is in the parking
garage of Plaza 57, an office building at 7301 SW 57th Court, within the "SR(HD -OV)"
Specialty Retail (Hometown District Overlay) zoning district,; and
WHEREAS, a Mobile Automobile Wash/Wax Service use is listed as a special use in
within the "SR(HD -OV)" Specialty Retail (Hometown District Overlay) zoning district and is
subject to meeting special use requirements set forth in LDC Section 20- 3.4(B)(20); and
WHEREAS, the approval of a special use requires a recommendation from the Planning
Board and the approval of the City Commission after a public hearing; and
WHEREAS, at its July 13, 2010 meeting the Planning Board, after public hearing, voted
5 ayes I nay to recommend approval with conditions of the special use request; and
WHEREAS, the Mayor and City Commission of the City of ,South Miami desire to
accept the recommendation of the Planning Board.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA THAT:
Section 1: Special Use Application (PB -10 -011 submitted by applicant, American Car
Detailing, for special use approval to operate a mobile automobile wash/wax Service to be
located to be located is in the parking garage of Plaza 57, an office building at 7301 SW 57th
Court, within the "SR(HD -OV)" Specialty Retail (Hometown District Overlay) zoning district is
hereby approved subject to the following three conditions:
1) This approval is valid for American Car Detailing, the designated tenant, subcontracted to

20 -3.4 SOUTH MIAMI LAND DEVELOPMENT CODE
(e) Dimensional requirements shall be approved by the city commission but in no
case shall they be less restrictive than requirements applicable to the MO
District.
(15) Reserved.
(16) ACCESSORY RETAIL AND SERVICE USES. Within any permitted principal building
in LO or MO districts, accessory retail or service uses may be permitted provided that:
(a) Such uses are located entirely within the principal building for the convenience
of the occupants of or visitors to the principal use;
(b) Such uses do not occupy more than ten (10) percent of the gross floor area of the
principal building in which located; and
(c) Such uses shall not have any signs or advertising visible from outside the
principal building.
(17) RESIDENTIAL USES WITHIN RESIDENTIAL OFFICE DISTRICTS. Within any
Residential Office 'RO" district, single - family residential uses shall be permitted
subject to the dimensional requirements of the RS 74 Single - Family Residential
district.
(18) ACCESSORY MEDICAL SERVICES
(a) Facilities may be permitted only in conjunction with an approved hospital use
and located on hospital premises.
(b) Facilities may be provided in the form of a trailer unit which is periodically
located for a specified length of time as determined by the city commission on an
approved site and conforms to all applicable codes.
(c) Only one trailer unit may be permitted per each approved, specially permitted
hospital use.
(d) Only those services that are not already provided by the hospital facility and
which is for the sole use of the hospital staff and patients may be permitted.
(e) No vehicular ingress nor egress shall be permitted along streets or rights -of -way
bordering residential zoning districts in the City of South Miami.
(f) The city commission shall review and recommend approval, disapproval or
modification of all site plans and project specifications, including but not limited
to, traffic circulation, landscaping, facility placement, access and facility arrange-
ment for this special use permit.
(19) Reserved.
(20) MOBILE AUTOMOBILE WASHAVAX SERVICE
(a) Mobile carwash services may operate from 9:00 a.m. to 5:00 p.m. on Monday
through Saturday only. No mobile service vendor shall station itself upon any
public street or right-of-way. Neither shall any mobile service vendor station
itself upon any private property except with the express permission of the owner

thereof and in a manner, which does not impede the flow of traffic in public
streets or rights -of -way nor block pedestrian access to public streets or tights -of-
way. No mobile service vendor shall station itself within one hundred (100) feet of
a residential zoning district; however, this restriction shall not apply to mobile
carwash vendors operating in residential districts and servicing the primary
residents.
(b) All mobile service vendors must provide for their own trash and garbage removal
such that no trash or garbage remains on the premises upon which the vending
was conducted.
(c) No property owner may permit mobile carwash services to operate on their
property for longer than two (2) hours, or operate on site more than two (2) times
per week.
(d) No signage, other than normal commercial graphics painted upon the actual
mobile service vehicle, shall be permitted, except as provided for in (e) below.
(e) With special use approval, exception to (c) above may be made for mobile service
vendors who are stationed within approved parking structures. No exterior
signage visible from a public street shall be permitted for locations within
parking structures.
M Mobile service vendors must operate from four -wheel motorized vehicles regis-
tered in the State of Florida.
(e) No steam - cleaning, solvents, and/or degreasers may be used.
(f) No run -off into catch basins is permitted.
(g) If soap is used, any run -off must be negligible and contained on private property.
(21) ANIMAL HOSPITAL/VETERINARIAN
(a) All such uses shall be located within a fully enclosed, air- conditioned, soundproof ,
structure.
(b) There shall be no overnight boarding of animals except for medical purposes.
(c) The hours of operation for visits and treatment will be 7:00 a.m. to 9:00 p.m.
Monday through Saturday; hours of operation shall not prevent emergency
medical treatment.
(22) AUTOMOBILE RENTAL AGENCY. The following requirements shall be applicable to
all automobile rental agencies allowed as a as special use:
(a) No ingress or egress to the automobile rental agency shall be permitted through
abutting residentially zoned parcels.
(b) When adjacent to a residential district, a landscape buffer acceptable to the city's
ERPB shall be constructed along dividing property lines.
(c) Required parking spaces are to be designated for customers and employees only,
and not to be used for the storage of vehicles.

