Secretary Sole asked me to respond to the City's resolution number 55- 10- 13089, regarding the
proposed FPL Turkey Point Units 6 &7 Site Certification Application (SCA). The resolution
specifically urged Florida's Department of Environmental Protection (DEP) to suspend the SCA.
On April 11, 2008 the Public Service Commission (PSC) granted FPUs determination of need for
Turkey Point Units 6 &7 (see: htg :/ /www psc state fl us /librar /y filings/08/02812-08/02812-
08.Rdf). In accordance with 403.519(4)(d), F.S., "The commission's determination of need for a
nuclear or integrated gasification combined cycle power plant shall create a presumption of
public need and necessity and shall serve as the commission's report required by s.
403.507(4)(a). An order entered pursuant to this section constitutes final agency action. Any
petition for reconsideration of a final order on a petition for need determination shall be filed
within 5 days after the date of such order. The commission's final order, including any order on
reconsideration, shall be reviewable on appeal in the Florida Supreme Court. Inasmuch as delay
in the determination of need will delay siting of a nuclear or integrated gasification combined
cycle power plant or diminish the opportunity for savings to customers under the federal
Energy Policy Act of 2005, the Supreme Court shall proceed to hear and determine the action as
expeditiously as practicable and give the action precedence over matters not accorded similar
precedence by law." The legislature has not granted DEP the authority to unilaterally suspend
an SCA.
Your resolution highlights the City's interest in this application. In this regard, it appears that
on 1/29/10, the City filed to be a party in the Division of Administrative Hearing case (see:

003575), to which the Department is also a party.
I'm re- attaching my response to a prior City resolution number 67- 09- 12876, dated July 6+s, 2009.
In that resolution, the City indicated their opposition to FPL's proposed eastern transmission
corridor, and sought to lobby the state legislature to either alter the route or to run the lines
underground. In my response, I explained the means by which the City may propose an
alternate corridor. The deadline for such a filing has been extended to August 13, 2010 and the
current application schedule can be seen here:

A resolution of the Mayor and City Commission of the City of South Miami,
Florida, urging the Department of Environmental Protection ( "DEP ") to
suspend FPL's site certification application for Turkey Point units 6 and 7
with regard to placing 85 to 105 foot overhead high voltage transmission
lines on US i to connect the Turkey Point power plant to the downtown
Miami; allowing the City Manager to use all legislative and administrative
means necessary to ensure DEP's suspension of the application; providing
for an effective date.
WHEREAS, Florida Power and Light ( "FPL ") desires to place 85 to 105 foot overhead
high voltage transmission lines through Miami -Dade County, specifically on Dixie Highway
( "US 1"), between Turkey Point in South Miami -Dade and Downtown Miami; and
WHEREAS, the deteriorating regulatory and business environment may result in the
suspension of plans to construct two new reactors at the Turkey Point nuclear plant; and
WHEREAS, this suspension would leave no need for overhead high voltage transmission
lines specifically on US l; and
WHEREAS, the transmission lines portion of the Site Certification Application for
Turkey Point Units 6 and 7 can wait to be built when the nuclear plant portion of the application
is resolved; and
WHEREAS, the transmission lines portion of the Site Certification Application for
Turkey Point Units 6 and 7 would not be necessary when the nuclear plant portion of the
application is suspended, especially since the projected electric needs are being met at this time,
and even for years to come;
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION
OF THE CITY OF SOUTH MIAMI, FLORIDA, AS FOLLOWS:
Section 1. That the City Commission hereby urges the Department of Environmental
Protection ( "DEP ") to suspend FPL's site certification application for Turkey Point Units 6 and 7
with regard to placing 85 to 105 foot overhead high voltage transmission lines on US I to
connect the Turkey Point power plant to the Downtown Miami substation and allowing the City
Manager to use all legislative and administrative means necessary to ensure DEP's suspension of
the application.

Thank you for forwarding your Resolution 67 -09- 12876, dated April 7, 2009, regarding
FPL's proposed eastern transmission line associated with the Turkey Point Nuclear Plant
expansion. Secretary Sole asked me to respond on his behalf, in order to provide you with
the necessary means to address your concerns.
The Florida Department of Environmental Protection (DEP) is the coordinating agency for
"Site Certification Applications" which are submitted under the Florida Electrical Power
Plant Siting Act (PPSA). DEP is also the primary state agency for the protection,
conservation and management of Florida's natural resources and enforcing the State's
environmental laws. In accordance with 403.507(5)(c), Florida Statutes, the Department
will incorporate your Resolution into the project analysis for the transmission lines. At
this time, we anticipate that project analysis to be issued during the last week of October.
When applying for site certification for a power plant and associated facilities, utility
companies identify the location of the proposed facilities. However, as part of the siting
process, local governments are afforded an opportunity to be parties to the process and as
such, may provide valuable input to the Department's overall recommendations. In
addition, FPL has opted to allow other parties to propose alternate transmission line
corridors to those reflected in its application pursuant to Section 403.5064(4), Florida
Statutes. I recommend that your legal counsel review that portion of the statutes
comprising the PPSA (Sections 403.501- 403.519, F.S.) and the portions of the
Transmission Line Siting Act incorporated into the PPSA related to alternate transmission
line corridors (Sections 403.521- 403.526, 403.527(4) and 403.5271, F.S.). For the

