Request: Authorizing the Acting City Manager to issue a work order to Fireworks Displays Unlimited, LLC in order to provide the 4 °i of July Fireworks Show at Palmer Park as budgeted in the FY 2009 -2010 Approved Expense Budget. Reason/Need: The attached resolution seeks approval to provide fireworks display services for the 2010 4 °i of July Celebration to be held at Palmer Park. As is the tradition every year, we are hosting our annual 4h of July celebration at Palmer Park to include a 15 minute fireworks show to culminate the event. This vendor was the lowest bidder amongst the following three qualified vendors. ➢ Fireworks Displays Unlimited $ 8,900.00 ➢ Zambelli International Fireworks $ 10,000.00 ➢ Garden State Fireworks $ 10,000.00 Fireworks Display Unlimited, LLC has historically provided the City of South Miami and other municipalities in South Florida with many outstanding fireworks performance. It will be on the City's best interest to use Fireworks Displays Unlimited since it is the lowest bidder and since historically, they have been providing the City with an excellent Fireworks display. It is important to understand that, pursuant to the direction of the City Commission, the Administration is working to raise sufficient funds for the non firework elements of the event. We must commit to the firework at this time to ensure that this vendor is available. WHEREAS, The City Commission wishes to provide fireworks show during the annual 4th of July Celebration at Palmer Park; and WHEREAS, Fireworks Displays Unlimited, LLC, is a qualified vendor selected as the lowest responsive bidder from a competitive bidding process; and WHEREAS, the firework display services will be funded from Parks and Recreation Department's 4th of July Fireworks account number 001- 2000 -572 -4820. In the event Sponsor shall fail to pay any sum when due under the terms of this contract, Sponsor shall pay, in addition to such amount, interest at the rate of 1 -1/2% per month on the unpaid amount from the original due date. Sponsor does further agree that it shall pay Fireworks Displays' reasonable attorney fees and court costs in the event Fireworks Displays shall commence suit or incur fees to compel Sponsor to pay any sums due hereunder or otherwise as a result of Sponsor's default of any of the terms and provisions herein contained. 3. SPONSOR'S AGENT: Patrick Duicio shall be designated as sponsor's agent to whom all questions and inquiries shall relay all questions and Inquiries. Sponsor's agent shall be the only agent of sponsor authorized to request rescheduling of the delivery and exhibition of the fireworks on the part of sponsor. S Miami - Page 1 of 6 4. If event is on land, sponsor to furnish police and /or crowd security personnel, provide proper parking supervision, and insure adequate patrol of the safety zone as marked and secured by the sponsor until Fireworks Displays Unlimited, LLC advises that it is no longer necessary. 5. If event is over water, Fireworks Displays Unlimited will be responsible for marine permit. The Sponsor will be responsible for control of safety zone. Fireworks Displays Unlimited, LLC. reserves the right to stop the display in the event persons, vehicles or animals enter the secured safety zone and security is unable or unwilling to remove them and enforce the safety regulations. 6. Fireworks Displays Unlimited, LLC. will furnish all applicable licenses, permits and $1,000,000 liability insurance and pyrotechnicians for your electronically fired display. 7. NOTE: In accordance with local regulations and ordinances, fireworks displays shall not take place later than 10:30pm unless approval is obtained from the governing authority. The restrictions shall not be applicable with regards to holidays such as December 31, January 1, or other national holidays. If for some reason, shoot time does not occur before the allotted time and shoot is cancelled due to local authority or expiration of permit, Sponsor is liable for full payment of display. 8. Hold harmless Fireworks Displays Unlimited, LLC. from any claims that do not directly relate to damages produced by its staff, equipment or pyrotechnic material. 9. Fireworks Displays will hold harmless, indemnify and defend any claims arising from or associated to the fireworks display. 10. CREDITS: As a material inducement to Fireworks Displays agreeing to enter into this agreement, Sponsor shall give Fireworks Displays program credit as sole fireworks supplier and producer in all press releases, advertising, and any other program announcements, printed or otherwise. 11. If the show is stopped while in progress for any reason not caused by Fireworks Displays Unlimited, LLC, sponsor is responsible for any permit, fire watch or barge /tug fees, if applicable. Additionally, sponsor will be responsible for load in/ load out expenses not to exceed 50% of budget. If show is stopped while in progress for any reason, Sponsor will still be responsible for contract amount minus the cost of material not discharged. 12. If wind exceeds 20 miles per hour, fireworks display will be postponed to an agreed date between sponsor and Fireworks Displays Unlimited, LLC, 13. Rain date policy is a follows: If rain prevents the fireworks display from proceeding, the fireworks display will be postponed to an agreed date between sponsor and Fireworks Displays Unlimited, LLC. 14. If the delivery and /or exhibition of the fireworks are postponed by reason of inclement weather, it shall be re- scheduled to the Inclement Weather Date set forth by Sponsor.(July 5, 2010) 15. IMPORTANT NOTE: Items listed in this proposal assume a firing area that conforms to NFPA Code 1123 -1995, which states that there must be at least 70 feet per inch of shell diameter between firing site and any spectators, cars or buildings. This program requires a safety zone that has a radius of 300 feet because of the inclusion of 4 -inch shells. Adjustments will be made to the content of this program if necessary to conform to NFPA 1123 -1995. 16. The proposal is attached and incorporated as Exhibit I to this Agreement . Carlton, Acting City Manager ®' SUBJECT: Fourth of July Celebration DATE: April 19, 2010 For the past 35 years the City of South Miami has provided a popular Fourth of July event. This event has brought many families together from all over the county to share in the celebration of our Nations Independence. Our City has always taken pride by celebrating this day with top notch activities and entertainment followed by a spectacular fireworks display. Throughout the years, the City has provided spectators with entertainment such as live music through various types of bands, activities especially for children, various food vendors, and give -a -ways. This event has increased in popularity and scope throughout the years, bringing in more events for our residents and other surrounding communities.. With the cancellation of other fireworks displays by adjacent municipalities, specifically; the City of Coral Gables, City of West Miami, Village of Pinecrest, and Baptist Hospital the attendance in our celebration has increased dramatically. Last year attendance peaked at approximately 5,000 people. Two years ago the City's cost for this event was $32, 000. Last year it cost a net of $26,000 with assistance from various sponsors in the amount of $4,400. (Attachment 1) The adopted FY 09/10 City of South Miami budget includes only $9,500 for fireworks and no additional allocation for the traditional activities. (Attachment 2) The cost to provide a comparable event to last year would be approximately $30,000, leaving a budget shortfall of approximately $21,000 without sponsorships. There are a number of suggestions to resolve this problem: 1) Leave the FY 09/10 allocation of $9,500 as is, and set a time limit of May 31, 2010, to raise additional sponsorships. We will then set an event that equals this budgeted allocation plus any sponsorship dollars received. 2) Seek financial support from neighboring jurisdictions and Miami Dade County, since our event has become regional in nature. This could provide additional funds to be added to our allocation plus sponsorships. We would still establish activities only at the level of funds available. 3) Should the City Commission decide to keep the event offerings at the previous years levels, combine I and 2 above and allocate additional dollars from contingency. This matter has been scheduled for a Manager's Report to receive direction regarding the 0 of July Fireworks Celebration at Palmer Park.