PLAZA 57 CAR WASH AGREEMENT
This Professional Services Agreement ( "Agreement ") is made as of this 30th day of April,
2010, By and Between Irving Borge or American Car Detailing ( "Vendor or Contractor'),
with an office located at , 3100 N.W. 7'h Avenue, Miami, Florida 33127, and 7300
Investments, LLC ( "Owner "), located at 7757 SW 54 "' Court, S. Miami, F1 33143.
Subject: Car Washing at Plaza 57
Vendor: Irving Borge or American Car Detailing
Owner: 7300 Investments, LLC
Service Location: 7301 SW 57`" Court, South Miami, Fl.
Service Area: That portion of the Service Location located in the service area of Plaza 57
on the ground floor and more particularly described on Exhibit "A" attached hereto.
1. Car washing activities may take place between the hours of 8:00 a.m. and 5:30
p.m. M -F, 7 days a week. By 5:30 p.m. on the permitted days all car washing
activities must have ceased and the car wash area must be completely clean and
vacated including the removal of any standing water. Vendor may not leave any
vehicles (whether belonging to Vendor, Vendor's employees or Vendor's
customers) anywhere in the service area.
2. Vendor shall pay $450 a month plus applicable sales tax directly to Owner, at the
Owners address above, on the first day of every month during while Vendor is
utilizing the Service Area at the above Service Location, with 1" months rent in
the amount of $675 being due on or before May 15'", 2010 and the second months
rent being due in the amount of $450 on July 1", 2010.
3. Car washing activities are restricted to that portion of the Service Area
immediately adjacent and on the South side to the electrical room and restaurant
trash area of the Service Location ( "Service Area "). This Service Area shall
consist of the one exit lane and the 3 adjacent parking spot as shown on exhibit
"A" attached hereto and made a part hereof.
4. No car washing activities (including parking of Vendor's employees' or
customers' vehicles) may block the driveway areas, entrances or exits of the
service area.
5. Vendor will not engage in any solicitation activities on the Plaza 57 property.
Vendor may advise his customers who are occupants of Plaza 57 of his schedule
and may contact those customers to advise them of his presence in the building.
Plaza 57 will display a flyer (the contents of which are subject to Plaza 57's
approval) in the bulletin board located in the lobby area of the building containing
information regarding the hours of operation of the car wash.

6. Vendor may, only during the times permitted for car washing activities, place one
sign, the design of which is subject to Owner's approval, in the portion of the
Service Area where car washing is permitted.
Vendor must deliver a certificate of insurance to Owner (7300 Investments, LLC)
and Plaza 57 Condominium Association, Inc. indicating current liability insurance
coverage in form and amount satisfactory to Owner. Vendor shall maintain such
insurance in force at all times that he engages in car washing activities at Plaza
57.
8. Vendor shall comply with all government laws, codes, rules and regulations
governing car wash activities
9. Vendor shall clean vehicles owned by Rick Mattaway and Brandon Lurie at no
charge (not more than one vehicle per week for each of them).
10. Owner may terminate Vendor's permission to wash cars at Plaza 57 at any time.
11. All disputes hereunder shall be resolved by binding arbitration in accordance with
the rules of the American Arbitration Association.
12. The Contractor shall keep the premises and surrounding area free from
accumulation of waste materials, rubbish, the Contractor's tools, construction
equipment, machinery and surplus materials and leave premises in broom clean
condition.
13. Contractor shall enforce strict discipline and good order among the Contractor's
employees and other persons carrying out the Contract. The Contractor shall not
permit employment of unfit persons or persons not skilled in tasks assigned to
them.
14. Contractor shall secure and pay for all permits, licenses and inspections necessary
for proper execution and completion of work.
15. Contractor shall indemnify and hold Owner harmless against and from any and all
claims arising from the conduct, management, or performance of the work,
including without limitations any and all claims arising from any condition of the
work or arising from any breach or default on the part of the Contractor in the
performance of any covenant or agreement on his part to be performed pursuant
to the terms of this Agreement, or arising from any act of negligence of
Contractor or any of its agents, servants, employees, Subcontractors, or licensees,
or arising from any accident, injury, or damage whatsoever caused to any person,
firm or corporation and from an and all costs, reasonable counsel fees, expenses,
and liabilities incurred in or about any such claim, action, or proceeding brought
thereon; and in case any action or proceeding be brought against Owner, its
employees, agents, or directors by reason of any such claim, Contractor, on notice
from Owner, shall defend against such action or proceeding by counsel
satisfactory to Owner, unless such action or proceeding is defended by counsel for
any carrier of public liability insurance provided herein. This indemnification