For your use, please consider the following thoughts with regards to your Resolution:
1. Section 1 appears to promote the use of alternate corridor(s) for the proposed
eastern transmission line. Please be aware that in order to properly advocate
alternate corridors, parties must meet a filing deadline of October 8th as well as
meet certain requirements within the Florida Statutes and Florida Administrative
Code. By way of example, these requirements include (but are not limited to):
A. The filing must include, among other things, the most recent United States
Geological Survey 1:24,000 quadrangle maps specifically delineating the corridor
boundaries;
B. Proper notice should be given to all local landowners whose property, as noted in
the most recent local government tax records, and residences, are located within
one - quarter mile of the proposed boundaries of an alternate transmission line
corridor;
C. Each proponent of an alternate transmission line corridor must arrange for
publication of newspaper notice of the filing of the proposal for an alternate
corridor.
2. Section 2 seems to infer that the placement of transmission lines underground will
reduce exposure to Electro- Magnetic Fields (EMF). In my experience, magnetic
fields directly above underground line sections can be higher than directly under
the equivalent overhead line section due to closer proximity to the underground
conductor (e.g. underground cables are located 3 to 4 feet below the ground level
whereas overhead conductors may be located 40 feet or more above the ground). In
addition, changing facilities from overhead to underground invariably comes with
an increased cost.

A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF
THE CITY OF SOUTH MIAMI, FLORIDA, RELATING TO
OPPOSING THE PROPOSED ROUTES ALONG THE LUDLUM
TRAIL OR ALONG US HIGHWAY 1, FOR THE FPL
TRANSMISSION LINE: AND PROPOSING THE EVALUATION OF
AN ALTERNATE ROUTE ALONG SR 826, SR 836 OR SR 874;
PROVIDING FOR TRANSMITTAL TO THE STATE, AGENCIES,
AND OTHER COMMUNITIES; PROVIDING AN EFFECTIVE DATE.
WHEREAS, Florida Power and Light (FPL) is considering the construction of a
transmission line in order to increase capacity and connect the turkey point power station
to downtown Miami and points North; and,
WHEREAS, one proposed FPL route is along US Highway I and a second
potential route is the railroad corridor along the Ludlum Trail through the City of South
Miami; and,
WHEREAS, the Ludlum Trail proposed route runs adjacent to and in close
proximity to established residential neighborhoods and two existing schools; and,
WHEREAS, the proposed US Highway 1 route runs adjacent to and in close
proximity to an established residential neighborhood, hospitals, schools and other
occupied commercial buildings; and,
WHEREAS, locating transmission lines through densely populated areas imposes
an unreasonable burden on the affected community due to exposure to EMF, audible
noise, visual impact and danger of collapsed lines; and,
WHEREAS, the siting of electric transmission power lines along public highway
right -of -ways and other corridors with relatively small right -of -ways poses significant
health and safety concerns; and,
WHEREAS, the siting of electric transmission power lines along public highway
right -of -ways with larger buffers and wider right -of -ways such as State Road 826, State
Road 836, and State Road 874 for example, minimizes impacts on residential'
communities, businesses, hospitals and schools; and,

WHEREAS, the Mayor and City Commission seek to lobby the State Legislature
relating to same.
NOW THEREFORE BE IT RESOLVED BY THE MAYOR AND CITY

Section 1. That the Mayor and City Commission does hereby state its
opposition to the Ludlam Trail route and the U.S. highway 1 route for the proposed
transmission line proposed by FPL, and propose the relocation of the FPL transmission
lines along larger public highway rights-of-way, including, but not limited to SR 826, 836
and 874.
Section 2. In the event that one of the routes through the City of South Miami
is ultimately selected that the Mayor and Commission formally request FPL to place the
transmission lines running through the City under ground to reduce the adverse impacts
of electric magnetic fields on the citizens and visitors to South Miami.
Section 3, The Mayor and City Commission encourage FPL to work with the
Department of Transportation to identify transmission line routes that minimize exposure
to population centers.
Section 4. The Mayor and City Commission directs the City Clerk to transmit
a certified copy of this resolution to the Governor, Senate President, House Speaker, the
Chair and Members of the Miami -Dade County State Legislative Delegation, the
Presiding Officer and Members of the municipalities in Miami -Dade County and the
Executive Director of the Miami- League of Cities, and the Florida Department of
Environmental Protection and FPL.
Section 5. This resolution shall take effect immediately upon approval.