shall not be affected by a claim that negligence of Owner, its employees, agents,
or directors contributed in part to the loss or damage indemnified against.

A Resolution of the Mayor and City Commission of the City of South Miami, relating to a
request pursuant to Section 20- 3.3(D) of the Land Development Code for special use
approval to operate a mobile car wash in an "SR(HD -OV)" Specialty Retail (Hometown
District Overlay) zoning district, specifically located in the parking garage of Plaza 57 an
office building at 7301 SW 57th Court; and providing for an effective date.
APPLICANT'S REQUEST:
Pursuant to Section 20- 3.3(D) of the Land Development Code (LDC) the applicant, American Car
Detailing, is requesting Special Use Approval to operate a mobile car wash in the parking garage
of Plaza 57, an office building at the above referenced location. The proposed use is within the
"SR(HD -OV)" Specialty Retail (Hometown District Overlay) which allows Mobile Automobile
Wash/Wax Service if approved through the special use process. The LDC provides that special
uses must be approved by the City Commission after a public hearing and receipt of a
recommendation from the Planning Board.
STAFF OBSERVATIONS:
(1) The proposed car wash will be located on the ground floor of the parking garage in an area
that was reserved for a future bank drive thru- teller operation. The car wash will not occupy any
space that was reserved for required parking. Attached is a copy of the ground floor site plan
(Exhibit "A ") indicating the location of the car wash operation. There is no required parking for
the car wash use.
(2) A mobile automobile wash/wax service is a special use which has special requirements (pre-
set conditions) listed in LDC Section 20- 3.4(B)(20). These conditions limit the location of the
service, the hours of operation, signage, and require certain environmental controls. Attached is a
copy of the pre -set requirements listed in the LDC.
(3) Special condition Sec. 20- 3.4(B)(22)(e) limits hours of operation to two hours a day, two
days a week at one location; however, an exemption to this limitation is allowed for mobile

service vendors located within approved parking structures. The subject applicant qualifies for
this exemption.
(4) The applicant has submitted the car wash lease agreement with the property owner (7300
Investments, LLC) of 7301 SW 57 Court.
(5) The City Commission at its February 4, 2003 approved by Resolution No. 17- 03- 11566, a
similar car wash service which has been operating to date in the parking garage at the Shops at
Sunset Place.
SPECIAL CONDITIONS APPLICABLE:
The overall purpose of going through the special use process is to determine the compatibility of
the proposed use with the surrounding neighborhood. In addition to the pre -set requirements set
forth in Section 20- 3.4(B)(20) a special use must also comply with the conditions set forth in
Section 20- 5.8(B) in that the use:
a) Will not adversely affect the health or safety of persons residing or working in the
vicinity of the proposed use;
b) Will not be detrimental to the public welfare or property or improvements in the
neighborhood; and
e) Complies with all other applicable Code provisions.
RECOMMENDATION
The requested special use is recommended for approval with the following supplemental
conditions:
1) This approval is valid for American Car Detailing, the designated tenant, subcontracted to
provide carwash services. At any time in the future that the tenant shall change, the new
tenant shall agree to these conditions of approval as a requirement for obtaining an
occupational license for this location.
2) Car washing shall only occur in the designated car wash area on the ground floor
3) If the subject car wash is, in the future, determined by the Director of Plam3ing, to be
adversely affecting the health or safety of persons residing or working in the vicinity of the
proposed use, to be detrimental to the public welfare or property or improvements in the
neighborhood, or to be not in compliance with other applicable Code provisions, the special
use approval may be modified or revoked by the City Commission upon notification and
public hearing.

Action: Mr. Cruz read the item into the record.
Mr. Youkilis informed the Board that the application is for a Special Use Approval, since Mobile
Car Wash requires approval as a Special Use in the district it is located in. The applicant is
submitting for a mobile car wash in a parking garage on the ground floor. This is located in 7301
SW 57 Court in Plaza 57 Building. The Planning Board would have to give a recommendation
that would then go to the City Commission. The car wash would be located in the building in an
area which was going to be used for a teller operation for a bank. The car wash application has a
number of pre -set restrictions and conditions that in the Land Development Code. If the
applicant is going to operate in a parking garage they would have to meet the requirements on
limited signage and hours. In the case of the garage, there will be no limitation on hours and they
would not have to move every two hours. In 2003, the City Commission approved the a car wash
that is operating in the Shops at Sunset Place parking garage. Staff recommends approval with
three conditions.
Mr. Morton questioned the hours of operation for the business. Mr. Youkilis responded that by
the City regulations they could only work Monday through Saturday 9:00 am- 5:00 pm. Mr.
Goldstein commented that in the applicant's' agreement with the property" owner vendors must
comply with all government regulations.
Mr. Morton questioned the exception provided to a garage located car wash. Mr. Youkilis
replied that the exception set forth in LDC Section 20- 3.4(B)(20)(e) is approved by the City
Commission as part of the special use approval process which will be incorporated as part of the
Board's recommendation The exception allows the applicant to operate in "a parking garage
without being limited to the two hours in one location and to operate at that site more than two
times a week.
Mr. Morton commented that the agreement is contradictory. Mr. Youkilis commented that the
applicant must still abide by the City regulations.
Mr. Whitman questioned if there was a previous submission for a Mobile Car Wash in this same
location. Mr. Youldlis responded not that he remembers.
Ms. Beckman commented that there is no current survey attached with the package. When
visiting the property recently it was brought to her attention that there was no places were there
could be a car wash on the eastern section of the building. She further commented that there is no
space for the trash collection trucks to get the trash. She questioned if the water is going to run
off and how would the residents get by. Mr. Youkilis commented that Town Restaurant is
located on the other side of the building far from the car was area. Mr. Youkilis informed the
Board that the owner would be submitting a Special Use application for a restaurant at that
southwest corner of the building.

Mr. Borge informed the Board that he was there to represent American Car Detailing. He
commented that the trash collection has nothing to do with the car wash since they are in
different locations. The mobile car wash location has been reserved and the landlord has clearly
stated that no one will be allowed to park in that location. The only people that are allowed to be
parked there consist of the mailman and handicap. Everyone has to use the ramp going up into
the parking garage.
Ms. Young questioned how long has the applicant been in business and how many employees
does the applicant plan on hiring. The applicant responded since 1983 and he will hire 6 -7
people. He commented that the car wash is a good idea, since individuals could leave there car
at the car wash while they take care of their business.
Mrs. Beckman questioned that in a particular location how is the trash collection going to occur.
Mr. Borge replied that there is an entrance and an exit. The location is being used only by
handicap and mobile car wash.
Mrs. Yates requested the applicant to explain their operation. The applicant stated that there will
be no run off since the water would be going into a tank.
Mr. Morton questioned the stacking formation of the cars. The applicant responded that the
landlord has allowed the car wash to park the cars in the parking garage once all the spaces in the
car wash area have been filled. He has also purchased parking pass that he has t in order to allow
the cars to park in the garage.
Mrs. Beckman questioned how the applicant would be getting his clients since he can not
advertise and how many cars are you planning to wash in one day. The applicant responded
through word of mouth. We have estimated thirty cars a day, if there is no rain.
Mrs. Beckman questioned if staff could provide the Board with the required twenty signatures of
surrounding neighbors. Mr. Youkilis responded that the signatures were not required since the
LDC was changed two years ago. A preliminary notice is required to be sent to all property
owners within five hundred feet. He commented that the notice is not included, but Ms. Beckman
could see the notice in the file.
Mrs. Beckman questioned in the November 18, 2008 meeting, a car wash issue went in front of
the Commission it was voted down. Mr. Youkilis responded that it was a text amendment to
allow car washes as a Permitted Uses with pre -set conditions. Mrs. Beckman commented that a
majority of the City Commission carne to the conclusion that the car wash needs to be Special
Use. She questioned what the current difference is. Mr. Youkilis commented that the previous
amendment was a propose change in the text of the use schedule but it was not adopted.

Mr. Youkilis commented that staff recommends approval since this is inside a garage, there is no
run off and it is similar to the one operating in Shops at Sunset.
Mrs. Beckman recommended that staff should provide better pictures with dimensions.
Mr. Cruz questioned the means of egress of the entrance and exits and will the design changed.
The applicant commented that the way that the garage was designed is the same exact way that it
is going to be used.
Mrs. Yates questioned if the entrance and exits of the alley way would be blocked. Mr. Borge
responded that there is plenty of room and it will not be blocked.
The Chair closed the public hearing.
The applicant thanked the Board and invited them to the mobile car wash.
Motion: Mrs. Young moved and Mr. Morton seconded to approve the application as presented
(with the operating hours exception listed in Sec. 20- 3.4.(13)(20)(e)), with following conditions:
